| 4 | | "Section 5. The Illinois Wage Payment and Collection Act is |
| 5 | | amended by adding Sections 3.5 and 3.6 as follows:

| 7 | | Sec. 3.5. Reporting time pay for nurses. |
| 8 | | (a) Except as required in Section 3.6, each workday a nurse |
| 9 | | is required to report for work, based upon a previously |
| 10 | | approved and distributed work schedule and either (1) does |
| 11 | | report, but is not put to work or (2) was directed to not |
| 12 | | report, the nurse shall be paid for half the usual or scheduled |
| 13 | | day's work at the nurse's regular rate of pay, which shall not |
| 14 | | be less than the minimum wage. |
| 15 | | (b) The reporting time pay provisions established under |
| 16 | | this Section are not applicable when: |

| 1 | | (1) operations cannot commence or continue due to |
| 2 | | threats to employees or property or when recommended by |
| 3 | | civil authorities; |
| 4 | | (2) public utilities fail to supply electricity, |
| 5 | | water, or gas, or there is a failure in the public |
| 6 | | utilities or sewer system; or |
| 7 | | (3) the interruption of work is caused by an Act of God |
| 8 | | or other cause not within the employer's control. |
| 9 | | (c) This Section does not apply to a nurse on paid standby |
| 10 | | status who is called to perform assigned work at a time other |
| 11 | | than the nurse's scheduled reporting time. |
| 12 | | (d) This Section applies to all nurses, including those who |
| 13 | | use technology to overcome physical distance between patient |
| 14 | | and nurse to deliver nursing care and conduct nursing practice.

| 16 | | Sec. 3.6. Reporting time pay for nurses; less than full |
| 17 | | schedule. Each workday a nurse is required to report for work |
| 18 | | based upon a previously approved work schedule and does report |
| 19 | | to work and is furnished less than one-half of the nurse's |
| 20 | | usual or scheduled day's work providing nursing services, the |
| 21 | | nurse shall be paid for all hours worked and shall be paid for |
| 22 | | one half of the remaining usual or scheduled day's work at the |
| 23 | | nurse's regular rate of pay.

| 24 | | Section 99. Effective date. This Act takes effect January |
