2 | | Title IV, Part D of the Social Security Act. The rule shall

3 | | provide for notice to and an opportunity to be heard by each |
4 | | responsible
relative affected and any final administrative |
5 | | decision rendered by the
Department shall be reviewed only |
6 | | under and in accordance with the
Administrative Review Law. A |
7 | | responsible relative shall be provided notice on 3 separate |
8 | | occasions before the suspension of the driver's license of the |
9 | | responsible relative. The first 2 notices shall be issued by |
10 | | the Illinois Department, and the third notice shall be issued |
11 | | by the Secretary of State. If the responsible relative fails to |
12 | | avail himself or herself of the opportunities to prevent the |
13 | | suspension of his or her driver's license, the driver's license |
14 | | shall be suspended until the responsible relative meets the |
15 | | criteria for the restoration of his or her driving privileges.

16 | | (b) The Illinois Department may provide by rule for |
17 | | directing the Secretary of State to issue family financial
|
18 | | responsibility driving permits upon petition of responsible |
19 | | relatives whose driver's licenses have been suspended in |
20 | | accordance with subsection (b) of Section 7-702.1 of the |
21 | | Illinois Vehicle Code. Any final administrative decisions |
22 | | rendered by the Department upon such petitions shall be |
23 | | reviewable only under and in accordance with the
Administrative |
24 | | Review Law. |
