AMENDMENT TO HOUSE BILL 2172

2    AMENDMENT NO. ______. Amend House Bill 2172 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Public Utilities Act is amended by adding
5Section 8-512 as follows:
 
6    (220 ILCS 5/8-512 new)
7    Sec. 8-512. Natural gas facility reporting.
8    (a) The General Assembly finds that the safety and
9reliability of the natural gas distribution system in Illinois
10is important to the health and welfare of the citizenry of this
11State. National and local events have demonstrated the
12importance of regular maintenance and replacement of gas
13pipeline and related facilities. In order to preserve the
14health and welfare of citizens and avoid the burden of large
15financial expenditures to remedy delayed pipeline replacement,
16the General Assembly finds that each natural gas utility

1subject to this Section shall be required to annually report to
2the Commission its existing and newly installed pipeline
3facilities in order to allow the Commission to monitor and
4address as necessary natural gas utilities' pipeline
5replacement programs.
6    (b) Each natural gas public utility serving more than
7100,000 customers shall submit to the Commission with its
8annual Form 21 ILCC filing the following additional information
9for a pipeline owned and operated by the utility as of December
1031 of the preceding calendar year:
11        (1) the length in feet categorized by year of
12    installation;
13        (2) the length in feet categorized by diameter size and
14    material composed of;
15        (3) the length in feet categorized by scheduled
16    replacement year, if any;
17        (4) the length in feet installed during the preceding
18    calendar year for the purpose of replacing existing
19    pipeline and under a tariff authorized by Section 9-220.3
20    categorized by diameter size and material composed of;
21        (5) the length in feet installed during the preceding
22    calendar year for the purpose of replacing existing
23    pipeline and not under a tariff authorized by Section
24    9-220.3 categorized by diameter size and material composed
25    of;
26        (6) the length in feet installed during the preceding

1    calendar year not for the purpose of replacing existing
2    pipeline categorized by diameter size and material
3    composed of;
4        (7) for each individual project, the cost incurred and
5    associated number of meters, both existing meters and
6    meters associated with newly connected customers, for the
7    construction activities described in paragraphs (4), (5),
8    and (6); and
9        (8) for the construction activities described in
10    paragraphs (4), (5), and (6), a brief description of the
11    reason for the activities and the location in relation to
12    the nearest incorporated municipality.
13    (c) No later than October 1 of each year, the Commission
14shall submit to the General Assembly a report containing the
15information set forth in subsection (b) and evaluating the
16safety and reliability of the natural gas distribution system
17in Illinois. The Commission report shall address the
18sufficiency of utility plans for replacing obsolete pipeline
19and maintaining the safety and reliability of their respective
20gas distribution systems.
21    (d) The annual reports submitted to the Commission by the
22natural gas utilities and the report submitted by the
23Commission to the General Assembly shall be made available to
24the public on the Commission's website. The first reports of
25the additional information required under subsection (b) shall
26be for 2019 and submitted to the Commission in 2020.

1    (e) If the Commission deems it necessary, it may adopt
2rules to facilitate implementation of the reporting
3requirements contained in this Section. The Commission may
4require additional information from the gas utilities subject
5to this Section if necessary to provide the report to the
6General Assembly required under subsection (c).".
