Amends the Real Estate Transactions
Article of the Illinois Human Rights Act. Provides that it is a civil rights violation to refuse to sell, rent, or otherwise make unavailable or deny, or to alter the terms, conditions, or privileges of the sale or rental, of a housing accommodation or dwelling to any buyer or renter due to the fact of an arrest, juvenile record, or criminal history record information ordered expunged, sealed, or impounded under the Criminal Identification Act. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 5. The Illinois Human Rights Act is amended by |
5 | | adding Section 3-102.5 as follows: |
6 | | (775 ILCS 5/3-102.5 new) |
7 | | Sec. 3-102.5. Arrest record. |
8 | | (A) Unless otherwise authorized by law, it is a civil |
9 | | rights violation to refuse to sell or rent or to otherwise make |
10 | | unavailable or deny a housing accommodation or dwelling to any |
11 | | buyer or renter due to the fact of an arrest, juvenile record, |
12 | | or criminal history record information ordered expunged, |
13 | | sealed, or impounded under Section 5.2 of the Criminal |
14 | | Identification Act. |
15 | | (B) Unless otherwise authorized by law, it is a civil |
16 | | rights violation to alter the terms, conditions, or privileges |
17 | | of the sale or rental of a housing accommodation or dwelling or |
18 | | the provision of services or facilities in connection with such |
19 | | housing accommodation due to the fact of an arrest, juvenile |
20 | | record, or criminal history record information ordered |
21 | | expunged, sealed, or impounded under Section 5.2 of the |
22 | | Criminal Identification Act.
