    Amends the Counties Code. Provides that the treasurer of a county shall reimburse a senior citizen, who is a resident of the treasurer's county, for public transportation costs incurred by the senior citizen within another county of the State for a medical appointment or medical services after the senior citizen provides specified documentation. Defines terms. Requires a medical provider to provide to a senior citizen, upon request, a completed uniform form, which the Department of Public Health shall prescribe for statewide use. Lists uniform form requirements. Limits home rule powers. Amends the State Mandates Act to require implementation without reimbursement.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by adding Section
53-10022 as follows:
 
6    (55 ILCS 5/3-10022 new)
7    Sec. 3-10022. Reimbursement of intercounty medical
8transportation costs of senior citizens.
9    (a) As used in this Section,
10    "Public transportation" has the meaning given to that term
11under subsection (a) of Section 5-5-3.2 of the Unified Code of
12Corrections.
13    "Senior citizen" means an individual aged 65 or older who
14meets the income eligibility limitation under subsection (a-5)
15of Section 4 of the Senior Citizens and Persons with
16Disabilities Property Tax Relief Act.
17    (b) The treasurer of a county shall reimburse a senior
18citizen, who is a resident of the treasurer's county, for
19public transportation costs incurred by the senior citizen
20within another county of the State for a medical appointment or
21medical services. Reimbursement shall occur within a
22reasonable time after the senior citizen has provided the
23following documentation to the treasurer's office:

1        (1) a receipt showing payment of public transportation
2    costs to a medical provider in another county; and
3        (2) a completed form, as provided for in subsection
4    (c), from the medical provider.
5    Public transportation that begins in the senior citizen's
6county that ends near the medical provider's office is
7reimbursable in full.
8    (c) Upon request from a senior citizen, a medical provider
9shall provide to the senior citizen a completed uniform form
10that the Department of Public Health shall prescribe for
11statewide use. The form shall include: an acknowledgment that
12the individual is a senior citizen; a statement that the
13individual was present in the medical provider's office,
14including the date the senior citizen was present; and an
15acknowledgment that public transportation was used to get the
16individual to the medical provider's office.
17    (d) A home rule county may not regulate the reimbursement
18of senior citizens for public transportation costs to a medical
19provider in a manner inconsistent with this Section. This
20Section is a limitation under subsection (i) of Section 6 of
21Article VII of the Illinois Constitution on the concurrent
22exercise by home rule units of powers and functions exercised
23by the State.
 
24    Section 90. The State Mandates Act is amended by adding
25Section 8.44 as follows:

1    (30 ILCS 805/8.44 new)
2    Sec. 8.44. Exempt mandate. Notwithstanding Sections 6 and 8
3of this Act, no reimbursement by the State is required for the
4implementation of any mandate created by this amendatory Act of
5the 101st General Assembly.
