1    AN ACT concerning civil law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:

Article 1.

 
5    Section 1-5. The State of Illinois owns the following
6described real estate, which is under the control of the
7Department of Transportation:

10    That part of Lot 2 in First Addition to Klefstad's

2the State of Illinois, shall convey by quitclaim deed all
3right, title, and interest of the State of Illinois and the
4Department of Transportation in and to the real estate

6Bensenville, for no less than the fair market value as
7determined by an average of 3 appraisals.
 
8    Section 1-15. The Secretary of Transportation shall obtain
9a certified copy of this Act within 60 days after this Act's
10effective date and shall record the certified document in the
11Recorder's Office of DuPage County, Illinois.

Article 2.

 
13    Section 2-5. Subject to the conditions set forth in Section
142-10, the Director of the Department of Children and Family
15Services, on behalf of the State of Illinois, shall execute and
16deliver to the Carole Robertson Center for Learning, an
17Illinois not-for-profit corporation, for and in consideration
18of $1 paid to the Department, a quitclaim deed to the following
19described real property:
 
20    Lot 1 (except the West 8.0 feet thereof), Lot 14 (except
21    the West 8.0 feet thereof), and Lots 2 through 7, both
22    inclusive, all in Block 1, together with the 16 foot

1    vacated alley lying East of the East line of Lot 14 and
2    lying West of the West line of Lots 2 thru 7, both
3    inclusive, and lying North of the North line of the C.B.& Q
4    R.R. right of way all in Block 1 in Levi P. Morton's
5    subdivision of the SE 1/4 of the SW 1/4 of Section 24,
6    Township 39 North, Range 13 (excepting the right of way of
7    the C.B.& Q. R.R.) all in Cook County.
 
8    Section 2-10. Conditions of conveyance.
9    (a) The quitclaim deed executed under Section 2-5 shall
10convey all right, title, and interest of the State of Illinois
11and the Department of Children and Family Services in and to
12the real property described in Section 2-5 to the Carole
13Robertson Center for Learning.
14    (b) The conveyance of real property authorized by Section
152-5 shall be made subject to existing public utilities,
16existing public roads, and any and all reservations, easements,
17encumbrances, covenants, and restrictions of record.
18    (c) The quitclaim deed to the Carole Robertson Center for
19Learning shall state on its face and be subject to the
20conditions that the real property shall be used by the Carole
21Robertson Center for Learning for a public child care facility
22and that if the Carole Robertson Center for Learning ceases to
23exist, if the real property is used for any purposes other than
24a public child care facility, or if an attempt is made to sell
25the property, then title shall revert without further action to

1the State of Illinois.
 
2    Section 2-15. Recording. The Director of the Department of
3Children and Family Services shall prepare one or more
4quitclaim deeds to convey the real property. The Director may
5also record a certified copy of this Act. Each quitclaim deed
6shall reference this Act and contain the reversionary language
7from subsection (c) of Section 2-10. All documents of
8conveyance shall be recorded in the county in which the land is
9located.

Article 3.

 
11    Section 3-5. The Northern Illinois University Law is
12amended by changing Section 30-45 as follows:
 
13    (110 ILCS 685/30-45)
14    Sec. 30-45. Powers and duties. The Board also shall have
15power and it shall be its duty:
16    (1) To make rules, regulations and bylaws, not inconsistent
17with law, for the government and management of Northern
18Illinois University and its branches.
19    (2) To employ, and, for good cause, to remove a President
20of Northern Illinois University, and all necessary deans,
21professors, associate professors, assistant professors,
22instructors, other educational and administrative assistants,

1and all other necessary employees, and to prescribe their
2duties and contract with them upon matters relating to tenure,
3salaries and retirement benefits in accordance with the State
4Universities Civil Service Act. Whenever the Board establishes
5a search committee to fill the position of President of
6Northern Illinois University, there shall be minority
7representation, including women, on that search committee. The
8Board shall, upon the written request of an employee of
9Northern Illinois University, withhold from the compensation
10of that employee any dues, payments or contributions payable by
11such employee to any labor organization as defined in the
12Illinois Educational Labor Relations Act. Under such
13arrangement, an amount shall be withheld from each regular
14payroll period which is equal to the pro rata share of the
15annual dues plus any payments or contributions, and the Board
16shall transmit such withholdings to the specified labor
17organization within 10 working days from the time of the
18withholding.
19    (3) To prescribe the courses of study to be followed, and
20textbooks and apparatus to be used at Northern Illinois
21University.
22    (4) To issue upon the recommendation of the faculty,
23diplomas to such persons as have satisfactorily completed the
24required studies of Northern Illinois University, and confer
25such professional and literary degrees as are usually conferred
26by other institutions of like character for similar or

1equivalent courses of study, or such as the Board may deem
2appropriate.
3    (5) To examine into the conditions, management, and
4administration of Northern Illinois University, to provide the
5requisite buildings, apparatus, equipment and auxiliary
6enterprises, and to fix and collect matriculation fees; tuition
7fees; fees for student activities; fees for student facilities
8such as student union buildings or field houses or stadia or
9other recreational facilities; student welfare fees;
10laboratory fees; and similar fees for supplies and materials.
11The expense of the building, improving, repairing and supplying
12fuel and furniture and the necessary appliances and apparatus
13for conducting Northern Illinois University, the reimbursed
14expenses of members of the Board, and the salaries or
15compensation of the President, assistants, agents and other
16employees of Northern Illinois University, shall be a charge
17upon the State Treasury. All other expenses shall be chargeable
18against students, and the Board shall regulate the charges
19accordingly.
20    (6) To succeed to and to administer all trusts, trust
21property, and gifts now or hereafter belonging or pertaining to
22Northern Illinois University.
23    (7) To accept endowments of professorships or departments
24in Northern Illinois University from any person who may proffer
25them and, at regular meetings, to prescribe rules and
26regulations in relation to endowments and declare on what

1general principles they may be accepted.
2    (8) To enter into contracts with the Federal government for
3providing courses of instruction and other services at Northern
4Illinois University for persons serving in or with the military
5or naval forces of the United States, and to provide such
6courses of instruction and other services.
7    (9) To contract with respect to the Cooperative Computer
8Center to obtain services related to electronic data
9processing.
10    (10) To provide for the receipt and expenditures of Federal
11funds paid to Northern Illinois University by the Federal
12government for instruction and other services for persons
13serving in or with the military or naval forces of the United
14States, and to provide for audits of such funds.
15    (11) To appoint, subject to the applicable civil service
16law, persons to be members of the Northern Illinois University
17Police Department. Members of the Police Department shall be
18conservators of the peace and as such have all powers possessed
19by policemen in cities, and sheriffs, including the power to
20make arrests on view or warrants of violations of State
21statutes, University rules and regulations and city or county
22ordinances, except that they may exercise such powers only
23within counties wherein Northern Illinois University and any of
24its branches or properties are located when such is required
25for the protection of University properties and interests, and
26its students and personnel, and otherwise, within such

1counties, when requested by appropriate State or local law
2enforcement officials. However, such officers shall have no
3power to serve and execute civil processes.
4    The Board must authorize to each member of the Northern
5Illinois University Police Department and to any other employee
6of Northern Illinois University exercising the powers of a
7peace officer a distinct badge that, on its face, (i) clearly
8states that the badge is authorized by Northern Illinois
9University and (ii) contains a unique identifying number. No
10other badge shall be authorized by Northern Illinois
11University.
12    (12) The Board may, directly or in cooperation with other
13institutions of higher education, acquire by purchase or lease
14or otherwise, and construct, enlarge, improve, equip,
15complete, operate, control and manage research and high
16technology parks, together with the necessary lands,
17buildings, facilities, equipment, and personal property
18therefor, to encourage and facilitate (i) the location and
19development of business and industry in the State of Illinois,
20and (ii) the increased application and development of
21technology, and (iii) the improvement and development of the
22State's economy. The Board may lease to nonprofit corporations
23all or any part of the land, buildings, facilities, equipment
24or other property included in a research and high technology
25park upon such terms and conditions as the Board may deem
26advisable and enter into any contract or agreement with such

1nonprofit corporations as may be necessary or suitable for the
2construction, financing, operation and maintenance and
3management of any such park; and may lease to any person, firm,
4partnership or corporation, either public or private, any part
5or all of the land, building, facilities, equipment or other
6property of such park for such purposes and upon such rentals,
7terms and conditions as the Board may deem advisable; and may
8finance all or part of the cost of any such park, including the
9purchase, lease, construction, reconstruction, improvement,
10remodeling, addition to, and extension and maintenance of all
11or part of such high technology park, and all equipment and
12furnishings, by legislative appropriations, government grants,
13contracts, private gifts, loans, receipts from the operation of
14such high technology park, rentals and similar receipts; and
15may make its other facilities and services available to tenants
16or other occupants of any such park at rates which are
17reasonable and appropriate.
18    (13) To assist in the provision of buildings and facilities
19beneficial to, useful for, or supportive of university
20purposes, the Board of Trustees of Northern Illinois University
21may exercise the following powers with regard to the areas area
22located on or adjacent to the Northern Illinois University
23DeKalb campus and bounded as follows:

11    Any buildings or facilities to be developed on the land
12shall be buildings or facilities that, in the determination of
13the Board of Trustees, in whole or in part: (i) are for use by
14the University; or (ii) otherwise advance the interests of the
15University, including, by way of example, residential,
16recreational, educational, and athletic facilities for
17University staff and students and commercial facilities which
18provide services needed by the University community. Revenues
19from the development fund account may be withdrawn by the
20University for the purpose of demolition and the processes
21associated with demolition; repairs to existing campus
22facilities and infrastructure, and professional services
23associated with planning and design routine land and property
24acquisition; extension of utilities; streetscape work;
25landscape work; surface and structure parking; sidewalks,
26recreational paths, and street construction; and lease and

1lease purchase arrangements and the professional services
2associated with the planning and development of the area.
3Moneys from the development fund account used for any other
4purpose must be deposited into and appropriated from the
5General Revenue Fund. Buildings or facilities leased to an
6entity or person other than the University shall not be subject
7to any limitations applicable to a State-supported college or
8university under any law. All development on the land and all
9the use of any buildings or facilities shall be subject to the
10control and approval of the Board of Trustees of Northern
11Illinois University.
12    (14) To borrow money, as necessary, from time to time in
13anticipation of receiving tuition, payments from the State of
14Illinois, or other revenues or receipts of the University, also
15known as anticipated moneys. The borrowing limit shall be
16capped at 100% of the total amount of payroll and other expense
17vouchers submitted and payable to the University for fiscal
18year 2010 expenses, but unpaid by the State Comptroller's
19office. Prior to borrowing any funds, the University shall
20request from the Comptroller's office a verification of the
21borrowing limit and shall include the estimated date on which
22such borrowing shall occur. The borrowing limit cap shall be
23verified by the State Comptroller's office not prior to 45 days
24before any estimated date for executing any promissory note or
25line of credit established under this item (14). The principal
26amount borrowed under a promissory note or line of credit shall

1not exceed 75% of the borrowing limit. Within 15 days after
2borrowing funds under any promissory note or line of credit
3established under this item (14), the University shall submit
4to the Governor's Office of Management and Budget, the Speaker
5of the House of Representatives, the Minority Leader of the
6House of Representatives, the President of the Senate, and the
7Minority Leader of the Senate an Emergency Short Term Cash
8Management Plan. The Emergency Short Term Cash Management Plan
9shall outline the amount borrowed, the terms for repayment, the
10amount of outstanding State vouchers as verified by the State
11Comptroller's office, and the University's plan for
12expenditure of any borrowed funds, including, but not limited
13to, a detailed plan to meet payroll obligations for all
14collective bargaining employees, civil service employees, and
15academic, research, and health care personnel. The
16establishment of any promissory note or line of credit
17established under this item (14) must be finalized within 90
18days after the effective date of this amendatory Act of the
1996th General Assembly. The borrowed moneys shall be applied to
20the purposes of paying salaries and other expenses lawfully
21authorized in the University's State appropriation and unpaid
22by the State Comptroller. Any line of credit established under
23this item (14) shall be paid in full one year after creation or
24within 10 days after the date the University receives
25reimbursement from the State for all submitted fiscal year 2010
26vouchers, whichever is earlier. Any promissory note

1established under this item (14) shall be repaid within one
2year after issuance of the note. The Chairman, Comptroller, or
3Treasurer of the Board shall execute a promissory note or
4similar debt instrument to evidence the indebtedness incurred
5by the borrowing. In connection with a borrowing, the Board may
6establish a line of credit with a financial institution,
7investment bank, or broker/dealer. The obligation to make the
8payments due under any promissory note or line of credit
9established under this item (14) shall be a lawful obligation
10of the University payable from the anticipated moneys. Any
11borrowing under this item (14) shall not constitute a debt,
12legal or moral, of the State and shall not be enforceable
13against the State. The promissory note or line of credit shall
14be authorized by a resolution passed by the Board and shall be
15valid whether or not a budgeted item with respect to that
16resolution is included in any annual or supplemental budget
17adopted by the Board. The resolution shall set forth facts
18demonstrating the need for the borrowing, state an amount that
19the amount to be borrowed will not exceed, and establish a
20maximum interest rate limit not to exceed the maximum rate
21authorized by the Bond Authorization Act or 9%, whichever is
22less. The resolution may direct the Comptroller or Treasurer of
23the Board to make arrangements to set apart and hold the
24portion of the anticipated moneys, as received, that shall be
25used to repay the borrowing, subject to any prior pledges or
26restrictions with respect to the anticipated moneys. The

1resolution may also authorize the Treasurer of the Board to
2make partial repayments of the borrowing as the anticipated
3moneys become available and may contain any other terms,

7means any bank subject to the Illinois Banking Act, any savings
8and loan association subject to the Illinois Savings and Loan
9Act of 1985, and any federally chartered commercial bank or

12laws of the United States.

8    (b) This Section is repealed 3 years after the effective
9date of this amendatory Act of the 101st General Assembly.

Article 5.

 
11    Section 5-5. The State Comptroller Act is amended by adding
12Section 28 as follows:
 
13    (15 ILCS 405/28 new)
14    Sec. 28. State Comptroller purchase of real property.
15    (a) Subject to the provisions of the Public Contract Fraud
16Act, the State Comptroller, on behalf of the State of Illinois,
17is authorized during State fiscal years 2021 and 2022 to
18acquire real property located in the City of Springfield, which
19the State Comptroller deems necessary to properly carry out the
20powers and duties vested in him or her. Real property acquired
21under this Section may be acquired subject to any third party
22interests in the property that do not prevent the State

1Comptroller from exercising the intended beneficial use of such
2property. This subsection (a) is inoperative on and after July
31, 2022.
4    (b) Subject to the provisions of the Comptroller's
5Procurement Rules, which shall be substantially in accordance
6with the requirements of the Illinois Procurement Code, the
7State Comptroller may:
8        (1) enter into contracts relating to construction,
9    reconstruction, or renovation projects for any such
10    buildings or lands acquired under subsection (a); and
11        (2) equip, lease, repair, operate, and maintain those
12    grounds, buildings, and facilities as may be appropriate to
13    carry out his or her statutory purposes and duties.
14    (c) The State Comptroller may enter into agreements for the
15purposes of exercising his or her authority under this Section.
16    (d) The exercise of the authority vested in the Comptroller
17to acquire property under this Section is subject to
18appropriation.
19    (e) The Capital Facility and Technology Modernization Fund
20is hereby created as a special fund in the State treasury.
21Subject to appropriation, moneys in the Fund shall be used by
22the Comptroller for the purchase, reconstruction, lease,
23repair, and maintenance of real property as may be acquired
24under this Section, including for expenses related to the
25modernization and maintenance of information technology
26systems and infrastructure.
