Amends the Public Officer Prohibited Activities Act. Provides that no officer, employee, or agent of a unit of local government may attempt to withhold disclosure to the public of information relating to tax incentives and other financial incentives by using a non-disclosure agreement. Defines "tax incentive". Effective immediately.

1 | | AN ACT concerning local government.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Public Officer Prohibited Activities Act is |
5 | | amended by adding Section 4.1 as follows: |
6 | | (50 ILCS 105/4.1 new) |
7 | | Sec. 4.1. Non-disclosure agreements. |
8 | | (a) As used in this Section, "tax incentive" includes, but |
9 | | is not limited to, any tax incentive authorized by law that by |
10 | | exemption, exclusion, deduction, allowance, credit, |
11 | | preferential tax rate, abatement, or other device reduces the |
12 | | amount of tax revenues that would otherwise accrue to the unit |
13 | | of local government. |
14 | | (b) No officer, employee, or agent of a unit of local |
15 | | government may attempt to withhold disclosure to the public of |
16 | | information relating to tax incentives and other financial |
17 | | incentives by using a non-disclosure agreement.

18 | | Section 99. Effective date. This Act takes effect upon |
19 | | becoming law.
