AMENDMENT TO HOUSE BILL 3361

2    AMENDMENT NO. ______. Amend House Bill 3361 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Minimum Wage Law is amended by adding
5Section 4.5 as follows:
 
6    (820 ILCS 105/4.5 new)
7    Sec. 4.5. Reporting time pay for nurses.
8    (a) Each workday a nurse is required to report for work,
9based upon a previously approved and distributed work schedule,
10and either (1) does report, but is not put to work, (2) does
11report and is furnished less than one-half the nurse's usual or
12scheduled day's work, or (3) was directed to not report, the
13nurse shall be paid for half the usual or scheduled day's work,
14but in no event for less than 4 hours, at the nurse's regular
15rate of pay, which shall not be less than the minimum wage.
16    (b) If a nurse is required to report for work a second time

1in any one workday and is furnished less than 2 hours of work
2on the second reporting, the nurse shall be paid for 2 hours at
3the nurse's regular rate of pay, which shall not be less than
4the minimum wage.
5    (c) The reporting time pay provisions established under
6this Section are not applicable when:
7        (1) operations cannot commence or continue due to
8    threats to employees or property or when recommended by
9    civil authorities;
10        (2) public utilities fail to supply electricity,
11    water, or gas, or there is a failure in the public
12    utilities or sewer system; or
13        (3) the interruption of work is caused by an Act of God
14    or other cause not within the employer's control.
15    (d) This Section does not apply to a nurse on paid standby
16status who is called to perform assigned work at a time other
17than the nurse's scheduled reporting time.
18    (e) This Section applies to all nurses, including those who
19use technology to overcome physical distance between patient
20and nurse to deliver nursing care and conduct nursing practice.
 
21    Section 99. Effective date. This Act takes effect January
221, 2020.".
