AMENDMENT TO HOUSE BILL 3390

2    AMENDMENT NO. ______. Amend House Bill 3390, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Animal Welfare Act is amended by adding
6Section 18.2 as follows:
 
7    (225 ILCS 605/18.2 new)
8    Sec. 18.2. Fire alarm system.
9    (a) In this Section:
10    "Fire alarm system" means a system that automatically
11triggers notification to local emergency responders when
12activated.
13    "Staffing plan" means a plan to staff a kennel operator
14anytime dogs or cats are on the premises. At a minimum, a
15staffing plan must include the kennel operator's hours of
16operation, number of staff, names of staff, and the staff's

1contact information. The Department may adopt rules adding
2requirements to a staffing plan.
3    "Qualified fire inspector" means a local fire official or a
4building inspector working for a unit of local government or
5fire protection district who is qualified to inspect buildings
6for fire safety or building code compliance.
7    (b) A kennel operator that maintains dogs or cats for
8boarding and that is not staffed at all times dogs or cats are
9on the premises shall be equipped with at least one fire alarm
10system or fire sprinkler system in operating condition in every
11building of the kennel operator that is used for the housing of
12animals. The kennel operator shall certify in its license
13application and annually certify in its license renewal that
14either: (1) its facility has a fire alarm system or a fire
15sprinkler system, and shall include with the application or
16license renewal an attached description and picture of the make
17and model of the system used; or (2) the kennel is staffed at
18all times dogs or cats are on the premises, and shall include
19with the application or license renewal an attached staffing
20plan. The Department shall include this certification on each
21application for license or license renewal.
22    (c) A qualified fire inspector may inspect a kennel
23operator that maintains dogs and cats for boarding during the
24course of performing routine inspections. If during a routine
25inspection a qualified fire inspector determines that the
26kennel operator does not have a fire alarm system or fire

1sprinkler system the inspector may inform the Department.
2    (d) For the purposes of this Section, veterinary hospitals,
3practices, or offices are not kennel operators.
 
4    Section 99. Effective date. This Act takes effect January
51, 2020.".
