| 2 | | Be it enacted by the People of the State of Illinois,

| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Public Utilities Act is amended by adding |
| 5 | | Section 9-218 as follows:

| 6 | | (220 ILCS 5/9-218 new) |
| 7 | | Sec. 9-218. Electric utility rate increase. |
| 8 | | Notwithstanding any other provision of law, an electric utility |
| 9 | | may not increase electric rates unless the electric utility has |
| 10 | | provided retail customer rebates under Article XVI in the 5 |
| 11 | | years preceding the requested rate increase.
