Amends the Job Opportunities for Qualified Applicants Act. Provides that a person may not be placed on a do-not-hire list unless the person has committed an violent crime or unless the specific employment opportunity will require the person to exercise fiduciary responsibility. Requires annual reevaluation of persons on a do-not-hire list.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 5. The Job Opportunities for Qualified Applicants |
5 | | Act is amended by adding Section 17 as follows: |
6 | | (820 ILCS 75/17 new) |
7 | | Sec. 17. Do-not-hire lists. |
8 | | (a) An employer or employment agency that maintains a |
9 | | do-not-hire list may not include an individual on that list |
10 | | unless the individual has committed a violent crime or unless |
11 | | the specific employment opportunity requires the employee to |
12 | | exercise fiduciary responsibility. |
13 | | (b) An employer or employment agency that maintains a |
14 | | do-not-hire list must annually reevaluate the persons on the |
15 | | list to ascertain whether the persons should remain on the |
16 | | list. |
17 | | (c) In this Section, "violent crime" has the meaning |
18 | | ascribed to that term in the Rights of Crime Victims and |
19 | | Witnesses Act.
