Creates the Local Government Residential Inspection Limitation Act. Provides that except for a fire, medical, or police emergency or as otherwise permitted by specified provisions of the Fire Investigation Act, a unit of local government may not conduct a physical inspection of residential property without the voluntary consent of the owner or occupant of the property, a lawful warrant, or court order. Limits home rule powers.

1 | | AN ACT concerning local government.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 1. Short title. This Act may be cited as the Local |
5 | | Government Residential Inspection Limitation Act. |
6 | | Section 5. Physical inspection of residential property. |
7 | | Except for a fire, medical, or police emergency or as otherwise |
8 | | permitted by Section 9 of the Fire Investigation Act, a unit of |
9 | | local government may not conduct a physical inspection of |
10 | | residential property without the voluntary consent of the owner |
11 | | or occupant of the property, a lawful warrant, or court order. |
12 | | This Section is a denial and limitation of home rule powers and |
13 | | functions under subsection (g) of Section 6 of Article VII of |
14 | | the Illinois Constitution.
