1 | AN ACT concerning education.
| ||||||||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||
3 | represented in the General Assembly:
| ||||||||||||||||||||||||
4 | Section 5. The Illinois Mathematics and Science Academy Law | ||||||||||||||||||||||||
5 | is amended by changing Section 4 as follows:
| ||||||||||||||||||||||||
6 | (105 ILCS 305/4) (from Ch. 122, par. 1503-4)
| ||||||||||||||||||||||||
7 | Sec. 4. Powers of the Board. The board is hereby authorized | ||||||||||||||||||||||||
8 | to:
| ||||||||||||||||||||||||
9 | (a) Accept donations, bequests, or other forms of | ||||||||||||||||||||||||
10 | financial assistance
for educational purposes from any | ||||||||||||||||||||||||
11 | public or private person or agency and
comply with rules | ||||||||||||||||||||||||
12 | and regulations governing grants from the federal
| ||||||||||||||||||||||||
13 | government or from any other person or agency, which are | ||||||||||||||||||||||||
14 | not in
contravention of the Illinois Constitution or the | ||||||||||||||||||||||||
15 | laws of the State
of Illinois.
| ||||||||||||||||||||||||
16 | (b) Purchase equipment and make improvements to | ||||||||||||||||||||||||
17 | facilities necessary for
the use of the school, in | ||||||||||||||||||||||||
18 | accordance with applicable law.
| ||||||||||||||||||||||||
19 | (c) Adopt, amend, or repeal rules, regulations, and | ||||||||||||||||||||||||
20 | policies necessary
or proper for the conduct of the | ||||||||||||||||||||||||
21 | business of the board.
| ||||||||||||||||||||||||
22 | (d) Award certificates and issue diplomas for | ||||||||||||||||||||||||
23 | successful completion of
programs of study requirements.

1 | (e) Select a Director who shall be the chief | ||||||
2 | administrative officer of
the Academy and who shall | ||||||
3 | administer the rules, regulations, and policies
adopted by | ||||||
4 | the Board pursuant hereto. The Director shall also be the | ||||||
5 | chief
administrative officer of the Board and shall be | ||||||
6 | responsible for all the
administrative functions, duties, | ||||||
7 | and needs of the Board.

8 | (f) Determine faculty and staff positions necessary | ||||||
9 | for the efficient
operation of the school and select | ||||||
10 | personnel for such positions.
| ||||||
11 | (g) Prepare and adopt an annual budget necessary for | ||||||
12 | the continued
operation of the school.
| ||||||
13 | (h) Enter into contracts and agreements which have been | ||||||
14 | recommended by
the Director, in accordance with applicable | ||||||
15 | law, and to the extent that
funds are specifically | ||||||
16 | appropriated therefor, with other public agencies
with | ||||||
17 | respect to cooperative enterprises and undertaking related | ||||||
18 | to or
associated with an educational purpose or program | ||||||
19 | affecting education in
the school. This shall not preclude | ||||||
20 | the Board from entering into other
such contracts and | ||||||
21 | agreements that it may deem necessary to carry out its
| ||||||
22 | duties and functions.
| ||||||
23 | (h-5) Enter into public-private partnership agreements | ||||||
24 | with private entities for purposes relating to or affecting | ||||||
25 | education in the school. | ||||||
26 | (i) Perform such other functions as are necessary to |

| |||||||
1 | the supervision and
control of those phases of education | ||||||
2 | under its supervision and control.
| ||||||
3 | (j) The Board shall delegate to the Director such of its | ||||||
4 | administrative
powers and duties as it deems appropriate to aid | ||||||
5 | the Director in the
efficient administration of his | ||||||
6 | responsibility for the implementation of
the policies of the | ||||||
7 | Board.
| ||||||
8 | (k) The Academy shall be empowered to lease or purchase | ||||||
9 | real and
personal property on commercially reasonable terms for | ||||||
10 | the use of the
Academy. After July 1, 1988, any leases or | ||||||
11 | purchases of real or personal
property and any disposition | ||||||
12 | thereof by the Academy must be in compliance
with the | ||||||
13 | provisions of The Civil Administrative Code of Illinois and the
| ||||||
14 | State Property Control Act. Personal property acquired for the | ||||||
15 | use of the
Academy shall be inventoried and disposed of in | ||||||
16 | accordance with the State
Property Control Act.
| ||||||
17 | In addition to the authorities granted herein and any | ||||||
18 | powers, duties, and
responsibilities vested by any other | ||||||
19 | applicable laws, the Board shall:
| ||||||
20 | (1) Adopt rules, regulations, and policies necessary | ||||||
21 | for the efficient
operation of the school.
| ||||||
22 | (2) Establish criteria to be used in determining | ||||||
23 | eligibility of
applicants for enrollment. Such criteria | ||||||
24 | shall ensure adequate geographic representation of this | ||||||
25 | State and adequate
sexual and ethnic representation.
| ||||||
26 | (3) Determine subjects and extracurricular activities |
| |||||||
| |||||||
1 | to be offered.
| ||||||
2 | (4) Pay salaries and expenses, including but not | ||||||
3 | necessarily restricted
to facilities, equipment, and | ||||||
4 | supplies of the faculty and staff of the
Academy out of | ||||||
5 | funds appropriated or otherwise made available for the
| ||||||
6 | operating and administrative expenses of the Board and the | ||||||
7 | Academy.
| ||||||
8 | (5) Exercise budgetary responsibility and allocate for
| ||||||
9 | expenditure by the Academy and programs under its | ||||||
10 | jurisdiction, all monies
appropriated or otherwise made | ||||||
11 | available for purposes of the Board and of
such Academy and | ||||||
12 | programs.
| ||||||
13 | (6) Prescribe and select for use in the school free | ||||||
14 | school books and
other materials of instruction for | ||||||
15 | children enrolled in the school and
programs under its | ||||||
16 | jurisdiction for which the General
Assembly provides | ||||||
17 | funds. However, free school books and other materials of | ||||||
18 | instruction need not be provided to students who are not | ||||||
19 | Illinois residents, and a fee may be charged to such | ||||||
20 | students for books and materials.
| ||||||
21 | (7) Prepare and adopt or approve programs of study and | ||||||
22 | rules, bylaws,
and regulations for the conduct of students | ||||||
23 | and for the government of the
school and programs under its | ||||||
24 | jurisdiction.
| ||||||
25 | (8) Employ such personnel as may be needed, establish | ||||||
26 | policies governing
their employment and dismissal, and fix |

| |||||||
1 | the amount of their compensation.
In the employment, | ||||||
2 | establishment of policies and fixing of compensation the
| ||||||
3 | board may make no discrimination on account of sex, race, | ||||||
4 | creed, color or
national origin.
| ||||||
5 | The Academy, its board of trustees, and its employees shall | ||||||
6 | be
represented and indemnified in certain civil law suits in | ||||||
7 | accordance with the State Employee Indemnification Act
"An Act | ||||||
8 | to provide for representation and indemnification in certain | ||||||
9 | civil
law suits", approved December 3, 1977, as amended .
| ||||||
10 | Neither the Academy, nor its officers, employees or board | ||||||
11 | members shall
participate in the creation of any corporation, | ||||||
12 | joint venture, partnership,
association, or other | ||||||
13 | organizational entity which exercises, expands, or
enhances | ||||||
14 | the powers, duties, or responsibilities of the Academy unless
| ||||||
15 | specifically authorized by the General Assembly by law.
| ||||||
16 | This Section does not restrict the Academy from creating | ||||||
17 | any organization
entity which is within or a part of the | ||||||
18 | Academy.

20 | Section 99. Effective date. This Act takes effect upon | ||||||
21 | becoming law.
