1 | | (2) uses heat in an oxygen-deficient atmosphere to |
2 | | process the feedstock into fuels, chemicals, or chemical |
3 | | feedstocks that are returned to the economic mainstream in |
4 | | the form of raw materials or products. |
5 | | "Plastics pyrolysis facility" means a manufacturing |
6 | | facility that: |
7 | | (1) receives only uncontaminated plastics that have |
8 | | been processed into a feedstock meeting the facility's |
9 | | specifications for a pyrolysis feedstock; and |
10 | | (2) uses heat in the absence of oxygen to process the |
11 | | uncontaminated plastics into fuels, chemicals, or chemical |
12 | | feedstocks that are returned to the economic mainstream in |
13 | | the form of raw materials or products. |
14 | | (b) To the extent allowed by federal law, uncontaminated |
15 | | plastics that have been processed into a feedstock meeting |
16 | | feedstock specifications for a plastics gasification facility |
17 | | or plastics pyrolysis facility, and that are further processed |
18 | | by such a facility and returned to the economic mainstream in |
19 | | the form of raw materials or products, are considered recycled |
20 | | and are not subject to regulation as waste. |
21 | | (c) The Agency may propose to the Board for adoption, and |
22 | | the Board may adopt, rules establishing standards for materials |
23 | | accepted as feedstocks by plastics gasification facilities and |
24 | | plastics pyrolysis facilities, rules establishing standards |
25 | | for the management of feedstocks at plastics gasification |
26 | | facilities and plastics pyrolysis facilities, and any other |
