SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/11-500  from Ch. 95 1/2, par. 11-500

    Amends the Illinois Vehicle Code. Provides that "first offender" means any person who, within 15 years (rather than 5 years) before the date of the current offense, has not had a driver's license suspension or revocation for refusing to submit to a chemical test or tests of blood, breath, or other bodily substance or urine for the purpose of determining the content of alcohol, other drug or drugs, or intoxicating compound or compounds or any combination thereof in the person's blood. Effective July 1, 2020.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Section 11-500 as follows:
 
6    (625 ILCS 5/11-500)  (from Ch. 95 1/2, par. 11-500)
7    Sec. 11-500. Definitions. For the purposes of interpreting
8Sections 6-206.1 and 6-208.1 of this Code, "first offender"
9shall mean any person who has not had a previous conviction or
10court-assigned court assigned supervision for violating
11Section 11-501, or a similar provision of a local ordinance, or
12a conviction in any other state for a violation of driving
13while under the influence or a similar offense where the cause
14of action is the same or substantially similar to this Code or
15similar offenses committed on a military installation, or any
16person who has not had a driver's license suspension pursuant
17to paragraph 6 of subsection (a) of Section 6-206 as the result
18of refusal of chemical testing in another state, or any person
19who has not had a driver's license suspension or revocation for
20violating Section 11-501.1 within 15 5 years prior to the date
21of the current offense, except in cases where the driver
22submitted to chemical testing resulting in an alcohol
23concentration of 0.08 or more, or any amount of a drug,

1substance, or compound in such person's blood, other bodily
2substance, or urine resulting from the unlawful use or
3consumption of cannabis listed in the Cannabis Control Act, a
4controlled substance listed in the Illinois Controlled
5Substances Act, or an intoxicating compound listed in the Use
6of Intoxicating Compounds Act, or methamphetamine as listed in
7the Methamphetamine Control and Community Protection Act and
8was subsequently found not guilty of violating Section 11-501,
9or a similar provision of a local ordinance.

11    Section 99. Effective date. This Act takes effect July 1,
