Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that benefits under the federal Old-Age, Survivors, and Disability Insurance Program shall not be considered in determining an individual's financial eligibility for medical assistance. Requires the Department of Healthcare and Family Service to apply to the Centers for Medicare and Medicaid Services for a federal waiver or State Plan amendment if the exemption requires federal approval. Effective January 1, 2020.

1 | | AN ACT concerning public aid.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Public Aid Code is amended by |
5 | | adding Section 5-1.5 as follows: |
6 | | (305 ILCS 5/5-1.5 new) |
7 | | Sec. 5-1.5. Social security disability benefits; |
8 | | exemption. Benefits under the federal Old-Age, Survivors, and |
9 | | Disability Insurance Program shall not be considered in |
10 | | determining an individual's financial eligibility for medical |
11 | | assistance under this Code. If the exemption provided under |
12 | | this Section requires federal approval, the Department shall |
13 | | submit the necessary application to the Centers for Medicare |
14 | | and Medicaid Services for a waiver or State Plan amendment to |
15 | | implement this Section.

16 | | Section 99. Effective date. This Act takes effect January |
17 | | 1, 2020.
