3 | | everything after the enacting clause with the following:

4 | | "Section 5. The Private Detective, Private Alarm, Private |
5 | | Security, Fingerprint Vendor, and
Locksmith Act of 2004 is |
6 | | amended by changing Sections 15-25 and 25-20 as follows:

9 | | Sec. 15-25. Training; private detective and employees.
|
10 | | (a) Registered employees of a private detective agency
|
11 | | shall complete, within 30 days of their employment, a minimum
|
12 | | of 20 hours of basic training provided by a qualified |
13 | | instructor.
The substance of the training shall be related to |
14 | | the work
performed by the registered employee . The training may |
15 | | be classroom-based or online Internet-based but shall not be |
16 | | conducted as on-the-job training and shall include relevant |

1 | | information as to the identification of terrorists, acts of |
2 | | terrorism, and terrorist organizations, as defined by federal |
3 | | and State statutes .
|
4 | | (a-5) In addition to the basic training required in |
5 | | subsection (a), registered employees of a private detective |
6 | | agency shall complete an additional minimum of 8 hours of |
7 | | annual training for every calendar year, commencing with the |
8 | | calendar year beginning after the employee's hire date. |
9 | | (a-10) Annual training for registered employees shall be |
10 | | based on subjects related to the work performed as determined |
11 | | by the employer and may be conducted in a classroom or seminar |
12 | | setting or via Internet-based online learning programs. Annual |
13 | | training may not be conducted as on-the-job training. |
14 | | (b) It is the responsibility of the employer to certify,
on |
15 | | a form provided by the Department, that the employee has
|
16 | | successfully completed the basic and annual training. The |
17 | | original form or a copy shall be a
permanent record of training |
18 | | completed by the employee and
shall be placed in the employee's |
19 | | file with the employer for
the period the employee remains with |
20 | | the employer. An agency
may place a notarized copy of the |
21 | | Department form in lieu of
the original into the permanent |
22 | | employee registration card
file. The original form shall be |
23 | | given to the employee when
his or her employment is terminated. |
24 | | Failure to return the
original form to the employee is grounds |
25 | | for disciplinary
action. The employee shall not be required to |
26 | | repeat the
required training once the employee has been issued |

An employer may provide or require additional |
2 | | training.
|
3 | | (c) (Blank). Any certification of completion of the 20-hour |
4 | | basic
training issued under the Private Detective, Private |
5 | | Alarm,
Private Security, and Locksmith Act of 1993 or any prior |
6 | | Act
shall be accepted as proof of training under this Act.
|
7 | | (d) All private detectives shall complete a minimum of 8 |
8 | | hours of annual training on a topic of their choosing, provided |
9 | | that the subject matter is reasonably related to their private |
10 | | detective practice. The annual training for private detectives |
11 | | may be completed utilizing any combination of hours obtained in |
12 | | a formal educational classroom setting, including, but not |
13 | | limited to, a live educational workshop or seminar offered by |
14 | | any industry-related product manufacturer or service provider, |
15 | | any recognized state or national industry association, any |
16 | | recognized continuing education provider, or by any accredited |
17 | | 2-year or 4-year college or university, or through |
18 | | Internet-based online training resources. |
19 | | (e) The annual training requirements for private |
20 | | detectives shall not apply until the calendar year following |
21 | | the issuance of the private detective license. |
22 | | (f) It shall be the responsibility of the private detective |
23 | | to keep and maintain a personal log of all training hours |
24 | | earned along with sufficient documentation for the Department |
25 | | to verify the annual training completed for at least 5 years. |
26 | | The personal training log and documentation shall be provided |

1 | | to the Department in the same manner as other documentation and |
2 | | records required under this Act. |
3 | | (g) Recognizing the diverse professional practices of |
4 | | private detectives licensed under this Act, it is the intent of |
5 | | the training requirements in this Section to allow for a broad |
6 | | interpretation of the coursework, seminar subjects, or class |
7 | | topics to be considered reasonably related to the practice of |
8 | | any profession licensed under this Act. |
9 | | (h) Notwithstanding any other professional license a |
10 | | private detective holds under this Act, no more than 8 hours of |
11 | | annual training shall be required for any one year. |

15 | | Sec. 25-20. Training; private security contractor and
|
16 | | employees. |
17 | | (a) Registered employees of the private security
|
18 | | contractor agency who provide traditional guarding or other
|
19 | | private security related functions or who respond to alarm
|
20 | | systems shall complete, within 30 days of their employment, a
|
21 | | minimum of 20 hours of classroom basic training provided by a
|
22 | | qualified instructor, which shall include the following
|
23 | | subjects:
|
24 | | (1) The law regarding arrest and search and seizure
as |
25 | | it applies to private security.

|
1 | | (2) Civil and criminal liability for acts related
to |
2 | | private security.
|
3 | | (3) The use of force, including but not limited to
the |
4 | | use of nonlethal force (i.e., disabling spray, baton,
|
5 | | stungun , taser, or similar weapon).
|
6 | | (4) Verbal communication skills Arrest and control |
7 | | techniques .
|
8 | | (5) The offenses under the Criminal Code of 2012
that |
9 | | are directly related to the protection of persons and
|
10 | | property.
|
11 | | (6) Private security officers and the criminal justice |
12 | | system The law on private security forces and on
reporting |
13 | | to law enforcement agencies .
|
14 | | (7) Fire prevention, fire equipment, and fire
safety.
|
15 | | (8) Report The procedures for
report writing and |
16 | | observation techniques .
|
17 | | (9) Customer service Civil rights and public |
18 | | relations.
|
19 | | (10) The identification of terrorists, acts of |
20 | | terrorism, and terrorist organizations, as defined by |
21 | | federal and State statutes.
|
22 | | (b) All other employees of a private security contractor
|
23 | | agency shall complete a minimum of 20 hours of training
|
24 | | provided by the qualified instructor within 30 days of their
|
25 | | employment. The substance of the training shall be related to
|
26 | | the work performed by the registered employee.

8 | | (d) In addition to the basic training provided for in |
9 | | subsections (a) and
(c),
registered employees of the private |
10 | | security contractor agency who provide
guarding or other
|
11 | | private security related functions
shall complete an
|
12 | | additional
8 hours of refresher training on subjects to be |
13 | | determined by the
employer
each calendar year commencing with |
14 | | the
calendar year
following the employee's first employment |
15 | | anniversary date,
which
refresher training may be |
16 | | site-specific and may be conducted on the job.
|
17 | | (e) It is the responsibility of the employer to certify,
on |
18 | | a form provided by the Department, that the employee has
|
19 | | successfully completed the basic and refresher training. The |
20 | | original
form or a copy shall be a permanent record of training |
21 | | completed by the
employee and shall be placed in the employee's |
22 | | file with the
employer for the period the employee remains with |
23 | | the
employer. An agency may place a notarized copy of the
|
24 | | Department form in lieu of the original into the permanent
|
25 | | employee registration card file. The original form shall be
|
26 | | given to the employee when his or her employment is

15 | | completed in a formal educational classroom setting, |
16 | | including, but not limited to, a live continuing education |
17 | | seminar offered by any recognized state or national industry |
18 | | association, any recognized continuing education provider, or |
19 | | by any 2-year or 4-year college or university. No more than 4 |
20 | | hours of the annual training may be completed utilizing online |
21 | | training materials, online videos, or other similar training |
22 | | materials available via the Internet or through the reading of |
23 | | professional journals or publications. |
24 | | (h) It shall be the responsibility of the private security |
25 | | contractor to keep and maintain a personal log of all training |
26 | | hours earned along with sufficient documentation necessary for |

1 | | the Department to verify the annual training completed for at |
2 | | least 5 years. The personal training log and documentation |
3 | | shall be provided to the Department in the same manner as other |
4 | | documentation and records required under this Act. |
5 | | (i) Recognizing the diverse professional practices of |
6 | | private security contractors licensed under this Act, it is the |
7 | | intent of the training requirements in this Section to allow |
8 | | for a broad interpretation of the coursework, seminar subjects, |
9 | | or class topics to be considered reasonably related to the |
10 | | practice of any profession licensed under this Act. |
11 | | (j) Notwithstanding any other professional license a |
12 | | private security contractor holds under this Act, no more than |
13 | | 8 hours of annual training shall be required for any one year. |
14 | | (k) The annual training requirements for private security |
15 | | contractors shall not apply until the calendar year following |
16 | | the issuance of the private security contractor license. |
