Amends the Counties Code. Provides that the county board or board of county commissioners of a county may prohibit the sale of and the use of coal tar sealant product and high polycyclic aromatic hydrocarbon sealant product on any surface, except for highway structures, including, but not limited to, a driveway, parking area, playground, sidewalk, bike trail, or roadway within the county. Amends the Municipal Code making similar changes.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 5. The Counties Code is amended by adding Section |
5 | | 5-1061.5 as follows: |
6 | | (55 ILCS 5/5-1061.5 new) |
7 | | Sec. 5-1061.5. Coal tar sealant product and high polycyclic |
8 | | aromatic hydrocarbon sealant product. |
9 | | (a) As used in this Section: |
10 | | "Coal tar sealant product" means a surface applied sealing |
11 | | product containing any amount of coal tar, coal tar pitch, coal |
12 | | tar pitch volatiles, or any variation assigned the Chemical |
13 | | Abstracts Service number 65996-93-2, 65996-89-6, or 8007-45-2. |
14 | | "High polycyclic aromatic hydrocarbon sealant product" |
15 | | means a surface applied sealing product that contains greater |
16 | | than 0.1% polycyclic aromatic hydrocarbons by weight, |
17 | | including, but not limited to coal tar pitch volatiles, tar, |
18 | | fuel oil, petroleum, or asphalt. |
19 | | (b) The county board or board of county commissioners of a |
20 | | county may prohibit the sale of and the use of coal tar sealant |
21 | | product and high polycyclic aromatic hydrocarbons sealant |
22 | | product on any surface, except for highway structures, |
23 | | including, but not limited to, a driveway, parking area, |
