    Amends the Illinois Act on the Aging. Defines "greatest social need" for the purpose of a specified rule. Makes a conforming change. Amends the Assisted Living and Shared Housing Act. Prohibits unlawful discrimination by an owner, licensee, administrator, employee, or agent of an assisted living establishment of residents in assisted living establishments. Provides that unlawful discrimination does not include an action by an owner, licensee, administrator, employee, or agent that is required by the Act or rules adopted under the Act. Effective immediately.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Act on the Aging is amended by
5changing Section 3 and by adding Section 3.11 as follows:
 
6    (20 ILCS 105/3)  (from Ch. 23, par. 6103)
7    Sec. 3. As used in this Act, unless the context otherwise
8requires, the terms specified in Sections 3.01 through 3.11
93.10 have the meanings ascribed to them in those Sections.

12    Sec. 3.11. Greatest social need. For the purposes of 89
13Ill. Adm. Code 210.50, "greatest social need" means the need
14caused by noneconomic factors that restrict an individual's
15ability to perform normal daily tasks or that threaten his or
16her capacity to live independently. These factors include
17physical or mental disability, language barriers, and cultural
18or social isolation caused by, among other things, racial and
19ethnic status, sexual orientation, gender identity, gender
20expression, or HIV status.
 
21    Section 10. The Assisted Living and Shared Housing Act is

1amended by adding Section 97 as follows:
 
2    (210 ILCS 9/97 new)
3    Sec. 97. Unlawful discrimination. No resident shall be
4subjected to unlawful discrimination as defined in Section
51-103 of the Illinois Human Rights Act by any owner, licensee,
6administrator, employee, or agent of an assisted living
7establishment. Unlawful discrimination does not include an
8action by any owner, licensee, administrator, employee, or
9agent of an assisted living establishment that is required by
10this Act or rules adopted under this Act.
 
11    Section 99. Effective date. This Act takes effect upon
12becoming law.
