| 2 | | Be it enacted by the People of the State of Illinois,

| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Hospital Licensing Act is amended by adding |
| 5 | | Section 6.27 as follows:
|

| 7 | | Sec. 6.27. Intended parent; delivery room. |
| 8 | | (a) As used in this Section, "gestational surrogate", |
| 9 | | "gestational surrogacy contract", and "intended parent" have |
| 10 | | the meanings given to those terms in Section 10 of the |
| 11 | | Gestational Surrogacy Act. |
| 12 | | (b) If a hospital has a gestational surrogacy contract on |
| 13 | | file for a gestational surrogate or has otherwise received the |
| 14 | | gestational surrogacy contract from a gestational surrogate, |
| 15 | | the hospital may not deny an intended parent entry into the |
| 16 | | delivery room where the gestational surrogate is being induced |
| 17 | | or in labor, except as provided under subsection (c). |
| 18 | | (c) A hospital is not required to allow entry into the |
| 19 | | delivery room to an intended parent if: (1) medical personnel |
| 20 | | determine that the gestational surrogate's life or health could |
| 21 | | be jeopardized if an intended parent is present; (2) the |
| 22 | | gestational surrogacy contract prohibits an intended parent |
| 23 | | from being present; or (3) medical personnel determine there is |
