AMENDMENT TO HOUSE BILL 2924

2    AMENDMENT NO. ______. Amend House Bill 2924, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Business Enterprise for Minorities, Women,
6and Persons with Disabilities Act is amended by adding Section
78k as follows:
 
8    (30 ILCS 575/8k new)
9    Sec. 8k. Museum and sports facility diversity report.
10    (a) Beginning in Fiscal Year 2020 and every fiscal year
11thereafter, (1) any museum under the authority of a park
12district in a municipality having a population of 1,000,000 or
13more and (2) any sports facility under the jurisdiction of the
14Illinois Sports Facilities Authority shall submit an annual
15diversity report to the Council, on or before January 30, which
16includes information and data on diversity goals, and progress

1toward achieving those goals, by businesses owned by
2minorities, women, and persons with disabilities.
3    (b) The diversity report shall include the following
4information from the previous fiscal year:
5        (1) the percentage of total annual spending on
6    contracts with businesses owned by minorities, women, and
7    persons with disabilities;
8        (2) the total number of contracts awarded or let to
9    businesses owned by minorities, women, and persons with
10    disabilities;
11        (3) the type of professional service contracts awarded
12    or let to business owned by minorities, women, and persons
13    with disabilities, including, but not limited to,
14    construction management, media, accounting, marketing, and
15    public relations contracts;
16        (4) whether the business owned by minorities, women, or
17    persons with disabilities is the primary entity holding the
18    contract with the museum or sports facility or a
19    subcontractor on a larger contract with the museum or
20    sports facility;
21        (5) a narrative description of contracting diversity
22    and equity goals and strategic plans for meeting those
23    goals;
24        (6) the percentage of total annual spending in
25    professional services with businesses owned by minorities,
26    women, and persons with disabilities, including, but not

1    limited to, the following professional services
2    categories: (A) accounting; (B) architecture and
3    engineering; (C) consulting; (D) information technology;
4    (E) insurance; (F) financial, legal, media, construction
5    management, and marketing services; and (G) other
6    professional services; and
7        (7) when reporting on businesses owned by minorities,
8    the report shall include a breakdown by demographic group.
9    The reports shall be submitted in the format as prescribed
10by the Council by rule. The Council shall publish each annual
11report on its website. In November of each year, the Council
12shall transmit to the General Assembly a report including a
13summary of the information reported to the Council for the
14previous fiscal year and a cumulative summary for all previous
15years in which reports were filed.
16    (c) Museums having to report under this Section shall hold
17an annual symposium beginning on or before July 30, 2020, and
18every year thereafter, that is open to the public on the status
19of contracting diversity and equity goals, and to share best
20practices and to collaboratively seek solutions to structural
21impediments that preclude achieving those goals. Museums may
22hold this symposium together or separately.
23    (d) Sports facilities having to report under this Section
24shall hold an annual symposium beginning on or before July 30,
252020, and every year thereafter, that is open to the public on
26the status of contracting diversity and equity goals, and to

1share best practices and to collaboratively seek solutions to
2structural impediments that preclude achieving those goals.
3Sports facilities may hold this symposium together or
4separately.
5    (e) The Council shall publish a database on its website of
6the point of contact for each museum and sports facility
7responsible for business diversity, along with a list of
8certifications each recognizes for business diversity.
 
9    Section 99. Effective date. This Act takes effect upon
10becoming law.".
