Amends the Illinois Criminal Justice Information Act. Creates the Statewide Deferred Prosecution Funding Program, to provide grants to State's Attorneys to operate deferred prosecution programs for misdemeanor offenses. Provides eligibility requirements and rulemaking authority for the Illinois Criminal Justice Information Authority Act. Creates the Statewide Deferred Prosecution Funding Program Fund. Amends the State Finance Act to make a conforming change.

1 | | AN ACT concerning State government.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Criminal Justice Information Act is |
5 | | amended by adding Section 9.4 as follows: |
6 | | (20 ILCS 3930/9.4 new) |
7 | | Sec. 9.4. Statewide Deferred Prosecution Funding Program. |
8 | | The Statewide Deferred Prosecution Funding Program Fund is |
9 | | hereby created as a special fund in the State treasury. Grants |
10 | | from the Fund shall be made, subject to appropriation, by the |
11 | | Illinois Criminal Justice Information Authority to State's |
12 | | Attorneys upon application in the amount of 25% of the costs |
13 | | incurred by the county to operate the deferred prosecution |
14 | | program. To be eligible to receive moneys from the Fund, a |
15 | | State's Attorney must provide a deferred prosecution program |
16 | | that allows for a misdemeanor charge to be dismissed upon |
17 | | successful completion of the deferred prosecution program |
18 | | created by the State's Attorney. The Authority shall by rule |
19 | | provide selection criteria and procedures for grants to be made |
20 | | under this Section. |
21 | | Section 90. The State Finance Act is amended by adding |
22 | | Section 5.891 as follows: |
