Amends the Illinois Public Aid Code. Provides that, for the purposes of the nursing home bed fee, the term "provider" does not include any county that provides skilled nursing or intermediate long-term care services.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Public Aid Code is amended by |
5 | | changing Section 5E-5 as follows:
|
6 | | (305 ILCS 5/5E-5)
|
7 | | Sec. 5E-5. Definitions. As used in this Article, unless the
|
8 | | context requires otherwise:
|
9 | | "Nursing home" means (i) a skilled nursing or intermediate |
10 | | long-term care
facility, whether public or private and whether |
11 | | organized for profit or
not-for-profit, that is subject to |
12 | | licensure by the Illinois Department
of Public Health under the |
13 | | Nursing Home Care Act, the ID/DD Community Care Act, or the |
14 | | MC/DD Act, including a
county nursing home directed and |
15 | | maintained under Section
5-1005 of the Counties Code, and (ii) |
16 | | a part of a hospital in
which skilled or intermediate long-term |
17 | | care services within the
meaning of Title XVIII or XIX of the |
18 | | Social Security Act are
provided; except that the term "nursing |
19 | | home" does not include a facility
operated solely as an |
20 | | intermediate care facility for the intellectually disabled

21 | | within the meaning of Title XIX of the Social Security Act or a |
22 | | specialized mental health rehabilitation facility.
|
23 | | "Nursing home provider" means (i) a person licensed
by the |

1 | | Department of Public Health to operate and maintain a
skilled |
2 | | nursing or intermediate long-term care facility which charges |
3 | | its
residents, a third party payor, Medicaid, or Medicare for |
4 | | skilled nursing or
intermediate long-term care services, or |
5 | | (ii) a hospital provider that
provides skilled or intermediate |
6 | | long-term care services within
the meaning of Title XVIII or |
7 | | XIX of the Social Security Act.
"Nursing home provider" does |
8 | | not include a person who operates or a provider who provides |
9 | | services within a specialized mental health rehabilitation |
10 | | facility. For purposes of this paragraph, "person" means any |
11 | | political
subdivision of the State, municipal corporation, |
12 | | individual,
firm, partnership, corporation, company, limited |
13 | | liability
company, association, joint stock association, or |
14 | | trust, or a
receiver, executor, trustee, guardian, or other |
15 | | representative
appointed by order of any court , but does not |
16 | | include any county that provides skilled nursing or |
17 | | intermediate long-term care services . "Hospital provider" |
18 | | means a
person licensed by the Department of Public Health to |
19 | | conduct,
operate, or maintain a hospital.

20 | | "Licensed bed days" shall be computed separately for each |
21 | | nursing home
operated or maintained by a nursing home provider |
22 | | and means, with respect to a
nursing home provider, the sum for |
23 | | all nursing home beds of the number of days
during a calendar |
24 | | quarter on which each bed is covered by a license issued to
|
25 | | that provider under the Nursing Home Care Act or the Hospital |
26 | | Licensing Act.
