Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that the Department of Healthcare and Family Services shall not require any resident of a nursing home licensed under the Nursing Home Care Act to enroll in or transition to the State's managed care medical assistance program, including any demonstration program operated by contract with the federal Centers for Medicare and Medicaid Services. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Illinois Public Aid Code is amended by |
5 | | adding Section 5-30b as follows: |
6 | | (305 ILCS 5/5-30b new) |
7 | | Sec. 5-30b. Managed care exemption; nursing home |
8 | | residents. Notwithstanding any other provision of law, the |
9 | | Department shall not require any resident of a nursing home |
10 | | licensed under the Nursing Home Care Act to enroll in or |
11 | | transition to the State's managed care medical assistance |
12 | | program, including any demonstration program operated by |
13 | | contract with the federal Centers for Medicare and Medicaid |
14 | | Services or its successor.

15 | | Section 99. Effective date. This Act takes effect upon |
16 | | becoming law.
