1 | | Act, together with such others as may be conferred upon it by |
2 | | law. The Council shall be an entity created under the |
3 | | legislative branch, and maintained and staffed under the |
4 | | executive branch by the Office of the Governor or an agency |
5 | | designated by the Governor that is under the jurisdiction of |
6 | | the Governor. |
7 | | Section 15. Advisory Board; members; nomination; term of |
8 | | office; vacancies. |
9 | | (a) An Advisory Board shall be created to facilitate the |
10 | | functions of the Council. The Advisory Board shall consist of 2 |
11 | | members of the House of Representatives, one each appointed by |
12 | | the Speaker of the House of Representatives and the Minority |
13 | | Leader of the House of Representatives; and 2 members of the |
14 | | Senate, one each appointed by the President of the Senate and |
15 | | the Minority Leader of the Senate. The initial term for members |
16 | | of the Advisory Council shall begin on January l, 2020, or the |
17 | | effective date of this Act, whichever occurs later, and expire |
18 | | on January 11, 2022. Thereafter, the term for members of the |
19 | | Advisory Council shall begin on the Thursday following the |
20 | | second Wednesday of January, and expire after 2 years. On or |
21 | | before September 1, 2019, the Advisory Board shall create an |
22 | | application that shall be used in nominating individuals to be |
23 | | members of the Council. The Advisory Board may, from time to |
24 | | time, modify the application with the consent of the Council. |
25 | | While the Council is in session, the Advisory Board may attend |

1 | | meetings of the Council, and may generally advise the Council. |
2 | | Nothing in this Act shall be construed to entitle Advisory |
3 | | Board members to vote on matters pending before the Council. |
4 | | (b) Each member of the House of Representatives shall |
5 | | nominate one qualified individual that resides in the |
6 | | Representative's legislative district to serve as a member of |
7 | | the Council after receiving and reviewing the individual's |
8 | | application and considering any recommendation made by a member |
9 | | of the Senate. The Representative shall make the nomination on |
10 | | or before October 31 of each calendar year. After making the |
11 | | nomination, the Representative shall, by first class mail, |
12 | | notify the nominated individual by November 15 of the same |
13 | | year. If the Representative is a member of the majority party, |
14 | | the Representative shall notify the Speaker of the House of |
15 | | Representatives of his or her nomination by November 15 of the |
16 | | same year. If the Representative is a member of the minority |
17 | | party, the Representative shall notify the Minority Leader of |
18 | | the House of Representatives of his or her nomination by |
19 | | November 15 of the same year. |
20 | | (c) Upon receiving a nomination, the Speaker of the House |
21 | | of Representatives or the Minority Leader of the House of |
22 | | Representatives, whichever the case may be, shall accept the |
23 | | nomination, except for good cause shown, and appoint the |
24 | | individual to be a member of the Council. Upon appointing the |
25 | | nominated individual, the Speaker of the House of |
26 | | Representatives or the Minority Leader of the House of |

1 | | Representatives, whichever the case may be, shall notify the |
2 | | individual of his or her appointment by first class mail. A |
3 | | nomination shall not be rejected except for good cause shown. |
4 | | If a nomination is rejected, the Speaker of the House of |
5 | | Representatives or the Minority Leader of the House of |
6 | | Representatives, whichever the case may be, shall state in |
7 | | writing the reason or reasons that the nomination was rejected, |
8 | | and transmit the written rejection to the nominated individual |
9 | | and the Senator that nominated the individual. In such a case, |
10 | | the Senator shall nominate another qualified individual within |
11 | | 5 days. |
12 | | (d) Each Council member's term shall be for one year. A |
13 | | member shall be allowed to serve more than one term, so long as |
14 | | the member continues to meet the requirements for being a |
15 | | member and is appointed for each term. |
16 | | (e) Any vacancies in the Council shall be filled in the |
17 | | same or substantially the same manner as the original |
18 | | appointment within 30 days after the vacancy. |
19 | | Section 20. Members; qualifications. Each member of the |
20 | | Council shall, during his or her term, be: |
21 | | (1) a resident of this State; |
22 | | (2) older than 16 years of age and younger than 22 |
23 | | years of age, except that if a member turns 23 years of age |
24 | | during his or her term, such member shall be allowed to |
25 | | complete the term; and |

1 | | (3) be a student enrolled at a high school, community |
2 | | college, or university in this State, except that if a |
3 | | member graduates from high school or college during his or |
4 | | her term, such member shall be allowed to complete the |
5 | | term. |
6 | | Section 25. Quorum; meetings; committees; leadership |
7 | | responsibilities. |
8 | | (a) A majority of those appointed to the Council shall |
9 | | constitute a quorum. |
10 | | (b) The Council shall convene each year on the Saturday |
11 | | following the second Wednesday of January in the State Capitol, |
12 | | unless the General Assembly is in session. An alternative |
13 | | meeting place shall be selected if one or both chambers cannot |
14 | | accommodate the meeting. At the initial meeting, the Council |
15 | | shall: |
16 | | (1) elect a President, Secretary, Treasurer, and |
17 | | Clerk; |
18 | | (2) adopt rules of procedure; |
19 | | (3) form committees to assist in furthering the goals |
20 | | of the Council, and appoint committee chairs and |
21 | | vice-chairs; and |
22 | | (4) announce the date and location of the next meeting |
23 | | of the Council. |
24 | | (c) The Council shall meet as often as is deemed necessary. |
25 | | For all other meetings and committee meetings, the Council may |

1 | | meet by electronic or telephonic means. Members of the Council |
2 | | shall be excused from school to participate in in-person |
3 | | meetings of the Council. |
4 | | (d) The President of the Council shall: |
5 | | (1) convene, direct, and adjourn meetings of the |
6 | | Council; |
7 | | (2) call for a vote on any matter pending before the |
8 | | Council; |
9 | | (3) transmit Council reports to the General Assembly; |
10 | | and |
11 | | (4) be the official liaison between the Council and |
12 | | General Assembly. |
13 | | (e) The Secretary of the Council shall: |
14 | | (1) serve as Acting President in the President's |
15 | | absence; |
16 | | (2) prepare and distribute agendas of Council meetings |
17 | | to Council members; and |
18 | | (3) keep and maintain the minutes of Council meetings. |
19 | | (f) The Treasurer of the Council shall: |
20 | | (1) report on the funds available in the Illinois |
21 | | Legislative Youth Advisory Council Fund; and |
22 | | (2) serve as the official liaison between the Council |
23 | | and the State Treasurer and the State Comptroller. |
24 | | (g) The Clerk of the Council shall: |
25 | | (1) record the final votes on any measure called for a |
26 | | vote by the President; and |

1 | | (2) transmit the final vote on all measures called for |
2 | | a vote by the President to the Secretary for inclusion in |
3 | | the minutes. |
4 | | (h) The President in transition shall be appointed by the |
5 | | President of the Senate within 14 days after the effective date |
6 | | of this Act. The President in transition shall meet the |
7 | | qualifications set forth in Section 20 of this Act, and shall |
8 | | serve until the second Wednesday of the
January following the |
9 | | effective date of this Act. The President in transition shall |
10 | | be responsible for initial outreach and marketing of the |
11 | | Council to the youth of Illinois. The President in transition |
12 | | may use the provisions of Section 35 of this Act to facilitate |
13 | | these duties. |
14 | | (i) The Council may create more leadership positions by |
15 | | rule. |
16 | | Section 30. Powers. The Council may: |
17 | | (1) request the drafting of legislative measures from |
18 | | the Legislative Reference Bureau; |
19 | | (2) provide testimony during any committee meeting of |
20 | | the General Assembly; |
21 | | (3) vote on any matter pending before the General

22 | | Assembly and inform the General Assembly of the Council's |
23 | | position on the matter; |
24 | | (4) draft reports and advisory opinions to the General |
25 | | Assembly; |

1 | | (5) perform any other activity that may reasonably |
2 | | inform the General Assembly of the Council's position on |
3 | | any issue of relevance; and |
4 | | (6) conduct periodic seminars for members of the |
5 | | Council concerning leadership, government, and the General |
6 | | Assembly. |
7 | | Section 35. Outreach. |
8 | | (a) On or before September 1 of each year, the President of |
9 | | the Council shall notify all high schools, colleges, and |
10 | | universities in this State that the time for applying to become |
11 | | a member of the Council is open, and shall expire on October |
12 | | 31. The notice shall include the requirements for membership, a |
13 | | copy of the application, and the name, district address, and |
14 | | district phone number of the Senators near the high school, |
15 | | college, or university. |
16 | | (b) Upon receiving notice that the application period is |
17 | | open, the high school, college, or university shall make |
18 | | reasonable attempts to notify interested students of the |
19 | | Council. |
20 | | (c) To raise awareness about the Council, the Council may: |
21 | | (1) conduct a public awareness campaign; |
22 | | (2) maintain a website; and |
23 | | (3) work with established youth groups to increase |
24 | | awareness. |

1 | | Section 40. Staff support. Staff and administrative |
2 | | support for the Council shall be provided by the Office of the |
3 | | Governor or an agency designated by the Governor that is under |
4 | | the jurisdiction of the Governor. Staff members shall be |
5 | | uncompensated and shall assist the Council in administrative |
6 | | duties. |
7 | | Section 45. Report to the General Assembly and Governor. |
8 | | The Council shall submit an annual report electronically to the |
9 | | General Assembly and the Governor detailing its activities and |
10 | | recommending any proposed legislation. |
11 | | Section 50. Illinois Legislative Youth Advisory Council |
12 | | Fund. The Illinois Legislative Youth Advisory Council Fund is |
13 | | created as a special fund in the State treasury. All moneys in |
14 | | the Fund shall be used to reimburse Council members for actual |
15 | | expenses incurred in traveling to Council meetings, including |
16 | | travel, food, and lodging, and printing the annual report in |
17 | | compliance with Section 45 of this Act. The moneys in the |
18 | | Illinois Legislative Youth Advisory Council Fund are subject to |
19 | | appropriation by the General Assembly. The Illinois |
20 | | Legislative Youth Advisory Council Fund may accept donations |
21 | | and gifts. |
22 | | Section 95. The State Finance Act is amended by adding |
23 | | Section 5.891 as follows: |
