2 | | AMENDMENT NO. ______. Amend House Bill 1866 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 1. Short title. This Act may be cited as the |
5 | | Autonomous Vehicle Act. |
6 | | Section 5. Definitions. As used in this Act: |
7 | | "Automated driving system" means technology installed on a |
8 | | motor vehicle that has the capability, on a part-time or |
9 | | full-time basis, to drive the vehicle without the need for |
10 | | supervision of the driving environment by a human driver or |
11 | | operator, whether or not a human driver or operator is in the |
12 | | vehicle. |
13 | | "Autonomous vehicle tester" means an autonomous vehicle |
14 | | manufacturer, institution of higher education, fleet service |
15 | | provider, or automotive equipment or technology provider. |
16 | | "Department" means the Department of Transportation. |

1 | | "Fleet service provider" means a person or entity that owns |
2 | | or leases a fully autonomous vehicle and operates such fully |
3 | | autonomous vehicle for commercial or public use. |
4 | | "Fully autonomous vehicle" means a motor vehicle that is |
5 | | equipped with an automated driving system, designed to function |
6 | | without an operator and classified as level 4 or level 5 by SAE |
7 | | J3016. |
8 | | "Operator" means the person seated in the driver's seat of |
9 | | a fully autonomous vehicle. |
10 | | "SAE J3016" means the "Taxonomy and Definitions for Terms |
11 | | Related to Driving Automation Systems for On-Road Motor |
12 | | Vehicles" published by SAE International in September 2016. |
13 | | Section 10. Pilot program. |
14 | | (a) The Department shall establish a pilot program for not |
15 | | less than 5 and not more than 10 municipalities to allow |
16 | | autonomous vehicle testers to test fully autonomous vehicles on |
17 | | the highways of such municipalities. Municipalities shall |
18 | | apply to the Department in the manner and form prescribed by |
19 | | the Department for inclusion in the pilot program. |
20 | | (b) If selected to participate, the chief elected official |
21 | | or chief executive officer of the municipality shall select and |
22 | | enter into a written agreement with an autonomous vehicle |
23 | | tester or autonomous vehicle testers to test fully autonomous |
24 | | vehicles on the highways of the municipality. |

1 | | Section 15. Selected autonomous vehicle testers. |
2 | | (a) Selected autonomous vehicle testers shall be required |
3 | | to meet the following requirements: |
4 | | (1) Have a properly licensed operator either seated in |
5 | | the driver's seat of the fully autonomous vehicle or |
6 | | remotely monitoring the vehicle in real time. |
7 | | (2) Be capable of taking immediate manual control of |
8 | | such fully autonomous vehicle. |
9 | | (b) Selected autonomous vehicle testers shall be required |
10 | | to: |
11 | | (1) Register each fully autonomous vehicle to be tested |
12 | | with the Department. |
13 | | (2) Submit to the Department, in a manner and form |
14 | | directed by the Department, proof of liability insurance, |
15 | | self-insurance, or a surety bond of at least $5,000,000 for |
16 | | damages by reason of bodily injury, death, or property |
17 | | damage caused by a fully autonomous vehicle. |
18 | | (3) Provide information to the Department that the |
19 | | Department deems to be appropriate for measuring the |
20 | | performance of the pilot program. |
21 | | An autonomous vehicle tester may withhold any commercially |
22 | | valuable, confidential, or proprietary information. |
23 | | Section 20. Operation of a fully autonomous vehicle. |
24 | | (a) An operator of a fully autonomous motor vehicle must |
25 | | comply with any provision of the general statutes, any |

1 | | ordinance of a municipality concerning the operation of motor |
2 | | vehicles, any standards established by the National Highway |
3 | | Traffic Safety Administration regarding fully autonomous |
4 | | vehicles, and any other requirements set by the Department in |
5 | | consultation with the other agencies as necessary to ensure the |
6 | | safe operation of such fully autonomous vehicle. |
7 | | (b) An operator of a fully autonomous motor vehicle shall |
8 | | be considered the driver or operator for purposes of assessing |
9 | | conformance to applicable traffic or motor vehicle laws; shall |
10 | | be validly licensed to operate a motor vehicle under Section |
11 | | 6-101 of the Illinois Vehicle Code and Section 15 of the |
12 | | Transportation Network Providers Act; shall satisfy all the |
13 | | applicable requirements to be licensed under this Act; and |
14 | | shall satisfy any physical acts required of a driver or |
15 | | operator, including, but not limited to, those required under |
16 | | Section 6-112 of the Illinois Vehicle Code. |
17 | | Section 25. Limiting provisions. |
18 | | (a) No autonomous vehicle tester shall test a fully |
19 | | autonomous vehicle on any limited access highway unless |
20 | | strictly authorized by the Department in consultation with |
21 | | other agencies. |
22 | | (b) The Department may immediately prohibit an operator or |
23 | | autonomous vehicle tester from testing a fully autonomous |
24 | | vehicle if the Department, in consultation with other agencies, |
25 | | determines that such testing poses a risk to public safety or |
