AMENDMENT TO HOUSE BILL 423

2    AMENDMENT NO. ______. Amend House Bill 423, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The School Code is amended by changing Sections
62-3.11d, 14-9.01, 21B-15, 21B-20, 21B-30, 21B-35, 21B-50,
721B-55, and 24-1.5 and by adding Section 21B-107 as follows:
 
8    (105 ILCS 5/2-3.11d)
9    Sec. 2-3.11d. Teacher preparation institution listing.
10Data on tests required for teacher preparation and
11certification. Beginning with the effective date of this
12amendatory Act of the 94th General Assembly, to collect and
13maintain all of the following data for each institution of
14higher education engaged in teacher preparation in this State:
15        (1) The number of individuals taking the test of basic
16    skills under Section 21-1a of this Code.

1        (2) The number of individuals passing the test of basic
2    skills under Section 21-1a of this Code.
3        (3) The total number of subject-matter tests attempted
4    under Section 21-1a of this Code.
5        (4) The total number of subject-matter tests passed
6    under Section 21-1a of this Code.
7The data regarding subject-matter tests shall be reported in
8sum, rather than by separately listing each subject, in order
9to better protect the identity of the test-takers.
10    On or before August 1, 2007, the State Board of Education
11shall file with the General Assembly and the Governor and shall
12make available to the public a report listing the institutions
13of higher education engaged in teacher preparation in this
14State, along with the data listed in items (1) and (2) of this
15Section pertinent to each institution.
16    On or before October 1, 2012 and every 3 years thereafter,
17the State Board of Education shall file with the General
18Assembly and the Governor and shall make available to the
19public a report listing the institutions of higher education
20engaged in teacher preparation in this State, along with the
21data listed in items (1) through (4) of this Section pertinent
22to each institution.

25    Sec. 14-9.01. Qualifications of teachers, other

1professional personnel and necessary workers. No person shall
2be employed to teach any class or program authorized by this
3Article who does not hold a valid teacher's license as provided
4by law and unless he has had such special training as the State
5Board of Education may require. No special license or
6endorsement to a special license issued under Article 21B
7Section 21B-30 of this Code shall be valid for teaching
8students with visual disabilities unless the person to whom the
9license or endorsement is issued has attained satisfactory
10performance on an examination that is designed to assess
11competency in Braille reading and writing skills according to
12standards that the State Board of Education may adopt. On and
13after July 1, 2025, evidence Evidence of successfully
14completing the examination of Braille reading and writing
15skills must be submitted to the State Board of Education prior
16to an applicant's taking of the content area test required
17under Section 21B-30 of this Code. In addition to other
18requirements, a candidate for a teaching license in the area of
19the deaf and hard of hearing granted by the Illinois State
20Board of Education for teaching deaf and hard of hearing
21students in grades pre-school through grade 12 must demonstrate
22a minimum proficiency in sign language as determined by the
23Illinois State Board of Education. All other professional
24personnel employed in any class, service, or program authorized
25by this Article shall hold such licenses and shall have had
26such special training as the State Board of Education may

1require; provided that in a school district organized under
2Article 34, the school district may employ speech and language
3pathologists who are licensed under the Illinois
4Speech-Language Pathology and Audiology Practice Act but who do
5not hold a license issued under this Code if the district
6certifies that a chronic shortage of certified personnel
7exists. Nothing contained in this Act prohibits the school
8board from employing necessary workers to assist the teacher
9with the special educational facilities, except that all such
10necessary workers must have had such training as the State
11Board of Education may require.
12    No later than January 1, 1993, the State Board of Education
13shall develop, in consultation with the Advisory Council on the
14Education of Children with Disabilities and the Advisory
15Council on Bilingual Education, rules governing the
16qualifications for certification of teachers and school
17service personnel providing services to English learners
18receiving special education and related services.
19    The employment of any teacher in a special education
20program provided for in Sections 14-1.01 to 14-14.01,
21inclusive, shall be subject to the provisions of Sections 24-11
22to 24-16, inclusive. Any teacher employed in a special
23education program, prior to the effective date of this
24amendatory Act of 1987, in which 2 or more districts
25participate shall enter upon contractual continued service in
26each of the participating districts subject to the provisions

3    (105 ILCS 5/21B-15)
4    Sec. 21B-15. Qualifications of educators.
5    (a) No one may be licensed to teach or supervise or be
6otherwise employed in the public schools of this State who is
7not of good character and at least 19 years of age.
8    In determining good character under this Section, the State
9Superintendent of Education shall take into consideration the
10disciplinary actions of other states or national entities
11against certificates or licenses issued by those states and
12held by individuals from those states. In addition, any felony
13conviction of the applicant may be taken into consideration;
14however, no one may be licensed to teach or supervise in the
15public schools of this State who has been convicted of (i) an
16offense set forth in subsection (b) of Section 21B-80 of this
17Code until 7 years following the end of the sentence for the
18criminal offense or (ii) an offense set forth in subsection (c)
19of Section 21B-80 of this Code. Unless the conviction is for an
20offense set forth in Section 21B-80 of this Code, an applicant
21must be permitted to submit character references or other
22written material before such a conviction or other information
23regarding the applicant's character may be used by the State
24Superintendent of Education as a basis for denying the
25application.

1    (b) No person otherwise qualified shall be denied the right
2to be licensed or to receive training for the purpose of
3becoming an educator because of a physical disability,
4including, but not limited to, visual and hearing disabilities;
5nor shall any school district refuse to employ a teacher on
6such grounds, provided that the person is able to carry out the
7duties of the position for which he or she applies.
8    (c) No person may be granted or continue to hold an
9educator license who has knowingly altered or misrepresented
10his or her qualifications, in this State or any other state, in
11order to acquire or renew the license. Any other license issued
12under this Article held by the person may be suspended or
13revoked by the State Educator Preparation and Licensure Board,
14depending upon the severity of the alteration or
15misrepresentation.
16    (d) No one may teach or supervise in the public schools nor
17receive for teaching or supervising any part of any public
18school fund who does not hold an educator license granted by
19the State Superintendent of Education as provided in this
20Article. However, the provisions of this Article do not apply
21to a member of the armed forces who is employed as a teacher of
22subjects in the Reserve Officers' Training Corps of any school,
23nor to an individual teaching a dual credit course as provided
24for in the Dual Credit Quality Act.
25    (e) Notwithstanding any other provision of this Code, the
26school board of a school district may grant to a teacher of the

1district a leave of absence with full pay for a period of not
2more than one year to permit the teacher to teach in a foreign
3state under the provisions of the Exchange Teacher Program
4established under Public Law 584, 79th Congress, and Public Law
5402, 80th Congress, as amended. The school board granting the
6leave of absence may employ, with or without pay, a national of
7the foreign state wherein the teacher on the leave of absence
8is to teach if the national is qualified to teach in that
9foreign state and if that national is to teach in a grade level
10similar to the one that was taught in the foreign state. The
11State Board of Education, in consultation with the State
12Educator Preparation and Licensure Board, may adopt rules as
13may be necessary to implement this subsection (e).
14    (f) No person shall be denied a license issued under this
15Article solely based on his or her citizenship status or
16immigration status. The General Assembly finds and declares
17that this subsection (f) is a State law within the meaning of
18subsection (d) of Section 1621 of Title 8 of the United States
19Code. Nothing in this subsection shall affect the requirements
20to obtain a license that are not directly related to
21citizenship status or immigration status. Nothing in this
22subsection shall be construed to grant eligibility for
23obtaining any public benefit other than a license issued under
24this Article.
25    (g) Beginning on the effective date of this amendatory Act
26of the 101st General Assembly and through June 30, 2025, a

1candidate enrolled in a teacher preparation program must
2receive a letter grade of at least a "C", or its equivalent, in
3his or her student teaching program to obtain an educator
4license under this Article.

7    (105 ILCS 5/21B-20)
8    Sec. 21B-20. Types of licenses. The State Board of
9Education shall implement a system of educator licensure,
10whereby individuals employed in school districts who are
11required to be licensed must have one of the following
12licenses: (i) a professional educator license; (ii) an educator
13license with stipulations; (iii) a substitute teaching
14license; or (iv) until June 30, 2023, a short-term substitute
15teaching license. References in law regarding individuals
16certified or certificated or required to be certified or
17certificated under Article 21 of this Code shall also include
18individuals licensed or required to be licensed under this
19Article. The first year of all licenses ends on June 30
20following one full year of the license being issued.
21    The State Board of Education, in consultation with the
22State Educator Preparation and Licensure Board, may adopt such
23rules as may be necessary to govern the requirements for
24licenses and endorsements under this Section.
25        (1) Professional Educator License. Persons who (i)

1    have successfully completed an approved educator
2    preparation program and are recommended for licensure by
3    the Illinois institution offering the educator preparation
4    program, (ii) have successfully completed the required
5    testing under Section 21B-30 of this Code, (iii) have
6    successfully completed coursework on the psychology of,
7    the identification of, and the methods of instruction for
8    the exceptional child, including without limitation
9    children with learning disabilities, (iv) have
10    successfully completed coursework in methods of reading
11    and reading in the content area, and (v) have met all other
12    criteria established by rule of the State Board of
13    Education shall be issued a Professional Educator License.
14    All Professional Educator Licenses are valid until June 30
15    immediately following 5 years of the license being issued.
16    The Professional Educator License shall be endorsed with
17    specific areas and grade levels in which the individual is
18    eligible to practice.
19        Individuals can receive subsequent endorsements on the
20    Professional Educator License. Subsequent endorsements
21    shall require a minimum of 24 semester hours of coursework
22    in the endorsement area and, on and after July 1, 2025,
23    passage of the applicable content area test, unless
24    otherwise specified by rule.
25        (2) Educator License with Stipulations. An Educator
26    License with Stipulations shall be issued an endorsement

1    that limits the license holder to one particular position
2    or does not require completion of an approved educator
3    program or both.
4        An individual with an Educator License with
5    Stipulations must not be employed by a school district or
6    any other entity to replace any presently employed teacher
7    who otherwise would not be replaced for any reason.
8        An Educator License with Stipulations may be issued
9    with the following endorsements:
10            (A) (Blank). A A provisional educator endorsement
11        for a service member or a spouse of a service member is
12        valid until June 30 immediately following 3 years of
13        the license being issued, provided that any remaining
14        testing and coursework deficiencies are met under this
15        Section. In this Section, "spouse of a service member"
16        means any person who, at the time of application under
17        this Section, is the spouse of an active duty member of
18        the United States Armed Forces or any reserve component
19        of the United States Armed Forces or the National Guard
20        of any state, commonwealth, or territory of the United
21        States or the District of Columbia.
22            Except as otherwise provided under this
23        subparagraph, a
24            (B) Alternative provisional educator. An
25        alternative provisional educator endorsement on an
26        Educator License with Stipulations may be issued to an

1        applicant who, at the time of applying for the
2        endorsement, has done all of the following:
3                (i) Graduated from a regionally accredited
4            college or university with a minimum of a
5            bachelor's degree.
6                (ii) Successfully completed the first phase of
7            the Alternative Educator Licensure Program for
8            Teachers, as described in Section 21B-50 of this
9            Code.
10                (iii) On and after July 1, 2025, passed Passed
11            a test of basic skills and content area test, as
12            required under Section 21B-30 of this Code.
13        The alternative provisional educator endorsement is
14    valid for 2 years of teaching and may be renewed for a
15    third year by an individual meeting the requirements set
16    forth in Section 21B-50 of this Code.
17            (C) Alternative provisional superintendent. An
18        alternative provisional superintendent endorsement on
19        an Educator License with Stipulations entitles the
20        holder to serve only as a superintendent or assistant
21        superintendent in a school district's central office.
22        This endorsement may only be issued to an applicant
23        who, at the time of applying for the endorsement, has
24        done all of the following:
25                (i) Graduated from a regionally accredited
26            college or university with a minimum of a master's

1            degree in a management field other than education.
2                (ii) Been employed for a period of at least 5
3            years in a management level position in a field
4            other than education.
5                (iii) Successfully completed the first phase
6            of an alternative route to superintendent
7            endorsement program, as provided in Section 21B-55
8            of this Code.
9                (iv) On and after July 1, 2025, passed Passed a
10            test of basic skills and content area tests
11            required under Section 21B-30 of this Code.
12            The endorsement is valid for 2 fiscal years in
13        order to complete one full year of serving as a
14        superintendent or assistant superintendent.
15            (D) (Blank).
16            (E) Career and technical educator. A career and
17        technical educator endorsement on an Educator License
18        with Stipulations may be issued to an applicant who has
19        a minimum of 60 semester hours of coursework from a
20        regionally accredited institution of higher education
21        or an accredited trade and technical institution and
22        has a minimum of 2,000 hours of experience outside of
23        education in each area to be taught.
24            The career and technical educator endorsement on
25        an Educator License with Stipulations is valid until
26        June 30 immediately following 5 years of the

1        endorsement being issued and may be renewed. On and
2        after July 1, 2025, for For individuals who were issued
3        the career and technical educator endorsement on an
4        Educator License with Stipulations on or after January
5        1, 2015, the license may be renewed if the individual
6        passes a test of basic skills or test of work
7        proficiency, as required under Section 21B-30 of this
8        Code.
9            An individual who holds a valid career and
10        technical educator endorsement on an Educator License
11        with Stipulations but does not hold a bachelor's degree
12        may substitute teach in career and technical education
13        classrooms.
14            (F) Part-time provisional career and technical
15        educator or provisional career and technical educator.
16        A part-time provisional career and technical educator
17        endorsement or a provisional career and technical
18        educator endorsement on an Educator License with
19        Stipulations may be issued to an applicant who has a
20        minimum of 8,000 hours of work experience in the skill
21        for which the applicant is seeking the endorsement. It
22        is the responsibility of each employing school board
23        and regional office of education to provide
24        verification, in writing, to the State Superintendent
25        of Education at the time the application is submitted
26        that no qualified teacher holding a Professional

1        Educator License or an Educator License with
2        Stipulations with a career and technical educator
3        endorsement is available and that actual circumstances
4        require such issuance.
5            The provisional career and technical educator
6        endorsement on an Educator License with Stipulations
7        is valid until June 30 immediately following 5 years of
8        the endorsement being issued and may be renewed for 5
9        years. On and after July 1, 2025, for For individuals
10        who were issued the provisional career and technical
11        educator endorsement on an Educator License with
12        Stipulations on or after January 1, 2015, the license
13        may be renewed if the individual passes a test of basic
14        skills or test of work proficiency, as required under
15        Section 21B-30 of this Code.
16            A part-time provisional career and technical
17        educator endorsement on an Educator License with
18        Stipulations may be issued for teaching no more than 2
19        courses of study for grades 6 through 12. The part-time
20        provisional career and technical educator endorsement
21        on an Educator License with Stipulations is valid until
22        June 30 immediately following 5 years of the
23        endorsement being issued and may be renewed for 5 years
24        if the individual makes application for renewal.
25            An individual who holds a provisional or part-time
26        provisional career and technical educator endorsement

1        on an Educator License with Stipulations but does not
2        hold a bachelor's degree may substitute teach in career
3        and technical education classrooms.
4            (G) Transitional bilingual educator. A
5        transitional bilingual educator endorsement on an
6        Educator License with Stipulations may be issued for
7        the purpose of providing instruction in accordance
8        with Article 14C of this Code to an applicant who
9        provides satisfactory evidence that he or she meets all
10        of the following requirements:
11                (i) Possesses adequate speaking, reading, and
12            writing ability in the language other than English
13            in which transitional bilingual education is
14            offered.
15                (ii) Has the ability to successfully
16            communicate in English.
17                (iii) Either possessed, within 5 years
18            previous to his or her applying for a transitional
19            bilingual educator endorsement, a valid and
20            comparable teaching certificate or comparable
21            authorization issued by a foreign country or holds
22            a degree from an institution of higher learning in
23            a foreign country that the State Educator
24            Preparation and Licensure Board determines to be
25            the equivalent of a bachelor's degree from a
26            regionally accredited institution of higher

1            learning in the United States.
2            A transitional bilingual educator endorsement
3        shall be valid for prekindergarten through grade 12, is
4        valid until June 30 immediately following 5 years of
5        the endorsement being issued, and shall not be renewed.
6            Persons holding a transitional bilingual educator
7        endorsement shall not be employed to replace any
8        presently employed teacher who otherwise would not be
9        replaced for any reason.
10            (H) Language endorsement. In an effort to
11        alleviate the shortage of teachers speaking a language
12        other than English in the public schools, an individual
13        who holds an Educator License with Stipulations may
14        also apply for a language endorsement, provided that
15        the applicant provides satisfactory evidence that he
16        or she meets all of the following requirements:
17                (i) Holds a transitional bilingual
18            endorsement.
19                (ii) On and after July 1, 2025, has Has
20            demonstrated proficiency in the language for which
21            the endorsement is to be issued by passing the
22            applicable language content test required by the
23            State Board of Education.
24                (iii) Holds a bachelor's degree or higher from
25            a regionally accredited institution of higher
26            education or, for individuals educated in a

1            country other than the United States, holds a
2            degree from an institution of higher learning in a
3            foreign country that the State Educator
4            Preparation and Licensure Board determines to be
5            the equivalent of a bachelor's degree from a
6            regionally accredited institution of higher
7            learning in the United States.
8                (iv) On and after July 1, 2025, has Has passed
9            a test of basic skills, as required under Section
10            21B-30 of this Code.
11            A language endorsement on an Educator License with
12        Stipulations is valid for prekindergarten through
13        grade 12 for the same validity period as the
14        individual's transitional bilingual educator
15        endorsement on the Educator License with Stipulations
16        and shall not be renewed.
17            (I) Visiting international educator. A visiting
18        international educator endorsement on an Educator
19        License with Stipulations may be issued to an
20        individual who is being recruited by a particular
21        school district that conducts formal recruitment
22        programs outside of the United States to secure the
23        services of qualified teachers and who meets all of the
24        following requirements:
25                (i) Holds the equivalent of a minimum of a
26            bachelor's degree issued in the United States.

1                (ii) Has been prepared as a teacher at the
2            grade level for which he or she will be employed.
3                (iii) Has adequate content knowledge in the
4            subject to be taught.
5                (iv) Has an adequate command of the English
6            language.
7            A holder of a visiting international educator
8        endorsement on an Educator License with Stipulations
9        shall be permitted to teach in bilingual education
10        programs in the language that was the medium of
11        instruction in his or her teacher preparation program,
12        provided that he or she passes the English Language
13        Proficiency Examination or another test of writing
14        skills in English identified by the State Board of
15        Education, in consultation with the State Educator
16        Preparation and Licensure Board.
17            A visiting international educator endorsement on
18        an Educator License with Stipulations is valid for 3
19        years and shall not be renewed.
20            (J) Paraprofessional educator. A paraprofessional
21        educator endorsement on an Educator License with
22        Stipulations may be issued to an applicant who holds a
23        high school diploma or its recognized equivalent and
24        either holds an associate's degree or a minimum of 60
25        semester hours of credit from a regionally accredited
26        institution of higher education or, on and after July

1        1, 2025, has passed a test of basic skills required
2        under Section 21B-30 of this Code. The
3        paraprofessional educator endorsement is valid until
4        June 30 immediately following 5 years of the
5        endorsement being issued and may be renewed through
6        application and payment of the appropriate fee, as
7        required under Section 21B-40 of this Code. An
8        individual who holds only a paraprofessional educator
9        endorsement is not subject to additional requirements
10        in order to renew the endorsement.
11            (K) Chief school business official. A chief school
12        business official endorsement on an Educator License
13        with Stipulations may be issued to an applicant who
14        qualifies by having a master's degree or higher, 2
15        years of full-time administrative experience in school
16        business management or 2 years of university-approved
17        practical experience, and a minimum of 24 semester
18        hours of graduate credit in a program approved by the
19        State Board of Education for the preparation of school
20        business administrators and by passage of the
21        applicable State tests, including, on and after July 1,
22        2025, a test of basic skills and applicable content
23        area test.
24            The chief school business official endorsement may
25        also be affixed to the Educator License with
26        Stipulations of any holder who qualifies by having a

1        master's degree in business administration, finance,
2        accounting, or public administration and who completes
3        an additional 6 semester hours of internship in school
4        business management from a regionally accredited
5        institution of higher education and passes the
6        applicable State tests, including, on and after July 1,
7        2025, a test of basic skills and applicable content
8        area test. This endorsement shall be required for any
9        individual employed as a chief school business
10        official.
11            The chief school business official endorsement on
12        an Educator License with Stipulations is valid until
13        June 30 immediately following 5 years of the
14        endorsement being issued and may be renewed if the
15        license holder completes renewal requirements as
16        required for individuals who hold a Professional
17        Educator License endorsed for chief school business
18        official under Section 21B-45 of this Code and such
19        rules as may be adopted by the State Board of
20        Education.
21            The State Board of Education shall adopt any rules
22        necessary to implement Public Act 100-288.
23            (L) Provisional in-state educator. A provisional
24        in-state educator endorsement on an Educator License
25        with Stipulations may be issued to a candidate who has
26        completed an Illinois-approved educator preparation

1        program at an Illinois institution of higher education
2        and who has not successfully completed an
3        evidence-based assessment of teacher effectiveness but
4        who meets all of the following requirements:
5                (i) Holds at least a bachelor's degree.
6                (ii) Has completed an approved educator
7            preparation program at an Illinois institution.
8                (iii) On an after July 1, 2025, has Has passed
9            a test of basic skills and applicable content area
10            test, as required by Section 21B-30 of this Code.
11                (iv) Has attempted an evidence-based
12            assessment of teacher effectiveness and received a
13            minimum score on that assessment, as established
14            by the State Board of Education in consultation
15            with the State Educator Preparation and Licensure
16            Board.
17            A provisional in-state educator endorsement on an
18        Educator License with Stipulations is valid for one
19        full fiscal year after the date of issuance and may not
20        be renewed.
21            (M) School support personnel intern. A school
22        support personnel intern endorsement on an Educator
23        License with Stipulations may be issued as specified by
24        rule.
25            (N) Special education area. A special education
26        area endorsement on an Educator License with

1        Stipulations may be issued as defined and specified by
2        rule.
3        (3) Substitute Teaching License. A Substitute Teaching
4    License may be issued to qualified applicants for
5    substitute teaching in all grades of the public schools,
6    prekindergarten through grade 12. Substitute Teaching
7    Licenses are not eligible for endorsements. Applicants for
8    a Substitute Teaching License must hold a bachelor's degree
9    or higher from a regionally accredited institution of
10    higher education.
11        Substitute Teaching Licenses are valid for 5 years.
12        Substitute Teaching Licenses are valid for substitute
13    teaching in every county of this State. If an individual
14    has had his or her Professional Educator License or
15    Educator License with Stipulations suspended or revoked,
16    then that individual is not eligible to obtain a Substitute
17    Teaching License.
18        A substitute teacher may only teach in the place of a
19    licensed teacher who is under contract with the employing
20    board. If, however, there is no licensed teacher under
21    contract because of an emergency situation, then a district
22    may employ a substitute teacher for no longer than 30
23    calendar days per each vacant position in the district if
24    the district notifies the appropriate regional office of
25    education within 5 business days after the employment of
26    the substitute teacher in the emergency situation. An

1    emergency situation is one in which an unforeseen vacancy
2    has occurred and (i) a teacher is unable to fulfill his or
3    her contractual duties or (ii) teacher capacity needs of
4    the district exceed previous indications, and the district
5    is actively engaged in advertising to hire a fully licensed
6    teacher for the vacant position.
7        There is no limit on the number of days that a
8    substitute teacher may teach in a single school district,
9    provided that no substitute teacher may teach for longer
10    than 90 school days for any one licensed teacher under
11    contract in the same school year. A substitute teacher who
12    holds a Professional Educator License or Educator License
13    with Stipulations shall not teach for more than 120 school
14    days for any one licensed teacher under contract in the
15    same school year. The limitations in this paragraph (3) on
16    the number of days a substitute teacher may be employed do
17    not apply to any school district operating under Article 34
18    of this Code.
19        A school district may not require an individual who
20    holds a valid Professional Educator License or Educator
21    License with Stipulations to seek or hold a Substitute
22    Teaching License to teach as a substitute teacher.
23        (4) Short-Term Substitute Teaching License. Beginning
24    on July 1, 2018 and until June 30, 2023, the State Board of
25    Education may issue a Short-Term Substitute Teaching
26    License. A Short-Term Substitute Teaching License may be

1    issued to a qualified applicant for substitute teaching in
2    all grades of the public schools, prekindergarten through
3    grade 12. Short-Term Substitute Teaching Licenses are not
4    eligible for endorsements. Applicants for a Short-Term
5    Substitute Teaching License must hold an associate's
6    degree or have completed at least 60 credit hours from a
7    regionally accredited institution of higher education.
8        Short-Term Substitute Teaching Licenses are valid for
9    substitute teaching in every county of this State. If an
10    individual has had his or her Professional Educator License
11    or Educator License with Stipulations suspended or
12    revoked, then that individual is not eligible to obtain a
13    Short-Term Substitute Teaching License.
14        The provisions of Sections 10-21.9 and 34-18.5 of this
15    Code apply to short-term substitute teachers.
16        An individual holding a Short-Term Substitute Teaching
17    License may teach no more than 5 consecutive days per
18    licensed teacher who is under contract. For teacher
19    absences lasting 6 or more days per licensed teacher who is
20    under contract, a school district may not hire an
21    individual holding a Short-Term Substitute Teaching
22    License. An individual holding a Short-Term Substitute
23    Teaching License must complete the training program under
24    Section 10-20.67 or 34-18.60 of this Code to be eligible to
25    teach at a public school. This paragraph (4) is inoperative
26    on and after July 1, 2023.

7    Sec. 21B-30. Educator testing.
8    (a) This Section applies beginning on July 1, 2012.
9    (b) The State Board of Education, in consultation with the
10State Educator Preparation and Licensure Board, shall design
11and implement a system of examinations, which shall be required
12prior to the issuance of educator licenses. These examinations
13and indicators must be based on national and State professional
14teaching standards, as determined by the State Board of
15Education, in consultation with the State Educator Preparation
16and Licensure Board. The State Board of Education may adopt
17such rules as may be necessary to implement and administer this
18Section.
19    (c) On and after July 1, 2025, except Except as otherwise
20provided in this Article, applicants seeking a Professional
21Educator License or an Educator License with Stipulations shall
22be required to pass a test of basic skills before the license
23is issued, unless the endorsement the individual is seeking
24does not require passage of the test. All applicants completing

1personnel preparation programs shall be required to pass the
2State Board of Education's recognized test of basic skills
3prior to starting their student teaching or starting the final
4semester of their internship. An institution of higher
5learning, as defined in the Higher Education Student Assistance
6Act, may not require an applicant to complete the State Board's
7recognized test of basic skills prior to the semester before
8student teaching or prior to the semester before starting the
9final semester of an internship. An individual who passes a
10test of basic skills does not need to do so again for
11subsequent endorsements or other educator licenses.
12    (d) Beginning on the effective date of this amendatory Act
13of the 101st General Assembly and through June 30, 2025, all
14applicants seeking a State license may, at the option of the
15applicant, complete a test of content area knowledge for each
16area of endorsement for which there is an applicable test. On
17and after July 1, 2025, all All applicants seeking a State
18license shall be required to pass a test of content area
19knowledge for each area of endorsement for which there is an
20applicable test. Except as otherwise provided under this
21subsection, there There shall be no exception to this
22requirement. On and after July 1, 2025, no No candidate shall
23be allowed to student teach or serve as the teacher of record
24until he or she has passed the applicable content area test.

1on September 1, 2015, all candidates completing teacher
2preparation programs in this State and all candidates subject
3to Section 21B-35 of this Code are required to pass a teacher
4performance assessment approved by the State Board of
5Education, in consultation with the State Educator Preparation
6and Licensure Board.
7    (g) Tests of basic skills and content area knowledge and
8the teacher performance assessment shall be the tests that from
9time to time are designated by the State Board of Education, in
10consultation with the State Educator Preparation and Licensure
11Board, and may be tests prepared by an educational testing
12organization or tests designed by the State Board of Education,
13in consultation with the State Educator Preparation and
14Licensure Board. The areas to be covered by a test of basic
15skills shall include reading, language arts, and mathematics.
16The test of content area knowledge shall assess content
17knowledge in a specific subject field. The tests must be
18designed to be racially neutral to ensure that no person taking
19the tests is discriminated against on the basis of race, color,
20national origin, or other factors unrelated to the person's
21ability to perform as a licensed employee. The score required
22to pass the tests shall be fixed by the State Board of
23Education, in consultation with the State Educator Preparation
24and Licensure Board. The tests shall be administered not fewer
25than 3 times a year at such time and place as may be designated
26by the State Board of Education, in consultation with the State

2    On and after July 1, 2025, the The State Board shall
3implement a test or tests to assess the speaking, reading,
4writing, and grammar skills of applicants for an endorsement or
5a license issued under subdivision (G) of paragraph (2) of
6Section 21B-20 of this Code in the English language and in the
7language of the transitional bilingual education program
8requested by the applicant.
9    (h) Except as provided in Section 34-6 of this Code, the
10provisions of this Section shall apply equally in any school
11district subject to Article 34 of this Code.
12    (i) The rules developed to implement and enforce the
13testing requirements under this Section shall include without
14limitation provisions governing test selection, test
15validation and determination of a passing score,
16administration of the tests, frequency of administration,
17applicant fees, frequency of applicants taking the tests, the
18years for which a score is valid, and appropriate special
19accommodations. The State Board of Education shall develop such
20rules as may be needed to ensure uniformity from year to year
21in the level of difficulty for each form of an assessment.

5institution of higher education applying for a Professional
6Educator License endorsed in a teaching field or school support
7personnel area must meet the following requirements:
8        (1) the applicant must:
9            (A) hold a comparable and valid educator license or
10        certificate, as defined by rule, with similar grade
11        level and content area credentials from another state,
12        with the State Board of Education having the authority
13        to determine what constitutes similar grade level and
14        content area credentials from another state; and
15            (B) have a bachelor's degree from a regionally
16        accredited institution of higher education; or
17        (2) the applicant must:
18            (A) have completed a state-approved program for
19        the licensure area sought, including coursework
20        concerning methods of instruction of the exceptional
21        child, methods of reading and reading in the content
22        area, and instructional strategies for English
23        learners;
24            (B) have a bachelor's degree from a regionally
25        accredited institution of higher education;
26            (C) have successfully met all Illinois examination

2                (i) on and after July 1, 2025, an applicant who
3            has successfully completed a test of basic skills,
4            as defined by rules, at the time of initial

8            who has successfully completed a test of content,
9            as defined by rules, at the time of initial
10            licensure in another state is not required to
11            complete a test of content; and
12                (iii) an applicant for a teaching endorsement
13            who has successfully completed an evidence-based
14            assessment of teacher effectiveness, as defined by
15            rules, at the time of initial licensure in another
16            state is not required to complete an
17            evidence-based assessment of teacher
18            effectiveness; and
19            (D) for an applicant for a teaching endorsement,
20        have completed student teaching or an equivalent
21        experience or, for an applicant for a school service
22        personnel endorsement, have completed an internship or
23        an equivalent experience.
24    (b) In order to receive a Professional Educator License
25endorsed in a teaching field or school support personnel area,
26applicants trained in another country must meet all of the

2        (1) Have completed a comparable education program in
3    another country.
4        (2) Have had transcripts evaluated by an evaluation
5    service approved by the State Superintendent of Education.

8        (4) Have completed coursework aligned to standards
9    concerning methods of instruction of the exceptional
10    child, methods of reading and reading in the content area,
11    and instructional strategies for English learners.
12        (5) (Blank).

14        (7) Have successfully met all State licensure
15    examination requirements. On and after July 1, 2025,
16    applicants Applicants who have successfully completed a

7institution of higher education and applicants trained in
8another country applying for a Professional Educator License
9endorsed for principal or superintendent must hold a master's
10degree from a regionally accredited institution of higher
11education and must hold a comparable and valid educator license
12or certificate with similar grade level and subject matter
13credentials, with the State Board of Education having the
14authority to determine what constitutes similar grade level and
15subject matter credentials from another state, or must meet all
16of the following requirements:
17        (1) Have completed an educator preparation program
18    approved by another state or comparable educator program in
19    another country leading to the receipt of a license or
20    certificate for the Illinois endorsement sought.
21        (2) Have successfully met all State licensure
22    examination requirements, as required by Section 21B-30 of
23    this Code. On and after July 1, 2025, applicants Applicants
24    who have successfully completed a test of basic skills, as
25    defined by rules, at the time of initial licensure in
26    another state or country shall not be required to complete

19must hold a master's degree from a regionally accredited
20institution of higher education and must hold a comparable and
21valid educator license or certificate with similar grade level
22and subject matter credentials, with the State Board of
23Education having the authority to determine what constitutes
24similar grade level and subject matter credentials from another
25state, or must meet all of the following requirements:
26        (1) Have completed a master's degree.

7    rules, at the time of initial licensure in another state or
8    country shall not be required to complete a test of
9    content.
10        (4) Have completed coursework aligned to standards
11    concerning methods of instruction of the exceptional
12    child, methods of reading and reading in the content area,
13    and instructional strategies for English learners.
14    (b-10) All applicants who have not been entitled by an
15Illinois-approved educator preparation program at an Illinois
16institution of higher education applying for a Professional
17Educator License endorsed for chief school business official
18must hold a master's degree from a regionally accredited
19institution of higher education and must hold a comparable and
20valid educator license or certificate with similar grade level
21and subject matter credentials, with the State Board of
22Education having the authority to determine what constitutes
23similar grade level and subject matter credentials from another
24state, or must meet all of the following requirements:
25        (1) Have completed a master's degree in school business
26    management, finance, or accounting.

2    school business management or have 2 years of experience as
3    a school business administrator.
4        (3) Have successfully met all State examination

8    rules, at the time of initial licensure in another state or
9    country shall not be required to complete a test of

14    and instructional strategies for English learners.
15    (c) The State Board of Education, in consultation with the
16State Educator Preparation and Licensure Board, may adopt such
17rules as may be necessary to implement this Section.

21    Sec. 21B-50. Alternative educator licensure program.
22    (a) There is established an alternative educator licensure
23program, to be known as the Alternative Educator Licensure
24Program for Teachers.
25    (b) The Alternative Educator Licensure Program for

1Teachers may be offered by a recognized institution approved to
2offer educator preparation programs by the State Board of
3Education, in consultation with the State Educator Preparation
4and Licensure Board.
5    The program shall be comprised of 4 phases:
6        (1) A course of study that at a minimum includes
7    instructional planning; instructional strategies,
8    including special education, reading, and English language
9    learning; classroom management; and the assessment of
10    students and use of data to drive instruction.
11        (2) A year of residency, which is a candidate's
12    assignment to a full-time teaching position or as a
13    co-teacher for one full school year. An individual must
14    hold an Educator License with Stipulations with an
15    alternative provisional educator endorsement in order to
16    enter the residency and must complete additional program
17    requirements that address required State and national
18    standards, pass the assessment of professional teaching
19    before entering the second residency year, as required
20    under phase (3) of this subsection (b), and be recommended
21    by the principal or qualified equivalent of a principal, as
22    required under subsection (d) of this Section, and the
23    program coordinator to continue with the second year of the
24    residency.
25        (3) A second year of residency, which shall include the
26    candidate's assignment to a full-time teaching position

1    for one school year. The candidate must be assigned an
2    experienced teacher to act as a mentor and coach the
3    candidate through the second year of residency.
4        (4) A comprehensive assessment of the candidate's
5    teaching effectiveness, as evaluated by the principal or
6    qualified equivalent of a principal, as required under
7    subsection (d) of this Section, and the program
8    coordinator, at the end of the second year of residency. If
9    there is disagreement between the 2 evaluators about the
10    candidate's teaching effectiveness, the candidate may
11    complete one additional year of residency teaching under a
12    professional development plan developed by the principal
13    or qualified equivalent and the preparation program. At the
14    completion of the third year, a candidate must have
15    positive evaluations and a recommendation for full
16    licensure from both the principal or qualified equivalent
17    and the program coordinator or no Professional Educator
18    License shall be issued.
19    Successful completion of the program shall be deemed to
20satisfy any other practice or student teaching and content
21matter requirements established by law.
22    (c) An alternative provisional educator endorsement on an
23Educator License with Stipulations is valid for 2 years of
24teaching in the public schools, including without limitation a
25preschool educational program under Section 2-3.71 of this Code
26or charter school, or in a State-recognized nonpublic school in

1which the chief administrator is required to have the licensure
2necessary to be a principal in a public school in this State
3and in which a majority of the teachers are required to have
4the licensure necessary to be instructors in a public school in
5this State, but may be renewed for a third year if needed to
6complete the Alternative Educator Licensure Program for
7Teachers. The endorsement shall be issued only once to an
8individual who meets all of the following requirements:
9        (1) Has graduated from a regionally accredited college
10    or university with a bachelor's degree or higher.
11        (2) Has a cumulative grade point average of 3.0 or
12    greater on a 4.0 scale or its equivalent on another scale.
13        (3) Has completed a major in the content area if
14    seeking a middle or secondary level endorsement or, if
15    seeking an early childhood, elementary, or special
16    education endorsement, has completed a major in the content
17    area of reading, English/language arts, mathematics, or
18    one of the sciences. If the individual does not have a
19    major in a content area for any level of teaching, he or
20    she must submit transcripts to the State Board of Education
21    to be reviewed for equivalency.
22        (4) Has successfully completed phase (1) of subsection
23    (b) of this Section.
24        (5) On and after July 1, 2025, has Has passed a test of
25    basic skills and content area test required for the
26    specific endorsement for admission into the program, as

1    required under Section 21B-30 of this Code.
2    A candidate possessing the alternative provisional
3educator endorsement may receive a salary, benefits, and any
4other terms of employment offered to teachers in the school who
5are members of an exclusive bargaining representative, if any,
6but a school is not required to provide these benefits during
7the years of residency if the candidate is serving only as a
8co-teacher. If the candidate is serving as the teacher of
9record, the candidate must receive a salary, benefits, and any
10other terms of employment. Residency experiences must not be
11counted towards tenure.
12    (d) The recognized institution offering the Alternative
13Educator Licensure Program for Teachers must partner with a
14school district, including without limitation a preschool
15educational program under Section 2-3.71 of this Code or
16charter school, or a State-recognized, nonpublic school in this
17State in which the chief administrator is required to have the
18licensure necessary to be a principal in a public school in
19this State and in which a majority of the teachers are required
20to have the licensure necessary to be instructors in a public
21school in this State. A recognized institution that partners
22with a public school district administering a preschool
23educational program under Section 2-3.71 of this Code must
24require a principal to recommend or evaluate candidates in the
25program. A recognized institution that partners with an
26eligible entity administering a preschool educational program

1under Section 2-3.71 of this Code and that is not a public
2school district must require a principal or qualified
3equivalent of a principal to recommend or evaluate candidates
4in the program. The program presented for approval by the State
5Board of Education must demonstrate the supports that are to be
6provided to assist the provisional teacher during the 2-year
7residency period. These supports must provide additional
8contact hours with mentors during the first year of residency.
9    (e) Upon completion of the 4 phases outlined in subsection
10(b) of this Section and all assessments required under Section
1121B-30 of this Code, an individual shall receive a Professional
12Educator License.
13    (f) The State Board of Education, in consultation with the
14State Educator Preparation and Licensure Board, may adopt such
15rules as may be necessary to establish and implement the
16Alternative Educator Licensure Program for Teachers.

19    (105 ILCS 5/21B-55)
20    Sec. 21B-55. Alternative route to superintendent
21endorsement.
22    (a) The State Board of Education, in consultation with the
23State Educator Preparation and Licensure Board, may approve
24programs designed to provide an alternative route to
25superintendent endorsement on a Professional Educator License.

1    (b) Entities offering an alternative route to
2superintendent endorsement program must have the program
3approved by the State Board of Education, in consultation with
4the State Educator Preparation and Licensure Board.
5    (c) All programs approved under this Section shall be
6comprised of the following 3 phases:
7        (1) A course of study offered on an intensive basis in
8    education management, governance, organization, and
9    instructional and district planning.
10        (2) The person's assignment to a full-time position for
11    one school year as a superintendent.
12        (3) A comprehensive assessment of the person's
13    performance by school officials and a recommendation to the
14    State Board of Education that the person be issued a
15    superintendent endorsement on a Professional Educator
16    License.
17    (d) In order to serve as a superintendent under phase (2)
18of subsection (c) of this Section, an individual must be issued
19an alternative provisional superintendent endorsement on an
20Educator License with Stipulations, to be valid for only one
21year of serving as a superintendent. In order to receive the
22provisional alternative superintendent endorsement under this
23Section, an individual must meet all of the following
24requirements:
25        (1) Have graduated from a regionally accredited
26    college or university with a minimum of a master's degree

1    in a management field.
2        (2) Have been employed for a period of at least 5 years
3    in a management level position other than education.
4        (3) Have successfully completed phase (1) of
5    subsection (c) of this Section.
6        (4) On and after July 1, 2025, have Have passed a test
7    of basic skills and a content area test for admission into
8    the program, as required by Section 21B-30 of this Code.
9    (e) Successful completion of an alternative route to
10superintendent endorsement program shall be deemed to satisfy
11any other supervisory, administrative, or management
12experience requirements established by law, and, once
13completed, an individual shall be eligible for a superintendent
14endorsement on a Professional Educator License.
15    (f) The State Board of Education, in consultation with the

22    (a) No later than July 1, 2025, the General Assembly must
23review the educator testing requirements of this Article.

1    (105 ILCS 5/24-1.5)
2    Sec. 24-1.5. New or vacant teaching positions. A school
3district's selection of a candidate for a new or vacant
4teaching position not otherwise required to be filled pursuant
5to Section 24-12 of this Code must be based upon the
6consideration of factors that include without limitation
7certifications, qualifications, merit and ability (including
8performance evaluations, if available), and relevant
9experience, provided that the length of continuing service with
10the school district must not be considered as a factor, unless
11all other factors are determined by the school district to be
12equal. A school district's decision to select a particular
13candidate to fill a new or vacant position is not subject to
14review under grievance resolution procedures adopted pursuant
15to subsection (c) of Section 10 of the Illinois Educational
16Labor Relations Act, provided that, in making such a decision,
17the district does not fail to adhere to procedural requirements
18in a collective bargaining agreement relating to the filling of
19new or vacant teaching positions. Provisions regarding the
20filling of new and vacant positions in a collective bargaining
21agreement between a school district and the exclusive
22bargaining representative of its teachers in existence on the
23effective date of this amendatory Act of the 97th General
24Assembly shall remain in full force and effect for the term of
25the agreement, unless terminated by mutual agreement. From the

1Assembly through June 30, 2025, a school district may, as a
2condition of employment, require an applicant for a new or
3vacant teaching position to pass a test of content area
4knowledge under Section 21B-30 for each endorsement area the
5applicant has affixed on his or her educator license if the
6endorsement area has an applicable test.
7    Nothing in this amendatory Act of the 97th General Assembly
8(i) limits or otherwise impacts school districts' management
9right to hire new employees, (ii) affects what currently is or
10may be a mandatory subject of bargaining under the Illinois
11Educational Labor Relations Act, or (iii) creates a statutory
12cause of action for a candidate or a candidate's representative
13to challenge a school district's selection decision based on
14the school district's failure to adhere to the requirements of
15this Section.
