Creates the Emotional Abuse Rehabilitation Act. Defines terms. Provides that a judge shall determine whether a domestic abuser is subject to immediate psychiatric evaluation and detainment until the psychiatric evaluation is completed. Provides that a survivor has the option to participate in a psychiatric evaluation of his or her significant other. Provides that a domestic abuser shall participate immediately in an inpatient de-escalation skills training before the domestic abuser may return to the household. Provides that a recovering domestic abuser shall complete a 3-month outpatient program to continue skill building and positive coping behavior.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 1. Short title. This Act may be cited as the |
5 | | Emotional Abuse Rehabilitation Act. |
6 | | Section 5. Definitions. As used in this Act: |
7 | | "Domestic abuser" means any person reasonably suspected to |
8 | | be emotionally or monetarily abusing his or her significant |
9 | | other. |
10 | | "Recovering domestic abuser" means a person who has |
11 | | participated and completed a de-escalation skills program. |
12 | | "Relapsed domestic abuser" means a person who has been |
13 | | identified on a second or subsequent incident as displaying |
14 | | abusive characteristics. |
15 | | "Survivor" means a significant other of a domestic abuser. |
16 | | Section 10. Emotional abuse rehabilitation. A judge, after |
17 | | notice and hearing, shall determine whether a domestic abuser |
18 | | is subject to immediate psychiatric evaluation and detainment |
19 | | until the psychiatric evaluation is completed. A survivor has |
20 | | the option to participate in a psychiatric evaluation of his or |
21 | | her significant other. A judge may order a domestic abuser to |
22 | | participate immediately in an inpatient de-escalation skills |
