Provides for the original fee, renewal fees, and fee distribution for Universal special license plates with decals issued by the Peace Officers Memorial Foundation of Cook County.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:
|
4 | | Section 5. The State Finance Act is amended by adding |
5 | | Section 5.891 as follows: |

7 | | Sec. 5.891. The Peace Officers Memorial Foundation of Cook |
8 | | County Fund. |
9 | | Section 10. The Illinois Vehicle Code is amended by |
10 | | changing Section 3-699.14 as follows: |

12 | | Sec. 3-699.14. Universal special license plates. |
13 | | (a) In addition to any other special license plate, the |
14 | | Secretary, upon receipt of all applicable fees and applications |
15 | | made in the form prescribed by the Secretary, may issue |
16 | | Universal special license plates to residents of Illinois on |
17 | | behalf of organizations that have been authorized by the |
18 | | General Assembly to issue decals for Universal special license |
19 | | plates. Appropriate documentation, as determined by the |
20 | | Secretary, shall accompany each application. Authorized |
21 | | organizations shall be designated by amendment to this Section. |

1 | | When applying for a Universal special license plate the |
2 | | applicant shall inform the Secretary of the name of the |
3 | | authorized organization from which the applicant will obtain a |
4 | | decal to place on the plate. The Secretary shall make a record |
5 | | of that organization and that organization shall remain |
6 | | affiliated with that plate until the plate is surrendered, |
7 | | revoked, or otherwise cancelled. The authorized organization |
8 | | may charge a fee to offset the cost of producing and |
9 | | distributing the decal, but that fee shall be retained by the |
10 | | authorized organization and shall be separate and distinct from |
11 | | any registration fees charged by the Secretary. No decal, |
12 | | sticker, or other material may be affixed to a Universal |
13 | | special license plate other than a decal authorized by the |
14 | | General Assembly in this Section or a registration renewal |
15 | | sticker. The special plates issued under this Section shall be |
16 | | affixed only to passenger vehicles of the first division, |
17 | | including motorcycles and autocycles, or motor vehicles of the |
18 | | second division weighing not more than 8,000 pounds. Plates |
19 | | issued under this Section shall expire according to the |
20 | | multi-year procedure under Section 3-414.1 of this Code. |
21 | | (b) The design, color, and format of the Universal special |
22 | | license plate shall be wholly within the discretion of the |
23 | | Secretary. Universal special license plates are not required to |
24 | | designate "Land of Lincoln", as prescribed in subsection (b) of |
25 | | Section 3-412 of this Code. The design shall allow for the |
26 | | application of a decal to the plate. Organizations authorized |

1 | | by the General Assembly to issue decals for Universal special |
2 | | license plates shall comply with rules adopted by the Secretary |
3 | | governing the requirements for and approval of Universal |
4 | | special license plate decals. The Secretary may, in his or her |
5 | | discretion, allow Universal special license plates to be issued |
6 | | as vanity or personalized plates in accordance with Section |
7 | | 3-405.1 of this Code. The Secretary of State must make a |
8 | | version of the special registration plates authorized under |
9 | | this Section in a form appropriate for motorcycles and |
10 | | autocycles. |
11 | | (c) When authorizing a Universal special license plate, the |
12 | | General Assembly shall set forth whether an additional fee is |
13 | | to be charged for the plate and, if a fee is to be charged, the |
14 | | amount of the fee and how the fee is to be distributed. When |
15 | | necessary, the authorizing language shall create a special fund |
16 | | in the State treasury into which fees may be deposited for an |
17 | | authorized Universal special license plate. Additional fees |
18 | | may only be charged if the fee is to be paid over to a State |
19 | | agency or to a charitable entity that is in compliance with the |
20 | | registration and reporting requirements of the Charitable |
21 | | Trust Act and the Solicitation for Charity Act. Any charitable |
22 | | entity receiving fees for the sale of Universal special license |
23 | | plates shall annually provide the Secretary of State a letter |
24 | | of compliance issued by the Attorney General verifying that the |
25 | | entity is in compliance with the Charitable Trust Act and the |
26 | | Solicitation for Charity Act. |

1 | | (d) Upon original issuance and for each registration |
2 | | renewal period, in addition to the appropriate registration |
3 | | fee, if applicable, the Secretary shall collect any additional |
4 | | fees, if required, for issuance of Universal special license |
5 | | plates. The fees shall be collected on behalf of the |
6 | | organization designated by the applicant when applying for the |
7 | | plate. All fees collected shall be transferred to the State |
8 | | agency on whose behalf the fees were collected, or paid into |
9 | | the special fund designated in the law authorizing the |
10 | | organization to issue decals for Universal special license |
11 | | plates. All money in the designated fund shall be distributed |
12 | | by the Secretary subject to appropriation by the General |
13 | | Assembly.

14 | | (e) The following organizations may issue decals for |
15 | | Universal special license plates with the original and renewal |
16 | | fees and fee distribution as follows: |
17 | | (1) The Illinois Department of Natural Resources. |
18 | | (A) Original issuance: $25; with $10 to the |
19 | | Roadside Monarch Habitat Fund and $15 to the Secretary |
20 | | of State Special License Plate Fund. |
21 | | (B) Renewal: $25; with $23 to the Roadside Monarch |
22 | | Habitat Fund and $2 to the Secretary of State Special |
23 | | License Plate Fund. |
24 | | (2) Illinois Veterans' Homes. |
25 | | (A) Original issuance: $26, which shall be |
26 | | deposited into the Illinois Veterans' Homes Fund. |

12 | | habitat development, enhancement, and restoration projects |

14 | | (2) The Prostate Cancer Awareness Fund. All moneys to |
15 | | be paid as grants to the Prostate Cancer Foundation of |
16 | | Chicago. |
17 | | (3) The Horsemen's Council of Illinois Fund. All moneys |
18 | | shall be paid as grants to the Horsemen's Council of |
19 | | Illinois. |
20 | | (4) The Peace Officers Memorial Foundation of Cook |
21 | | County Fund. All money in the Peace Officers Memorial |
22 | | Foundation of Cook County Fund shall be paid as grants to |
23 | | the
Peace Officers Memorial Foundation of Cook County for |
24 | | construction or maintenance of a memorial and park, holding |
25 | | an annual memorial commemoration, giving scholarships to |
26 | | children of Cook County peace officers killed or |

1 | | catastrophically injured in the line of duty, providing |
2 | | financial assistance to Cook County peace officers and |
3 | | their families when a Cook County peace officer is killed |

5 | | premiums for Cook County peace officers who are terminally |
6 | | ill. |
