AMENDMENT TO HOUSE BILL 1866

2    AMENDMENT NO. ______. Amend House Bill 1866 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the
5Autonomous Vehicle Act.
 
6    Section 5. Definitions. As used in this Act:
7    "Automated driving system" means technology installed on a
8motor vehicle that has the capability, on a part-time or
9full-time basis, to drive the vehicle without the need for
10supervision of the driving environment by a human driver or
11operator, whether or not a human driver or operator is in the
12vehicle.
13    "Autonomous vehicle tester" means an autonomous vehicle
14manufacturer, institution of higher education, fleet service
15provider, or automotive equipment or technology provider.
16    "Department" means the Department of Transportation.

1    "Fleet service provider" means a person or entity that owns
2or leases a fully autonomous vehicle and operates such fully
3autonomous vehicle for commercial or public use.
4    "Fully autonomous vehicle" means a motor vehicle that is
5equipped with an automated driving system, designed to function
6without an operator and classified as level 4 or level 5 by SAE
7J3016.
8    "Operator" means the person seated in the driver's seat of
9a fully autonomous vehicle.
10    "SAE J3016" means the "Taxonomy and Definitions for Terms
11Related to Driving Automation Systems for On-Road Motor
12Vehicles" published by SAE International in September 2016.
 
13    Section 10. Pilot program.
14    (a) The Department shall establish a pilot program for not
15less than 5 and not more than 10 municipalities to allow
16autonomous vehicle testers to test fully autonomous vehicles on
17the highways of such municipalities. Municipalities shall
18apply to the Department in the manner and form prescribed by
19the Department for inclusion in the pilot program.
20    (b) If selected to participate, the chief elected official
21or chief executive officer of the municipality shall select and
22enter into a written agreement with an autonomous vehicle
23tester or autonomous vehicle testers to test fully autonomous
24vehicles on the highways of the municipality.

1    Section 15. Selected autonomous vehicle testers.
2    (a) Selected autonomous vehicle testers shall be required
3to meet the following requirements:
4        (1) Have a properly licensed operator either seated in
5    the driver's seat of the fully autonomous vehicle or
6    remotely monitoring the vehicle in real time.
7        (2) Be capable of taking immediate manual control of
8    such fully autonomous vehicle.
9    (b) Selected autonomous vehicle testers shall be required
10to:
11        (1) Register each fully autonomous vehicle to be tested
12    with the Department.
13        (2) Submit to the Department, in a manner and form
14    directed by the Department, proof of liability insurance,
15    self-insurance, or a surety bond of at least $5,000,000 for
16    damages by reason of bodily injury, death, or property
17    damage caused by a fully autonomous vehicle.
18        (3) Provide information to the Department that the
19    Department deems to be appropriate for measuring the
20    performance of the pilot program.
21    An autonomous vehicle tester may withhold any commercially
22valuable, confidential, or proprietary information.
 
23    Section 20. Operation of a fully autonomous vehicle.
24    (a) An operator of a fully autonomous motor vehicle must
25comply with any provision of the general statutes, any

1ordinance of a municipality concerning the operation of motor
2vehicles, any standards established by the National Highway
3Traffic Safety Administration regarding fully autonomous
4vehicles, and any other requirements set by the Department in
5consultation with the other agencies as necessary to ensure the
6safe operation of such fully autonomous vehicle.
7    (b) An operator of a fully autonomous motor vehicle shall
8be considered the driver or operator for purposes of assessing
9conformance to applicable traffic or motor vehicle laws; shall
10be validly licensed to operate a motor vehicle under Section
116-101 of the Illinois Vehicle Code and Section 15 of the
12Transportation Network Providers Act; shall satisfy all the
13applicable requirements to be licensed under this Act; and
14shall satisfy any physical acts required of a driver or
15operator, including, but not limited to, those required under
16Section 6-112 of the Illinois Vehicle Code.
 
17    Section 25. Limiting provisions.
18    (a) No autonomous vehicle tester shall test a fully
19autonomous vehicle on any limited access highway unless
20strictly authorized by the Department in consultation with
21other agencies.
22    (b) The Department may immediately prohibit an operator or
23autonomous vehicle tester from testing a fully autonomous
24vehicle if the Department, in consultation with other agencies,
25determines that such testing poses a risk to public safety or

1that the operator or autonomous vehicle tester has failed to
2comply with the provisions or requirements of the pilot
3program.
 
4    Section 30. Annual report. The Department shall publish an
5annual report concerning the implementation and progress of the
6pilot program.
 
7    Section 99. Effective date. This Act takes effect upon
8becoming law.".
