SYNOPSIS AS INTRODUCED:

    Amends the Abraham Lincoln Presidential Library and Museum Act. Provides that the Executive Director of the Abraham Lincoln Presidential Library and Museum shall appoint a Facilities Services Director (rather than a Library Facilities Operations Director) and a Library Services Director (rather than a Director of the Library). Provides that the State Historian may, with the consent of the Executive Director (rather than the Board of Trustees of the Abraham Lincoln Presidential Library and Museum), exchange specified materials which the library may acquire that are of no historical interest or for any reason are of no value to it, with any other library, school, or historical society. Removes provisions concerning the Illinois Historical Collections. Modifies requirements concerning the preservation of selected past editions of newspapers of this State as historical records. Repeals the State Historical Library Act. Makes conforming changes.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Abraham Lincoln Presidential Library and
5Museum Act is amended by changing Sections 30, 35, and 45 as
6follows:

8    Sec. 30. Administration of the Agency. The Agency shall be
9under the supervision and direction of an Executive Director.
10The person serving on the effective date of this Act as Library
11Director, as defined in Section 33 of the Historic Preservation
12Act, shall become the inaugural Executive Director on the
13effective date of this Act and shall serve as Executive
14Director until the expiration of his then-current term as
15Library Director. Thereafter, the Board shall appoint the
16Executive Director with the advice and consent of the Senate.
17The Executive Director shall serve at the pleasure of the Board
18for a term of 4 years. The Executive Director shall, subject to
19applicable provisions of law, execute and discharge the powers
20and duties of the Agency. The Executive Director shall have
21hiring power and shall appoint (a) a Facilities Services
22Library Facilities Operations Director; and (b) a Director of
23the Library Services Director. The Executive Director shall

1appoint those other employees of the Agency as he or she deems
2appropriate and shall fix the compensation of the Facilities
3Services Library Facilities Operations Director, the Director
4of the Library Services Director, and other employees. The
5Executive Director may make provision to establish and collect
6admission and registration fees, operate a gift shop, and
7publish and sell educational and informational materials.

10    Sec. 35. State Historian; exchange historical records. The
11State Historian shall make all necessary rules, regulations,
12and bylaws not inconsistent with law to carry into effect the
13purposes of this Act and to procure from time to time as may be
14possible and practicable, at reasonable costs, all books,
15pamphlets, manuscripts, monographs, writings, and other
16material of historical interest and useful to the historian
17bearing upon the political, physical, religious, or social
18history of the State of Illinois from the earliest known period
19of time. The State Historian may, with the consent of the
20Executive Director Board, exchange any books, pamphlets,
21manuscripts, records, or other materials which such library may
22acquire that are of no historical interest or for any reason
23are of no value to it, with any other library, school or
24historical society. The State Historian shall distribute
25volumes of the series known as the Illinois Historical

1Collections now in print, and to be printed, to all who may
2apply for same and who pay to the Library and Museum for such
3volumes an amount fixed by the State Historian sufficient to
4cover the expenses of printing and distribution of each volume
5received by such applicants. However, the State Historian shall
6have authority to furnish 25 of each of the volumes of the
7Illinois Historical Collections, free of charge, to each of the
8authors and editors of the Collections or parts thereof; to
9furnish, as in his or her discretion he or she deems necessary
10or desirable, a reasonable number of each of the volumes of the
11Collections without charge to archives, libraries, and similar
12institutions from which material has been drawn or assistance
13has been given in the preparation of such Collections, and to
14the officials thereof; and to furnish, as in his or her
15discretion he or she deems necessary or desirable, a reasonable
16number of each of the volumes of the Collections without charge
17to the University of Illinois Library and to instructors and
18officials of that University, and to public libraries in the
19State of Illinois. The State Historian may, with the consent of
20the Board, also make exchanges of the Historical Collections
21with any other library, school or historical society, and
22distribute volumes of the Collections for review purposes.

25    Sec. 45. State Historian; historical records. The State

1Historian shall establish and supervise a program within the
2Agency designed to preserve as historical records selected past
3editions of newspapers of this State. Such editions and other
4materials shall be preserved in accordance with industry
5standards and shall be stored in a place provided by the
6Agency. The negatives of microphotographs and other materials
7shall be stored in a place provided by the Agency.
8    The State Historian shall determine on the basis of
9historical value the various newspaper edition files which
10shall be preserved and shall arrange a schedule for such
11preservation. The State Historian or his or her designee shall
12work with library personnel in shall supervise the making of
13arrangements for acquiring access to past edition files and
14copyright permissions with the editors or publishers of the
15various newspapers.
16    The method of microphotography to be employed in this
17program shall conform to the standards established pursuant to
18Section 17 of the State Records Act.
19    Upon payment to the Agency of the required fee, any person
20or organization shall be granted access to the preserved
21editions of newspapers and all records supplied with any prints
22requested to be made from the newspapers and all records. The
23fee required shall be determined by the State Historian and
24shall be equal in amount to the costs incurred by the Agency in
25granting such access supplying the requested prints.
