1 | | (a) The Department of Public Health shall administer and |
2 | | enforce the provisions of this Act. |
3 | | (b) Any person or entity who violates this Act shall be |
4 | | liable for a civil penalty of $500 for the first violation and |
5 | | $1,000 for each subsequent violation. The State's Attorney of |
6 | | the county in which the violation occurred or the Attorney |
7 | | General may bring an action in the circuit court of the county |
8 | | in which the violation occurred to enforce the collection of |
9 | | any civil penalty imposed. |
10 | | Section 90. The Illinois Plumbing License Law is amended by |
11 | | changing Section 40 as follows:

13 | | Sec. 40.
All persons engaged in plumbing as defined in this |
14 | | Act shall
comply with the minimum code of standards for |
15 | | plumbing and the fixtures,
materials, design and installation |
16 | | methods of plumbing systems published
by the Department and |
17 | | filed with the Secretary of State as required by this Act.

18 | | All installations of equipment, fixtures, appliances or |
19 | | piping which
are used or intended for use entirely for or as a |
20 | | part of a water supply
system or sewage disposal system and |
21 | | thereby can affect the public health
shall comply with the |
22 | | provisions of the State Plumbing Code for design,
materials, |
23 | | installation and maintenance. The installation, repair, |
24 | | maintenance,
alteration or extension of building sewers shall |

1 | | be done in accordance
with the State Plumbing Code. Any person |
2 | | engaged in any of such work
shall upon investigation and |
3 | | determination of non-compliance with the provisions
of the |
4 | | State Plumbing Code be subject to the penalties contained in |
5 | | this
Act. Such prosecution shall be the responsibility of the |
6 | | State's Attorney
or other authority as authorized by this Act.

7 | | A person engaged in plumbing who installs a water heater or |
8 | | tank for use in a residence or residential facility located in |
9 | | Illinois must supply or attach a temperature mixing valve or |
10 | | other safety valve to the water heater or tank that prevents |
11 | | water with a temperature above 120 degrees Fahrenheit from |
12 | | coming from any bathtub faucet, shower faucet, sink faucet, or |
13 | | any other source of water into direct contact with a person. |
