| 2 | | AMENDMENT NO. ______. Amend House Bill 1729 by replacing |
| 3 | | everything after the enacting clause with the following:

| 4 | | "Section 1. Short title. This Act may be cited as the Local |
| 5 | | Working Animal Protection Act.
|
| 6 | | Section 5. Definition. As used in this Act, "working |
| 7 | | animal" means a non-human animal used for the purpose of |
| 8 | | performing a specific duty or function in commerce or animal |
| 9 | | enterprise, including, but not limited to, human service, |
| 10 | | transportation, education, competition, or exhibition.

| 11 | | Section 10. Working animal regulation. Notwithstanding any |
| 12 | | other provision of law to the contrary, the right to utilize |
| 13 | | working animals for the benefit and welfare of the animals or |
| 14 | | those they serve is guaranteed. No ordinance or rule shall be |
| 15 | | enacted by a unit of local government, including a home rule |

| 1 | | unit, that terminates, bans, effectively bans, or creates an |
| 2 | | undue financial hardship relating to the job or use of working |
| 3 | | animals or animal enterprise in commerce, service, legal |
| 4 | | hunting, agriculture, husbandry, transportation, ranching, |
| 5 | | entertainment, education, or exhibition.

| 6 | | Section 15. Limitations.
|
| 7 | | (a) Nothing in this Act alters State law or rules that |
| 8 | | regulate animal care, public health, or public safety.
|
| 9 | | (b) Nothing in this Act prevents the establishment of or |
| 10 | | alteration of ordinances or rules by a unit of local government |
| 11 | | regarding animal care, public health, or public safety.
|
| 12 | | Section 20. Home rule. A home rule unit may not regulate |
| 13 | | working animals in a manner inconsistent with this Act. This |
| 14 | | Act is a limitation under subsection (i) of Section 6 of |
| 15 | | Article VII of the Illinois Constitution on the concurrent |
| 16 | | exercise by home rule units of powers and functions exercised |
| 17 | | by the State.

| 18 | | Section 25. Conflict with ordinance or rule. If a unit of |
| 19 | | local government has an ordinance, resolution, or rule that |
| 20 | | conflicts with this Act, this Act controls.".
