Amends the Illinois Public Aid Code. Provides that, on January 1, 2020, all powers and duties of the
Department of Human Services related to processing and
administering eligibility for individuals with Medicaid
long-term care benefits and any and all individuals applying
for Medicaid who also apply for Medicaid long-term care
benefits shall be transferred to the Department of Healthcare
and Family Services, including, but not be limited to, the
transfer of all powers and duties of the Department of Human
Services related to eligibility determinations,
redeterminations, admission approvals, income and address
changes, appeals, and all associated tasks. Provides that all personnel, property, materials, supplies, and funds associated with the completion of these functions shall be transferred from the Department of Human Services to the Department of Healthcare and Family Services, including the transfer of all 3 Department
of Human Services' Medical Field Operations offices (Long Term
Care), and all other resources or personnel located outside
those 3 offices who administer the functions of or provide
support to those offices. Provides that all rules, standards, policies, and procedures adopted by the Department of Human Services shall continue in effect as the rules, standards, policies, and procedures of the Department of Healthcare and Family Services until they are modified or abolished by the Department of Healthcare and Family Services. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Illinois Public Aid Code is amended by |
5 | | adding Section 11-5.5 as follows: |
6 | | (305 ILCS 5/11-5.5 new) |
7 | | Sec. 11-5.5. Improved accountability and responsibility |
8 | | for long-term care eligibility determinations. |
9 | | (a) On January 1, 2020, all powers and duties of the |
10 | | Department of Human Services related to processing and |
11 | | administering eligibility for individuals with Medicaid |
12 | | long-term care benefits and any and all individuals applying |
13 | | for Medicaid who also apply for Medicaid long-term care |
