Amends the Mental Health and Developmental Disabilities Code. Provides that a peace officer may take a person into custody and transport
the person to a mental health facility if the peace officer has administered an opioid antagonist to the person in response to an opioid overdose. Defines "opioid antagonist".

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Mental Health and Developmental |
5 | | Disabilities Code is amended by changing Section 3-606 as |
6 | | follows: |
7 | | (405 ILCS 5/3-606) (from Ch. 91 1/2, par. 3-606) |
8 | | Sec. 3-606. (a) In this Section, "opioid antagonist" has |
9 | | the meaning ascribed to it in paragraph (4) of subsection (d) |
10 | | of Section 5-23 of the Substance Use Disorder Act. |
11 | | (b) A peace officer may take a person into custody and |
12 | | transport
him to a mental health facility when
the peace |
13 | | officer has reasonable grounds to believe that the person is
|
14 | | subject to involuntary admission on an inpatient basis and in |
15 | | need of immediate hospitalization
to protect such person or |
16 | | others from physical harm or if the peace officer has |
17 | | administered an opioid antagonist to the person in response to |
18 | | an opioid overdose . Upon arrival at the
facility, the peace |
19 | | officer may
complete the petition under Section 3-601. If the |
20 | | petition is not completed by the peace officer transporting the |
21 | | person, the transporting officer's name, badge number, and |
22 | | employer shall be included in the petition as a potential |
23 | | witness as provided in Section 3-601 of this Chapter.
