Amends the Bees and Apiaries Act. Provides that a person registered with the Department of Agriculture who owns and operates an apiary in a reasonable manner in conformance with Department rules is not liable for any personal injury or property damage that occurs in connection with the keeping and maintaining of bees, bee equipment, queen breeding equipment, or apiaries and appliances. Provides that these limits of liability do not apply to intentional tortious conduct or acts or omission that constitute gross negligence.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Bees and Apiaries Act is amended by changing |
5 | | Section 2 as follows:
|
6 | | (510 ILCS 20/2) (from Ch. 8, par. 124)

7 | | Sec. 2. Registration; liability. |
8 | | (a) Every person keeping one or more colonies
of bees shall |
9 | | register with the Department annually.
|
10 | | (b) Every person keeping one or more colonies of bees may |
11 | | be required to
post
his or her registration number in a |
12 | | prominent place within each apiary under
his or her control.
|
13 | | (c) A person registered with the Department who owns and |
14 | | operates an apiary in a reasonable manner in conformance with |
15 | | Department rules is not liable for any personal injury or |
16 | | property damage that occurs in connection with the keeping and |
17 | | maintaining of bees, bee equipment, queen breeding equipment, |
18 | | or apiaries and appliances. The limits of liability described |
19 | | in this subsection (c) do not apply to intentional tortious |
20 | | conduct or acts or omission that constitute gross negligence. |
