Amends the Criminal Code of 2012. Provides that the penalty for knowingly buying or selling, or offering to buy or sell, a
human body or any part of a human body is a Class 4 felony (rather than a Class A misdemeanor) for the first conviction and a Class 3 felony (rather than a Class 4 felony) for subsequent convictions.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 5. The Criminal Code of 2012 is amended by changing |
5 | | Section 12-20 as follows: |
6 | | (720 ILCS 5/12-20) (from Ch. 38, par. 12-20)

7 | | Sec. 12-20. Sale of body parts.
|
8 | | (a) Except as provided in subsection
(b), any person who |
9 | | knowingly buys or sells, or offers to buy or sell, a
human body |
10 | | or any part of a human body, is guilty of a Class 4 felony A |
11 | | misdemeanor
for the first conviction and a Class 3 4 felony for |
12 | | subsequent convictions.

13 | | (b) This Section does not prohibit:
|
14 | | (1) An anatomical gift made in accordance with the |
15 | | Illinois
Anatomical Gift
Act.

16 | | (2) (Blank).
|
17 | | (3) Reimbursement of actual expenses incurred by a |
18 | | living person in
donating an organ, tissue or other body |
19 | | part or fluid for transplantation,
implantation, infusion, |
20 | | injection, or other medical or scientific purpose,
|
21 | | including medical costs, loss of income, and travel |
22 | | expenses.
