1 | AN ACT concerning education.

2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Public Community College Act is amended by | ||||||
5 | changing Sections 3-8 and 3-10 as follows:
| ||||||

7 | Sec. 3-8. Board meetings; public comments and questions. | ||||||
8 | (a) In this Section, "reasonable emergency" means any | ||||||
9 | imminent need to maintain the operations or facilities of the | ||||||
10 | community college district and that such need is due to | ||||||
11 | circumstances beyond the control of the board. | ||||||
12 | (b) Following each election and canvass, the new board | ||||||
13 | shall
hold its organizational meeting on or before the 28th day | ||||||
14 | after the election. If the election is the initial election | ||||||
15 | ordered by the regional superintendent,
the organizational | ||||||
16 | meeting shall be convened by the regional superintendent,
who | ||||||
17 | shall preside over the meeting until the election for chairman, | ||||||
18 | vice
chairman , and secretary of board is completed. At all | ||||||
19 | other organizational
meetings, the chairman of the board, or, | ||||||
20 | in his or her absence, the president
of the community college | ||||||
21 | or acting chief executive officer of the college shall
convene | ||||||
22 | the new board, and conduct the election for chairman, vice | ||||||
23 | chairman , and
secretary. In either case, the secretary of the |

1 | board may be a member of the board. If the secretary is not a | ||||||
2 | member of the board, he or she may receive compensation that | ||||||
3 | shall be fixed by the board prior to the election of the | ||||||
4 | secretary. The board shall then proceed with its organization | ||||||
5 | under the newly
elected board officers, and shall fix a time | ||||||
6 | and place for its regular
meetings. It shall then enter upon | ||||||
7 | the discharge of its duties. Public notice of the schedule of | ||||||
8 | regular meetings for the next calendar year, as set at the | ||||||
9 | organizational meeting, must be given at the beginning of that | ||||||
10 | calendar year. The terms of
board office shall be 2 years, | ||||||
11 | except that the board by resolution may
establish a policy for | ||||||
12 | the terms of office to be one year, and provide for the
| ||||||
13 | election of officers for the remaining one-year one year | ||||||
14 | period.
Terms of members are subject to Section 2A-54 of the | ||||||
15 | Election Code.

16 | (c) Beginning 45 days prior to the Tuesday following the | ||||||
17 | first Monday of April in odd-numbered years until the first | ||||||
18 | organizational meeting of the new board, no addendum to modify | ||||||
19 | or amend an employee agreement between a community college | ||||||
20 | district and the district's president, chancellor, or chief | ||||||
21 | executive officer may be agreed to or executed, nor may an | ||||||
22 | employment contract be made and entered into between the board | ||||||
23 | of an established community college district and a president, | ||||||
24 | chancellor, or chief executive officer. If the current board | ||||||
25 | must take such action at any time during the 45 days prior to | ||||||
26 | the Tuesday following the first Monday of April in odd-numbered |

1 | years until the first organizational meeting of the new board | ||||||
2 | due to a reasonable emergency, then that action shall be | ||||||
3 | terminated on the 60th day after the first organizational | ||||||
4 | meeting, unless the new board, by resolution, reaffirms the | ||||||
5 | agreed-upon addendum or new employment contract. | ||||||
6 | (d) Special meetings of the board may be called by the | ||||||
7 | chairman or by any
3 members of the board by giving notice | ||||||
8 | thereof in writing stating the
time, place , and purpose of the | ||||||
9 | meeting. Such notice may be served by
mail 48 hours before the | ||||||
10 | meeting or by personal service 24 hours before
the meeting.

11 | (e) At each regular and special meeting which is open to | ||||||
12 | the public,
members of the public and employees of the | ||||||
13 | community college district shall
be afforded time, subject to | ||||||
14 | reasonable constraints, to comment to or ask
questions of the | ||||||
15 | board.

18 | Sec. 3-10. Chairman, vice-chairman, and secretary of the | ||||||
19 | board. | ||||||
20 | (a) The chairman shall preside at all meetings and shall | ||||||
21 | perform
such duties as are imposed upon him or her by law or by | ||||||
22 | action of the board. The
vice-chairman shall perform the duties | ||||||
23 | of the chairman if there is a vacancy in the office of the | ||||||
24 | chairman or in case of the chairman's absence or inability to | ||||||
25 | act. If there is a vacancy in the office of the chairman and

1 | vice-chairman or the chairman and vice-chairman are absent from | ||||||
2 | any meeting or refuse to perform their
duties, a chairman pro | ||||||
3 | tempore shall be appointed by the board from among
their | ||||||
4 | number.

5 | (b) The secretary may be a member of the board and shall | ||||||
6 | perform the duties usually pertaining to his or her office.
If | ||||||
7 | not a member of the board, the secretary may receive | ||||||
8 | compensation that shall be fixed by the board prior to the | ||||||
9 | election of the secretary. If the secretary he is absent from | ||||||
10 | any meeting or refuses to perform his or her duties, a member
| ||||||
11 | of the board shall be appointed secretary pro tempore.

13 | Section 99. Effective date. This Act takes effect upon | ||||||
14 | becoming law.
