AMENDMENT TO HOUSE BILL 2924

2    AMENDMENT NO. ______. Amend House Bill 2924 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Commerce and Economic
5Opportunity Law of the Civil Administrative Code of Illinois is
6amended by adding Sections 605-1030 and 605-1035 as follows:
 
7    (20 ILCS 605/605-1030 new)
8    Sec. 605-1030. Office of Inclusion.
9    (a) The Office of Inclusion is hereby created within the
10Department. The Office shall assist minority-owned businesses,
11women-owned businesses, veteran-owned businesses and
12businesses owned by persons with disabilities through targeted
13programs, resources, and outreach and promotional activities.
14The Office shall engage in or conduct the following activities:
15        (1) promoting and conducting outreach efforts with
16    respect to the making of small business loans pursuant to

1    Section 9-4.3 of the Build Illinois Act and assisting
2    minority-owned businesses, women-owned businesses,
3    veteran-owned businesses and businesses owned by persons
4    with disabilities in applying for and receiving loan funds
5    under that Act;
6        (2) providing and hosting workshops and public forums
7    and engaging in outreach efforts for minority-owned
8    businesses, women-owned businesses, veteran-owned
9    businesses and businesses owned by persons with
10    disabilities to encourage participation in programs
11    authorized by the Business Enterprise for Minorities,
12    Women and Persons with Disabilities Act and the Illinois
13    Procurement Code;
14        (3) providing and hosting workshops and public forums
15    and engaging in outreach efforts that assist and educate
16    minority-owned businesses, women-owned businesses,
17    veteran-owned businesses and businesses owned by persons
18    with disabilities on the process of applying for and
19    becoming certified to apply for State grant funds under the
20    Grant Accountability and Transparency Act; and
21        (4) providing and hosting workshops and public forums
22    and engaging in outreach efforts that assist and educate
23    aspiring and existing minority-owned businesses,
24    women-owned businesses, veteran-owned businesses, and
25    businesses owned by persons with disabilities in
26    understanding concepts such as, but not limited to,

1    business formation, business planning, capital access, and
2    marketing a business.
3    (b) In order to facilitate and encourage the growth of
4supplier diversity, the Office may have at least one employee
5that serves as a supplier diversity program manager to (i)
6collect reports and information concerning entities that
7manage supplier diversity programs and (ii) conduct public
8workshops focused on specific industries to collaboratively
9connect diverse enterprises with entities that manage supplier
10diversity programs. Those workshops shall be modeled after
11Illinois Commerce Commission hearings for utilities and
12railroads and shall include a collaborative discussion of filed
13supplier diversity reports. The program manager shall hold
14public workshops for relevant industries including, but not
15limited to, gaming, hospitals, and public and private higher
16education. Those workshops shall be held on the following
17schedule:
18        (1) gaming: February;
19        (2) hospitals: April;
20        (3) public and private higher education: July; and
21        (4) Economic Development for a Growing Economy (EDGE)
22    tax credit: September.
23    (c) The Department shall publish a template for supplier
24diversity reports to be used for EDGE tax credit recipients and
25private higher education institutions. The reports for private
26higher education and EDGE tax credit recipients shall contain

1the following provisions:
2        (1) the name, address, phone number and email address
3    of the point of contact for potential vendors to register
4    with the entity;
5        (2) local, State, or private certifications that the
6    entity accepts or recognizes for minority- and women-owned
7    businesses;
8        (3) the voluntary supplier diversity goals, if any, for
9    the next fiscal year for the entire budget of the entity;
10        (4) for the last fiscal year, the actual contractual
11    spending for the entire budget of the entity and the actual
12    spending for minority-owned and women-owned businesses,
13    expressed both as actual dollars and as a percentage of the
14    total budget for actual spending for the entity;
15        (5) narrative explaining the results of the report and
16    the tactics to be employed to achieve the voluntary goals
17    for the next fiscal year; and
18        (6) the particular areas of spending in the next fiscal
19    year that the entity intends to procure that are most
20    relevant to minority-owned and women-owned businesses.
21    (d) In addition, the Office shall compile and publish on
22its website a master database for all points of contract,
23certifications accepted, and links to the most recent supplier
24diversity reports submitted to the Department under:
25        (1) Section 405-530 of the Department of Central
26    Management Services Law of the Civil Administrative Code of

1    Illinois;
2        (2) Section 5.3 of the Illinois Health Facilities
3    Planning Act;
4        (3) Section 8f of the Business Enterprise for
5    Minorities, Women, and Persons with Disabilities Act;
6        (4) Section 5-57 of the Economic Development for a
7    Growing Economy Tax Credit Act;
8        (5) Section 5-117 of the Public Utilities Act;
9        (6) Section 12.2 of the Illinois Horse Racing Act of
10    1975; and
11        (7) Section 10 of the Railroad Supplier Diversity Act.
12    (e) The Office shall administer programs established by the
13Department, the General Assembly, or both and shall provide
14grants to minority-owned business, woman-owned businesses,
15veteran-owned businesses, and businesses owned by persons with
16disabilities. The Office may establish applications,
17notifications, contracts, and other forms or procedures and may
18use vendors or contract work to carry out the purposes of this
19Act. The Office may coordinate assistance for businesses with
20other State agencies.
21    (f) The Department shall provide staff, administrative
22support, and related support to the Office as required to
23administer this Section and may adopt rules to administer this
24Section.

1    Sec. 605-1035. Higher education supplier diversity report.
2Every private institution of higher education approved by the
3Illinois Student Assistance Commission for the purposes of the
4Monetary Award Program shall submit a 2-page report on its
5voluntary supplier diversity program to the Department in the
6form and manner required by the Department by April 1 of every
7year. The Department shall hold an annual workshop open to the
8public with leaders of private institutions of higher education
9and minority-owned and women-owned businesses in July of every
10year.
 
11    Section 99. Effective date. This Act takes effect upon
12becoming law.".
