AMENDMENT TO HOUSE BILL 1687

2    AMENDMENT NO. ______. Amend House Bill 1687 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Child Death Review Team Act is amended by
5changing Section 30 as follows:
 
6    (20 ILCS 515/30)
7    Sec. 30. Public access to information.
8    (a) Meetings of the child death review teams and the
9Executive Council shall be closed to the public. Meetings of
10the child death review teams and the Executive Council are not
11subject to the Open Meetings Act (5 ILCS 120), as provided in
12that Act.
13    (b) Records and information provided to a child death
14review team and the Executive Council, and records maintained
15by a team or the Executive Council, are confidential and not
16subject to the Freedom of Information Act (5 ILCS 140), as

1provided in that Act.
2    Nothing contained in this subsection (b) prevents the
3sharing or disclosure of records, other than those produced by
4a Child Death Review Team or the Executive Council, relating or
5pertaining to the death of a minor under the care of or
6receiving services from the Department of Children and Family
7Services and under the jurisdiction of the juvenile court with
8the juvenile court, the State's Attorney, and the minor's
9attorney.
10    (c) Members of a child death review team and the Executive
11Council are not subject to examination, in any civil or
12criminal proceeding, concerning information presented to
13members of the team or the Executive Council or opinions formed
14by members of the team or the Executive Council based on that
15information. A person may, however, be examined concerning
16information provided to a child death review team or the
17Executive Council that is otherwise available to the public.
18    (d) Records and information produced by a child death
19review team and the Executive Council are only not subject to
20discovery or subpoena by the State's Attorney's office
21reviewing the child death case but and are not admissible as
22evidence in any civil or criminal proceeding. The State's
23Attorney's offices may not disclose these records and
24information to the public. Those records and information are,
25however, subject to discovery or a subpoena, and are admissible
26as evidence, to the extent they are otherwise available to the
