| 5 | | "Section 5. The Animal Welfare Act is amended by adding |
| 6 | | Section 18.2 as follows:
|
| 7 | | (225 ILCS 605/18.2 new) |
| 8 | | Sec. 18.2. Fire alarm system. |
| 9 | | (a) In this Section: |
| 10 | | "Fire alarm system" means a system that automatically |
| 11 | | triggers notification to local emergency responders when |
| 12 | | activated. |
| 13 | | "Staffing plan" means a plan to staff a kennel operator |
| 14 | | anytime dogs or cats are on the premises. At a minimum, a |
| 15 | | staffing plan must include the kennel operator's hours of |
| 16 | | operation, number of staff, names of staff, and the staff's |

| 1 | | contact information. The Department may adopt rules adding |
| 2 | | requirements to a staffing plan. |
| 3 | | "Qualified fire inspector" means a local fire official or a |
| 4 | | building inspector working for a unit of local government or |
| 5 | | fire protection district who is qualified to inspect buildings |
| 6 | | for fire safety or building code compliance. |
| 7 | | (b) A kennel operator that maintains dogs or cats for |
| 8 | | boarding and that is not staffed at all times dogs or cats are |
| 9 | | on the premises shall be equipped with at least one fire alarm |
| 10 | | system or fire sprinkler system in operating condition in every |
| 11 | | building of the kennel operator that is used for the housing of |
| 12 | | animals. The kennel operator shall certify in its license |
| 13 | | application and annually certify in its license renewal that |
| 14 | | either: (1) its facility has a fire alarm system or a fire |
| 15 | | sprinkler system, and shall include with the application or |
| 16 | | license renewal an attached description and picture of the make |
| 17 | | and model of the system used; or (2) the kennel is staffed at |
| 18 | | all times dogs or cats are on the premises, and shall include |
| 19 | | with the application or license renewal an attached staffing |
| 20 | | plan. The Department shall include this certification on each |
| 21 | | application for license or license renewal. |
| 22 | | (c) A qualified fire inspector may inspect a kennel |
| 23 | | operator that maintains dogs and cats for boarding during the |
| 24 | | course of performing routine inspections. If during a routine |
| 25 | | inspection a qualified fire inspector determines that the |
| 26 | | kennel operator does not have a fire alarm system or fire |
