AMENDMENT TO HOUSE BILL 3068

2    AMENDMENT NO. ______. Amend House Bill 3068 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Solid Waste Planning and Recycling Act is
5amended by adding Section 4.5 as follows:
 
6    (415 ILCS 15/4.5 new)
7    Sec. 4.5. Statewide Materials Management Advisory
8Committee; Report.
9    (a) The Statewide Materials Management Advisory Committee
10is hereby created.
11    (b) The Advisory Committee shall:
12        (1) investigate and provide recommendations for
13    expanding waste reduction, recycling, reuse, and
14    composting in Illinois in a manner that protects the
15    environment, as well as public health and safety, and
16    promotes economic development;

1        (2) investigate and provide recommendations for the
2    form and contents of county waste management plans adopted
3    under this Act; and
4        (3) prepare a report as required under Section 4.6 of
5    this Act.
6    (c) The Advisory Committee shall be composed of the
7following:
8        (1) The Director of the Agency, or his or her designee,
9    who shall serve as an ex officio and nonvoting member.
10        (2) 25 voting members appointed by the Director of the
11    Agency, as follows:
12            (A) one member representing a municipality with a
13        population of more than 1,000,000;
14            (B) one member representing a county with a
15        population of more than 1,000,000;
16            (C) two members representing counties with a
17        population of at least 200,000 but not more than
18        1,000,000;
19            (D) two members representing counties with a
20        population of at least 85,000 but not more than
21        200,000;
22            (E) two members representing counties with a
23        population of less than 85,000;
24            (F) two members representing the solid waste
25        management industry;
26            (G) two members representing the recycling

1        industry;
2            (H) two members representing providers of general
3        construction and demolition debris recycling services;
4            (I) two members representing environmental
5        interest groups;
6            (J) two members representing manufacturers in the
7        State;
8            (K) two members representing retailers in the
9        State;
10            (L) two members representing producers of compost;
11        and
12            (M) three members representing producers of end
13        products generated through recycling.
14    (d) The Director of the Agency shall appoint all members of
15the Advisory Committee by no later than January 1, 2020.
16    (e) The initial meeting of the Advisory Committee shall be
17convened by the Director of the Agency, or his or her designee,
18no later than March 1, 2020. At the initial meeting, the voting
19members shall select co-chairs. Subsequent meetings shall
20convene at the call of the co-chairs.
21    (f) A simple majority of those appointed shall constitute a
22quorum. The affirmative vote of a majority of those present and
23voting shall be necessary for Advisory Committee action.
24    (g) Members of the Advisory Committee shall receive no
25compensation for their services.
26    (h) The Agency shall provide administrative assistance and

1technical support to the Advisory Committee. The Agency may
2obtain assistance from outside experts to assist in preparation
3of the Plan. Funding for the Plan and assistance from outside
4experts shall be obtained from the Solid Waste Management Fund.
5    (i) On or before July 1, 2021, the Advisory Committee shall
6prepare and submit a report to the General Assembly summarizing
7its work.
8    (j) The report shall include, at a minimum, the following
9information:
10        (1) an estimate of the amount and composition of waste
11    generated annually in Illinois with 2018 as the base year;
12        (2) an estimate of the amount of waste disposed of
13    annually in Illinois with 2018 as the base year;
14        (3) an estimate of the amount of material diverted from
15    landfills annually in Illinois with 2018 as the base year;
16        (4) an analysis of the markets available for materials
17    diverted from Illinois landfills;
18        (5) recommended materials in the municipal waste
19    stream that could be targeted to maximize waste diversion;
20        (6) recommended actions that could be taken to increase
21    landfill diversion rates and the costs associated with
22    those actions;
23        (7) recommended education and public outreach programs
24    that could maximize waste diversion;
25        (8) recommended diversion rates that are achievable by
26    2025, 2030, and 2035; and

1        (9) a database and map of permitted and nonpermitted
2    facilities, including, but not limited to, landfills,
3    garbage transfer stations, landscape waste transfer
4    stations, construction and demolition debris recycling
5    facilities, recycling facilities, compost sites, and scrap
6    metal recycling facilities.
7    (k) In addition, the report shall also include, at a
8minimum, the following recommendations for waste management
9plans required under this Act:
10        (1) recommended elements for counties to include in
11    waste management plans required under this Act;
12        (2) a recommended standard methodology for counties to
13    use to determine the annual waste generation rate in the
14    county;
15        (3) a recommended standard methodology for counties to
16    use to determine the annual disposal rate in the county;
17        (4) a recommended standard methodology for counties to
18    use to determine the annual diversion rate in the county;
19        (5) recommended standard actions that can be taken by
20    counties to increase landfill diversion rates;
21        (6) recommended education and public outreach programs
22    that could maximize waste diversion within the county; and
23        (7) recommended standard content for waste management
24    plans required under this Act.
25    (l) This Section is repealed on July 1, 2022.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.".
