Amends the Illinois Governmental Ethics Act. Provides that a legislator shall declare a conflict of interest before taking official action on a legislative matter, and shall request to be excused from voting on the matter, if the legislator or a member of the legislator's immediate family has a financial interest in a business, investment, real property, lease, or other enterprise, and if the interest is substantial and the effect on that interest of the action to be voted on is greater than the effect on the general public of the State. Provides that the Legislative Ethics Commission may impose a fine of not more than $1,000 upon a member of the General Assembly for each violation of the provision. Repeals previous provisions concerning legislator conflict situations.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Illinois Governmental Ethics Act is amended |
5 | | by adding Section 3-108 as follows: |
6 | | (5 ILCS 420/3-108 new) |
7 | | Sec. 3-108. Conflicts of interest recusal. |
8 | | (a) A legislator shall declare a conflict of interest |
9 | | before taking official action on a legislative matter, and |
10 | | shall request to be excused from voting on the matter, if the |
11 | | legislator or a member of the legislator's immediate family has |
12 | | a financial interest in a business, investment, real property, |
13 | | lease, or other enterprise, and if the interest is substantial |
14 | | and the effect on that interest of the action to be voted on is |
15 | | greater than the effect on the general public of the State. |
16 | | (b) For the purposes of this Section, an interest is |
17 | | substantial if it meets or exceeds the thresholds for |
18 | | disclosure established under Section 4A-102 of this Act. |
19 | | (c) The Legislative Ethics Commission may impose a fine of |
20 | | not more than $1,000 upon a member of the General Assembly for |
21 | | each violation of subsection (a).
