AMENDMENT TO HOUSE BILL 423

2    AMENDMENT NO. ______. Amend House Bill 423, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The School Code is amended by changing Sections
62-3.11d, 14-9.01, 21B-15, 21B-20, 21B-30, 21B-35, 21B-50, and
721B-55 as follows:
 
8    (105 ILCS 5/2-3.11d)
9    Sec. 2-3.11d. Teacher preparation institution listing.
10Data on tests required for teacher preparation and
11certification. Beginning with the effective date of this
12amendatory Act of the 94th General Assembly, to collect and
13maintain all of the following data for each institution of
14higher education engaged in teacher preparation in this State:
15        (1) The number of individuals taking the test of basic
16    skills under Section 21-1a of this Code.

1        (2) The number of individuals passing the test of basic
2    skills under Section 21-1a of this Code.
3        (3) The total number of subject-matter tests attempted
4    under Section 21-1a of this Code.
5        (4) The total number of subject-matter tests passed
6    under Section 21-1a of this Code.
7The data regarding subject-matter tests shall be reported in
8sum, rather than by separately listing each subject, in order
9to better protect the identity of the test-takers.
10    On or before August 1, 2007, the State Board of Education
11shall file with the General Assembly and the Governor and shall
12make available to the public a report listing the institutions
13of higher education engaged in teacher preparation in this
14State, along with the data listed in items (1) and (2) of this
15Section pertinent to each institution.
16    On or before October 1, 2012 and every 3 years thereafter,
17the State Board of Education shall file with the General
18Assembly and the Governor and shall make available to the
19public a report listing the institutions of higher education
20engaged in teacher preparation in this State, along with the
21data listed in items (1) through (4) of this Section pertinent
22to each institution.

1professional personnel and necessary workers. No person shall
2be employed to teach any class or program authorized by this
3Article who does not hold a valid teacher's license as provided
4by law and unless he has had such special training as the State
5Board of Education may require. No special license or
6endorsement to a special license issued under Article 21B
7Section 21B-30 of this Code shall be valid for teaching
8students with visual disabilities unless the person to whom the
9license or endorsement is issued has attained satisfactory
10performance on an examination that is designed to assess
11competency in Braille reading and writing skills according to
12standards that the State Board of Education may adopt. Evidence
13of successfully completing the examination of Braille reading
14and writing skills must be submitted to the State Board of
15Education prior to an applicant's taking of the content area
16test required under Section 21B-30 of this Code. In addition to
17other requirements, a candidate for a teaching license in the
18area of the deaf and hard of hearing granted by the Illinois
19State Board of Education for teaching deaf and hard of hearing
20students in grades pre-school through grade 12 must demonstrate
21a minimum proficiency in sign language as determined by the
22Illinois State Board of Education. All other professional
23personnel employed in any class, service, or program authorized
24by this Article shall hold such licenses and shall have had
25such special training as the State Board of Education may
26require; provided that in a school district organized under

1Article 34, the school district may employ speech and language
2pathologists who are licensed under the Illinois
3Speech-Language Pathology and Audiology Practice Act but who do
4not hold a license issued under this Code if the district
5certifies that a chronic shortage of certified personnel
6exists. Nothing contained in this Act prohibits the school
7board from employing necessary workers to assist the teacher
8with the special educational facilities, except that all such
9necessary workers must have had such training as the State
10Board of Education may require.
11    No later than January 1, 1993, the State Board of Education
12shall develop, in consultation with the Advisory Council on the
13Education of Children with Disabilities and the Advisory
14Council on Bilingual Education, rules governing the
15qualifications for certification of teachers and school
16service personnel providing services to English learners
17receiving special education and related services.
18    The employment of any teacher in a special education
19program provided for in Sections 14-1.01 to 14-14.01,
20inclusive, shall be subject to the provisions of Sections 24-11
21to 24-16, inclusive. Any teacher employed in a special
22education program, prior to the effective date of this
23amendatory Act of 1987, in which 2 or more districts
24participate shall enter upon contractual continued service in
25each of the participating districts subject to the provisions
26of Sections 24-11 to 24-16, inclusive.

2    (105 ILCS 5/21B-15)
3    Sec. 21B-15. Qualifications of educators.
4    (a) No one may be licensed to teach or supervise or be
5otherwise employed in the public schools of this State who is
6not of good character and at least 19 years of age.
7    In determining good character under this Section, the State
8Superintendent of Education shall take into consideration the
9disciplinary actions of other states or national entities
10against certificates or licenses issued by those states and
11held by individuals from those states. In addition, any felony
12conviction of the applicant may be taken into consideration;
13however, no one may be licensed to teach or supervise in the
14public schools of this State who has been convicted of (i) an
15offense set forth in subsection (b) of Section 21B-80 of this
16Code until 7 years following the end of the sentence for the
17criminal offense or (ii) an offense set forth in subsection (c)
18of Section 21B-80 of this Code. Unless the conviction is for an
19offense set forth in Section 21B-80 of this Code, an applicant
20must be permitted to submit character references or other
21written material before such a conviction or other information
22regarding the applicant's character may be used by the State
23Superintendent of Education as a basis for denying the
24application.
25    (b) No person otherwise qualified shall be denied the right

1to be licensed or to receive training for the purpose of
2becoming an educator because of a physical disability,
3including, but not limited to, visual and hearing disabilities;
4nor shall any school district refuse to employ a teacher on
5such grounds, provided that the person is able to carry out the
6duties of the position for which he or she applies.
7    (c) No person may be granted or continue to hold an
8educator license who has knowingly altered or misrepresented
9his or her qualifications, in this State or any other state, in
10order to acquire or renew the license. Any other license issued
11under this Article held by the person may be suspended or
12revoked by the State Educator Preparation and Licensure Board,
13depending upon the severity of the alteration or
14misrepresentation.
15    (d) No one may teach or supervise in the public schools nor
16receive for teaching or supervising any part of any public
17school fund who does not hold an educator license granted by
18the State Superintendent of Education as provided in this
19Article. However, the provisions of this Article do not apply
20to a member of the armed forces who is employed as a teacher of
21subjects in the Reserve Officers' Training Corps of any school,
22nor to an individual teaching a dual credit course as provided
23for in the Dual Credit Quality Act.
24    (e) Notwithstanding any other provision of this Code, the
25school board of a school district may grant to a teacher of the
26district a leave of absence with full pay for a period of not

1more than one year to permit the teacher to teach in a foreign
2state under the provisions of the Exchange Teacher Program
3established under Public Law 584, 79th Congress, and Public Law
4402, 80th Congress, as amended. The school board granting the
5leave of absence may employ, with or without pay, a national of
6the foreign state wherein the teacher on the leave of absence
7is to teach if the national is qualified to teach in that
8foreign state and if that national is to teach in a grade level
9similar to the one that was taught in the foreign state. The
10State Board of Education, in consultation with the State
11Educator Preparation and Licensure Board, may adopt rules as
12may be necessary to implement this subsection (e).
13    (f) No person shall be denied a license issued under this
14Article solely based on his or her citizenship status or
15immigration status. The General Assembly finds and declares
16that this subsection (f) is a State law within the meaning of
17subsection (d) of Section 1621 of Title 8 of the United States
18Code. Nothing in this subsection shall affect the requirements
19to obtain a license that are not directly related to
20citizenship status or immigration status. Nothing in this
21subsection shall be construed to grant eligibility for
22obtaining any public benefit other than a license issued under
23this Article.
24    (g) A candidate enrolled in a teacher preparation program
25must receive a letter grade of at least a "C", or its
26equivalent, in his or her student teaching program to obtain an

1educator license under this Article.

4    (105 ILCS 5/21B-20)
5    Sec. 21B-20. Types of licenses. The State Board of
6Education shall implement a system of educator licensure,
7whereby individuals employed in school districts who are
8required to be licensed must have one of the following
9licenses: (i) a professional educator license; (ii) an educator
10license with stipulations; (iii) a substitute teaching
11license; or (iv) until June 30, 2023, a short-term substitute
12teaching license. References in law regarding individuals
13certified or certificated or required to be certified or
14certificated under Article 21 of this Code shall also include
15individuals licensed or required to be licensed under this
16Article. The first year of all licenses ends on June 30
17following one full year of the license being issued.
18    The State Board of Education, in consultation with the
19State Educator Preparation and Licensure Board, may adopt such
20rules as may be necessary to govern the requirements for
21licenses and endorsements under this Section.
22        (1) Professional Educator License. Persons who (i)
23    have successfully completed an approved educator
24    preparation program and are recommended for licensure by
25    the Illinois institution offering the educator preparation

1    program, (ii) have successfully completed the required
2    testing under Section 21B-30 of this Code, (iii) have
3    successfully completed coursework on the psychology of,
4    the identification of, and the methods of instruction for
5    the exceptional child, including without limitation
6    children with learning disabilities, (iv) have
7    successfully completed coursework in methods of reading
8    and reading in the content area, and (v) have met all other
9    criteria established by rule of the State Board of
10    Education shall be issued a Professional Educator License.
11    All Professional Educator Licenses are valid until June 30
12    immediately following 5 years of the license being issued.
13    The Professional Educator License shall be endorsed with
14    specific areas and grade levels in which the individual is
15    eligible to practice.
16        Individuals can receive subsequent endorsements on the
17    Professional Educator License. Subsequent endorsements
18    shall require a minimum of 24 semester hours of coursework
19    in the endorsement area and passage of the applicable
20    content area test, unless otherwise specified by rule.
21        (2) Educator License with Stipulations. An Educator
22    License with Stipulations shall be issued an endorsement
23    that limits the license holder to one particular position
24    or does not require completion of an approved educator
25    program or both.
26        An individual with an Educator License with

1    Stipulations must not be employed by a school district or
2    any other entity to replace any presently employed teacher
3    who otherwise would not be replaced for any reason.
4        An Educator License with Stipulations may be issued
5    with the following endorsements:
6            (A) (Blank). A A provisional educator endorsement
7        for a service member or a spouse of a service member is
8        valid until June 30 immediately following 3 years of
9        the license being issued, provided that any remaining
10        testing and coursework deficiencies are met under this
11        Section. In this Section, "spouse of a service member"
12        means any person who, at the time of application under
13        this Section, is the spouse of an active duty member of
14        the United States Armed Forces or any reserve component
15        of the United States Armed Forces or the National Guard
16        of any state, commonwealth, or territory of the United
17        States or the District of Columbia.
18            Except as otherwise provided under this
19        subparagraph, a
20            (B) Alternative provisional educator. An
21        alternative provisional educator endorsement on an
22        Educator License with Stipulations may be issued to an
23        applicant who, at the time of applying for the
24        endorsement, has done all of the following:
25                (i) Graduated from a regionally accredited
26            college or university with a minimum of a

1            bachelor's degree.
2                (ii) Successfully completed the first phase of
3            the Alternative Educator Licensure Program for
4            Teachers, as described in Section 21B-50 of this
5            Code.
6                (iii) (Blank). Passed a test of basic skills
7            and content area test, as required under Section
8            21B-30 of this Code.
9        The alternative provisional educator endorsement is
10    valid for 2 years of teaching and may be renewed for a
11    third year by an individual meeting the requirements set
12    forth in Section 21B-50 of this Code.
13            (C) Alternative provisional superintendent. An
14        alternative provisional superintendent endorsement on
15        an Educator License with Stipulations entitles the
16        holder to serve only as a superintendent or assistant
17        superintendent in a school district's central office.
18        This endorsement may only be issued to an applicant
19        who, at the time of applying for the endorsement, has
20        done all of the following:
21                (i) Graduated from a regionally accredited
22            college or university with a minimum of a master's
23            degree in a management field other than education.
24                (ii) Been employed for a period of at least 5
25            years in a management level position in a field
26            other than education.

1                (iii) Successfully completed the first phase
2            of an alternative route to superintendent
3            endorsement program, as provided in Section 21B-55
4            of this Code.
5                (iv) (Blank). Passed a test of basic skills and
6            content area tests required under Section 21B-30
7            of this Code.
8            The endorsement is valid for 2 fiscal years in
9        order to complete one full year of serving as a
10        superintendent or assistant superintendent.
11            (D) (Blank).
12            (E) Career and technical educator. A career and
13        technical educator endorsement on an Educator License
14        with Stipulations may be issued to an applicant who has
15        a minimum of 60 semester hours of coursework from a
16        regionally accredited institution of higher education
17        or an accredited trade and technical institution and
18        has a minimum of 2,000 hours of experience outside of
19        education in each area to be taught.
20            The career and technical educator endorsement on
21        an Educator License with Stipulations is valid until
22        June 30 immediately following 5 years of the
23        endorsement being issued and may be renewed. For
24        individuals who were issued the career and technical
25        educator endorsement on an Educator License with
26        Stipulations on or after January 1, 2015, the license

1        may be renewed if the individual passes a test of basic
2        skills or test of work proficiency, as required under
3        Section 21B-30 of this Code.
4            An individual who holds a valid career and
5        technical educator endorsement on an Educator License
6        with Stipulations but does not hold a bachelor's degree
7        may substitute teach in career and technical education
8        classrooms.
9            (F) Part-time provisional career and technical
10        educator or provisional career and technical educator.
11        A part-time provisional career and technical educator
12        endorsement or a provisional career and technical
13        educator endorsement on an Educator License with
14        Stipulations may be issued to an applicant who has a
15        minimum of 8,000 hours of work experience in the skill
16        for which the applicant is seeking the endorsement. It
17        is the responsibility of each employing school board
18        and regional office of education to provide
19        verification, in writing, to the State Superintendent
20        of Education at the time the application is submitted
21        that no qualified teacher holding a Professional
22        Educator License or an Educator License with
23        Stipulations with a career and technical educator
24        endorsement is available and that actual circumstances
25        require such issuance.
26            The provisional career and technical educator

1        endorsement on an Educator License with Stipulations
2        is valid until June 30 immediately following 5 years of
3        the endorsement being issued and may be renewed for 5
4        years. For individuals who were issued the provisional
5        career and technical educator endorsement on an
6        Educator License with Stipulations on or after January
7        1, 2015, the license may be renewed if the individual
8        passes a test of basic skills or test of work
9        proficiency, as required under Section 21B-30 of this
10        Code.
11            A part-time provisional career and technical
12        educator endorsement on an Educator License with
13        Stipulations may be issued for teaching no more than 2
14        courses of study for grades 6 through 12. The part-time
15        provisional career and technical educator endorsement
16        on an Educator License with Stipulations is valid until
17        June 30 immediately following 5 years of the
18        endorsement being issued and may be renewed for 5 years
19        if the individual makes application for renewal.
20            An individual who holds a provisional or part-time
21        provisional career and technical educator endorsement
22        on an Educator License with Stipulations but does not
23        hold a bachelor's degree may substitute teach in career
24        and technical education classrooms.
25            (G) Transitional bilingual educator. A
26        transitional bilingual educator endorsement on an

1        Educator License with Stipulations may be issued for
2        the purpose of providing instruction in accordance
3        with Article 14C of this Code to an applicant who
4        provides satisfactory evidence that he or she meets all
5        of the following requirements:
6                (i) Possesses adequate speaking, reading, and
7            writing ability in the language other than English
8            in which transitional bilingual education is
9            offered.
10                (ii) Has the ability to successfully
11            communicate in English.
12                (iii) Either possessed, within 5 years
13            previous to his or her applying for a transitional
14            bilingual educator endorsement, a valid and
15            comparable teaching certificate or comparable
16            authorization issued by a foreign country or holds
17            a degree from an institution of higher learning in
18            a foreign country that the State Educator
19            Preparation and Licensure Board determines to be
20            the equivalent of a bachelor's degree from a
21            regionally accredited institution of higher
22            learning in the United States.
23            A transitional bilingual educator endorsement
24        shall be valid for prekindergarten through grade 12, is
25        valid until June 30 immediately following 5 years of
26        the endorsement being issued, and shall not be renewed.

1            Persons holding a transitional bilingual educator
2        endorsement shall not be employed to replace any
3        presently employed teacher who otherwise would not be
4        replaced for any reason.
5            (H) Language endorsement. In an effort to
6        alleviate the shortage of teachers speaking a language
7        other than English in the public schools, an individual
8        who holds an Educator License with Stipulations may
9        also apply for a language endorsement, provided that
10        the applicant provides satisfactory evidence that he
11        or she meets all of the following requirements:
12                (i) Holds a transitional bilingual
13            endorsement.
14                (ii) (Blank). Has demonstrated proficiency in
15            the language for which the endorsement is to be
16            issued by passing the applicable language content
17            test required by the State Board of Education.
18                (iii) Holds a bachelor's degree or higher from
19            a regionally accredited institution of higher
20            education or, for individuals educated in a
21            country other than the United States, holds a
22            degree from an institution of higher learning in a
23            foreign country that the State Educator
24            Preparation and Licensure Board determines to be
25            the equivalent of a bachelor's degree from a
26            regionally accredited institution of higher

1            learning in the United States.
2                (iv) (Blank). Has passed a test of basic
3            skills, as required under Section 21B-30 of this
4            Code.
5            A language endorsement on an Educator License with
6        Stipulations is valid for prekindergarten through
7        grade 12 for the same validity period as the
8        individual's transitional bilingual educator
9        endorsement on the Educator License with Stipulations
10        and shall not be renewed.
11            (I) Visiting international educator. A visiting
12        international educator endorsement on an Educator
13        License with Stipulations may be issued to an
14        individual who is being recruited by a particular
15        school district that conducts formal recruitment
16        programs outside of the United States to secure the
17        services of qualified teachers and who meets all of the
18        following requirements:
19                (i) Holds the equivalent of a minimum of a
20            bachelor's degree issued in the United States.
21                (ii) Has been prepared as a teacher at the
22            grade level for which he or she will be employed.
23                (iii) Has adequate content knowledge in the
24            subject to be taught.
25                (iv) Has an adequate command of the English
26            language.

1            A holder of a visiting international educator
2        endorsement on an Educator License with Stipulations
3        shall be permitted to teach in bilingual education
4        programs in the language that was the medium of
5        instruction in his or her teacher preparation program,
6        provided that he or she passes the English Language
7        Proficiency Examination or another test of writing
8        skills in English identified by the State Board of
9        Education, in consultation with the State Educator
10        Preparation and Licensure Board.
11            A visiting international educator endorsement on
12        an Educator License with Stipulations is valid for 3
13        years and shall not be renewed.
14            (J) Paraprofessional educator. A paraprofessional
15        educator endorsement on an Educator License with
16        Stipulations may be issued to an applicant who holds a
17        high school diploma or its recognized equivalent and
18        either holds an associate's degree or a minimum of 60
19        semester hours of credit from a regionally accredited
20        institution of higher education or has passed a test of
21        basic skills required under Section 21B-30 of this
22        Code. The paraprofessional educator endorsement is
23        valid until June 30 immediately following 5 years of
24        the endorsement being issued and may be renewed through
25        application and payment of the appropriate fee, as
26        required under Section 21B-40 of this Code. An

1        individual who holds only a paraprofessional educator
2        endorsement is not subject to additional requirements
3        in order to renew the endorsement.
4            (K) Chief school business official. A chief school
5        business official endorsement on an Educator License
6        with Stipulations may be issued to an applicant who
7        qualifies by having a master's degree or higher, 2
8        years of full-time administrative experience in school
9        business management or 2 years of university-approved
10        practical experience, and a minimum of 24 semester
11        hours of graduate credit in a program approved by the
12        State Board of Education for the preparation of school
13        business administrators and by passage of the
14        applicable State tests, including a test of basic
15        skills and applicable content area test.
16            The chief school business official endorsement may
17        also be affixed to the Educator License with
18        Stipulations of any holder who qualifies by having a
19        master's degree in business administration, finance,
20        accounting, or public administration and who completes
21        an additional 6 semester hours of internship in school
22        business management from a regionally accredited
23        institution of higher education and passes the
24        applicable State tests, including a test of basic
25        skills and applicable content area test. This
26        endorsement shall be required for any individual

1        employed as a chief school business official.
2            The chief school business official endorsement on
3        an Educator License with Stipulations is valid until
4        June 30 immediately following 5 years of the
5        endorsement being issued and may be renewed if the
6        license holder completes renewal requirements as
7        required for individuals who hold a Professional
8        Educator License endorsed for chief school business
9        official under Section 21B-45 of this Code and such
10        rules as may be adopted by the State Board of
11        Education.
12            The State Board of Education shall adopt any rules
13        necessary to implement Public Act 100-288.
14            (L) Provisional in-state educator. A provisional
15        in-state educator endorsement on an Educator License
16        with Stipulations may be issued to a candidate who has
17        completed an Illinois-approved educator preparation
18        program at an Illinois institution of higher education
19        and who has not successfully completed an
20        evidence-based assessment of teacher effectiveness but
21        who meets all of the following requirements:
22                (i) Holds at least a bachelor's degree.
23                (ii) Has completed an approved educator
24            preparation program at an Illinois institution.
25                (iii) (Blank). Has passed a test of basic
26            skills and applicable content area test, as

1            required by Section 21B-30 of this Code.
2                (iv) Has attempted an evidence-based
3            assessment of teacher effectiveness and received a
4            minimum score on that assessment, as established
5            by the State Board of Education in consultation
6            with the State Educator Preparation and Licensure
7            Board.
8            A provisional in-state educator endorsement on an
9        Educator License with Stipulations is valid for one
10        full fiscal year after the date of issuance and may not
11        be renewed.
12            (M) School support personnel intern. A school
13        support personnel intern endorsement on an Educator
14        License with Stipulations may be issued as specified by
15        rule.
16            (N) Special education area. A special education
17        area endorsement on an Educator License with
18        Stipulations may be issued as defined and specified by
19        rule.
20        (3) Substitute Teaching License. A Substitute Teaching
21    License may be issued to qualified applicants for
22    substitute teaching in all grades of the public schools,
23    prekindergarten through grade 12. Substitute Teaching
24    Licenses are not eligible for endorsements. Applicants for
25    a Substitute Teaching License must hold a bachelor's degree
26    or higher from a regionally accredited institution of

1    higher education.
2        Substitute Teaching Licenses are valid for 5 years.
3        Substitute Teaching Licenses are valid for substitute
4    teaching in every county of this State. If an individual
5    has had his or her Professional Educator License or
6    Educator License with Stipulations suspended or revoked,
7    then that individual is not eligible to obtain a Substitute
8    Teaching License.
9        A substitute teacher may only teach in the place of a
10    licensed teacher who is under contract with the employing
11    board. If, however, there is no licensed teacher under
12    contract because of an emergency situation, then a district
13    may employ a substitute teacher for no longer than 30
14    calendar days per each vacant position in the district if
15    the district notifies the appropriate regional office of
16    education within 5 business days after the employment of
17    the substitute teacher in the emergency situation. An
18    emergency situation is one in which an unforeseen vacancy
19    has occurred and (i) a teacher is unable to fulfill his or
20    her contractual duties or (ii) teacher capacity needs of
21    the district exceed previous indications, and the district
22    is actively engaged in advertising to hire a fully licensed
23    teacher for the vacant position.
24        There is no limit on the number of days that a
25    substitute teacher may teach in a single school district,
26    provided that no substitute teacher may teach for longer

1    than 90 school days for any one licensed teacher under
2    contract in the same school year. A substitute teacher who
3    holds a Professional Educator License or Educator License
4    with Stipulations shall not teach for more than 120 school
5    days for any one licensed teacher under contract in the
6    same school year. The limitations in this paragraph (3) on
7    the number of days a substitute teacher may be employed do
8    not apply to any school district operating under Article 34
9    of this Code.
10        A school district may not require an individual who
11    holds a valid Professional Educator License or Educator
12    License with Stipulations to seek or hold a Substitute
13    Teaching License to teach as a substitute teacher.
14        (4) Short-Term Substitute Teaching License. Beginning
15    on July 1, 2018 and until June 30, 2023, the State Board of
16    Education may issue a Short-Term Substitute Teaching
17    License. A Short-Term Substitute Teaching License may be
18    issued to a qualified applicant for substitute teaching in
19    all grades of the public schools, prekindergarten through
20    grade 12. Short-Term Substitute Teaching Licenses are not
21    eligible for endorsements. Applicants for a Short-Term
22    Substitute Teaching License must hold an associate's
23    degree or have completed at least 60 credit hours from a
24    regionally accredited institution of higher education.
25        Short-Term Substitute Teaching Licenses are valid for
26    substitute teaching in every county of this State. If an

1    individual has had his or her Professional Educator License
2    or Educator License with Stipulations suspended or
3    revoked, then that individual is not eligible to obtain a
4    Short-Term Substitute Teaching License.
5        The provisions of Sections 10-21.9 and 34-18.5 of this
6    Code apply to short-term substitute teachers.
7        An individual holding a Short-Term Substitute Teaching
8    License may teach no more than 5 consecutive days per
9    licensed teacher who is under contract. For teacher
10    absences lasting 6 or more days per licensed teacher who is
11    under contract, a school district may not hire an
12    individual holding a Short-Term Substitute Teaching
13    License. An individual holding a Short-Term Substitute
14    Teaching License must complete the training program under
15    Section 10-20.67 or 34-18.60 of this Code to be eligible to
16    teach at a public school. This paragraph (4) is inoperative
17    on and after July 1, 2023.

2State Educator Preparation and Licensure Board, shall design
3and implement a system of examinations, which shall be required
4prior to the issuance of educator licenses. These examinations
5and indicators must be based on national and State professional
6teaching standards, as determined by the State Board of
7Education, in consultation with the State Educator Preparation
8and Licensure Board. The State Board of Education may adopt
9such rules as may be necessary to implement and administer this
10Section.
11    (c) (Blank). Except as otherwise provided in this Article,
12applicants seeking a Professional Educator License or an
13Educator License with Stipulations shall be required to pass a
14test of basic skills before the license is issued, unless the
15endorsement the individual is seeking does not require passage
16of the test. All applicants completing Illinois-approved,
17teacher education or school service personnel preparation
18programs shall be required to pass the State Board of
19Education's recognized test of basic skills prior to starting
20their student teaching or starting the final semester of their
21internship. An institution of higher learning, as defined in
22the Higher Education Student Assistance Act, may not require an
23applicant to complete the State Board's recognized test of
24basic skills prior to the semester before student teaching or
25prior to the semester before starting the final semester of an
26internship. An individual who passes a test of basic skills

1does not need to do so again for subsequent endorsements or
2other educator licenses.
3    (d) (Blank). All applicants seeking a State license shall
4be required to pass a test of content area knowledge for each
5area of endorsement for which there is an applicable test.
6There shall be no exception to this requirement. No candidate
7shall be allowed to student teach or serve as the teacher of
8record until he or she has passed the applicable content area
9test.
10    (e) (Blank).
11    (f) Except as otherwise provided in this Article, beginning
12on September 1, 2015, all candidates completing teacher
13preparation programs in this State and all candidates subject
14to Section 21B-35 of this Code are required to pass a teacher
15performance assessment approved by the State Board of
16Education, in consultation with the State Educator Preparation
17and Licensure Board.
18    (g) The Tests of basic skills and content area knowledge
19and the teacher performance assessment shall be a test the
20tests that from time to time is are designated by the State
21Board of Education, in consultation with the State Educator
22Preparation and Licensure Board, and may be a test tests
23prepared by an educational testing organization or a test tests
24designed by the State Board of Education, in consultation with
25the State Educator Preparation and Licensure Board. The areas
26to be covered by a test of basic skills shall include reading,

1language arts, and mathematics. The test of content area
2knowledge shall assess content knowledge in a specific subject
3field. The test tests must be designed to be racially neutral
4to ensure that no person taking the test tests is discriminated
5against on the basis of race, color, national origin, or other
6factors unrelated to the person's ability to perform as a
7licensed employee. The score required to pass the test tests
8shall be fixed by the State Board of Education, in consultation
9with the State Educator Preparation and Licensure Board. The
10test tests shall be administered not fewer than 3 times a year
11at such time and place as may be designated by the State Board
12of Education, in consultation with the State Educator
13Preparation and Licensure Board.
14    The State Board shall implement a test or tests to assess
15the speaking, reading, writing, and grammar skills of
16applicants for an endorsement or a license issued under
17subdivision (G) of paragraph (2) of Section 21B-20 of this Code
18in the English language and in the language of the transitional
19bilingual education program requested by the applicant.
20    (h) Except as provided in Section 34-6 of this Code, the
21provisions of this Section shall apply equally in any school
22district subject to Article 34 of this Code.
23    (i) The rules developed to implement and enforce the
24testing requirements under this Section shall include without
25limitation provisions governing test selection, test
26validation and determination of a passing score,

1administration of the tests, frequency of administration,
2applicant fees, frequency of applicants taking the tests, the
3years for which a score is valid, and appropriate special
4accommodations. The State Board of Education shall develop such

11    Sec. 21B-35. Minimum requirements for educators trained in
12other states or countries.
13    (a) Any applicant who has not been entitled by an
14Illinois-approved educator preparation program at an Illinois
15institution of higher education applying for a Professional
16Educator License endorsed in a teaching field or school support
17personnel area must meet the following requirements:
18        (1) the applicant must:
19            (A) hold a comparable and valid educator license or
20        certificate, as defined by rule, with similar grade
21        level and content area credentials from another state,
22        with the State Board of Education having the authority
23        to determine what constitutes similar grade level and
24        content area credentials from another state; and
25            (B) have a bachelor's degree from a regionally

1        accredited institution of higher education; or
2        (2) the applicant must:
3            (A) have completed a state-approved program for
4        the licensure area sought, including coursework

9            (B) have a bachelor's degree from a regionally
10        accredited institution of higher education;
11            (C) have successfully met all Illinois examination
12        requirements, except that:
13                (i) an applicant who has successfully
14            completed a test of basic skills, as defined by
15            rules, at the time of initial licensure in another
16            state is not required to complete a test of basic
17            skills;
18                (ii) an applicant who has successfully
19            completed a test of content, as defined by rules,
20            at the time of initial licensure in another state
21            is not required to complete a test of content; and
22                (iii) an applicant for a teaching endorsement
23            who has successfully completed an evidence-based
24            assessment of teacher effectiveness, as defined by
25            rules, at the time of initial licensure in another
26            state is not required to complete an

2            effectiveness; and
3            (D) for an applicant for a teaching endorsement,
4        have completed student teaching or an equivalent

8    (b) In order to receive a Professional Educator License
9endorsed in a teaching field or school support personnel area,
10applicants trained in another country must meet all of the
11following requirements:
12        (1) Have completed a comparable education program in
13    another country.
14        (2) Have had transcripts evaluated by an evaluation
15    service approved by the State Superintendent of Education.
16        (3) Have a degree comparable to a degree from a
17    regionally accredited institution of higher education.
18        (4) Have completed coursework aligned to standards
19    concerning methods of instruction of the exceptional
20    child, methods of reading and reading in the content area,
21    and instructional strategies for English learners.
22        (5) (Blank).
23        (6) (Blank).
24        (7) Have successfully met all State licensure
25    examination requirements. Applicants who have successfully
26    completed a test of basic skills, as defined by rules, at

8    teacher effectiveness, as defined by rules, at the time of
9    initial licensure in another country shall not be required
10    to complete an evidence-based assessment of teacher
11    effectiveness.
12        (8) Have completed student teaching or an equivalent
13    experience.
14    (b-5) All applicants who have not been entitled by an
15Illinois-approved educator preparation program at an Illinois
16institution of higher education and applicants trained in
17another country applying for a Professional Educator License
18endorsed for principal or superintendent must hold a master's
19degree from a regionally accredited institution of higher
20education and must hold a comparable and valid educator license
21or certificate with similar grade level and subject matter
22credentials, with the State Board of Education having the
23authority to determine what constitutes similar grade level and
24subject matter credentials from another state, or must meet all
25of the following requirements:
26        (1) Have completed an educator preparation program

1    approved by another state or comparable educator program in
2    another country leading to the receipt of a license or
3    certificate for the Illinois endorsement sought.
4        (2) Have successfully met all State licensure

7    test of basic skills, as defined by rules, at the time of
8    initial licensure in another state or country shall not be
9    required to complete a test of basic skills. Applicants who
10    have successfully completed a test of content, as defined
11    by rules, at the time of initial licensure in another state
12    or country shall not be required to complete a test of
13    content.
14        (2.5) Have completed an internship, as defined by rule.
15        (3) (Blank).
16        (4) Have completed coursework aligned to standards
17    concerning methods of instruction of the exceptional
18    child, methods of reading and reading in the content area,
19    and instructional strategies for English learners.
20        (5) Have completed a master's degree.
21        (6) Have successfully completed teaching, school
22    support, or administrative experience as defined by rule.
23    (b-7) All applicants who have not been entitled by an
24Illinois-approved educator preparation program at an Illinois
25institution of higher education applying for a Professional

8        (1) Have completed a master's degree.
9        (2) Have 2 years of full-time experience providing
10    special education services.
11        (3) Have successfully completed all examination
12    requirements, as required by Section 21B-30 of this Code.
13    Applicants who have successfully completed a test of
14    content, as identified by rules, at the time of initial
15    licensure in another state or country shall not be required
16    to complete a test of content.
17        (4) Have completed coursework aligned to standards
18    concerning methods of instruction of the exceptional
19    child, methods of reading and reading in the content area,
20    and instructional strategies for English learners.
21    (b-10) All applicants who have not been entitled by an
22Illinois-approved educator preparation program at an Illinois
23institution of higher education applying for a Professional
24Educator License endorsed for chief school business official
25must hold a master's degree from a regionally accredited
26institution of higher education and must hold a comparable and

3Education having the authority to determine what constitutes

7    management, finance, or accounting.
8        (2) Have successfully completed an internship in
9    school business management or have 2 years of experience as
10    a school business administrator.
11        (3) Have successfully met all State examination
12    requirements, as required by Section 21B-30 of this Code.
13    Applicants who have successfully completed a test of
14    content, as identified by rules, at the time of initial
15    licensure in another state or country shall not be required
16    to complete a test of content.
17        (4) Have completed modules aligned to standards
18    concerning methods of instruction of the exceptional
19    child, methods of reading and reading in the content area,
20    and instructional strategies for English learners.
21    (c) The State Board of Education, in consultation with the
22State Educator Preparation and Licensure Board, may adopt such
23rules as may be necessary to implement this Section.

1    (105 ILCS 5/21B-50)
2    Sec. 21B-50. Alternative educator licensure program.
3    (a) There is established an alternative educator licensure
4program, to be known as the Alternative Educator Licensure
5Program for Teachers.
6    (b) The Alternative Educator Licensure Program for
7Teachers may be offered by a recognized institution approved to
8offer educator preparation programs by the State Board of
9Education, in consultation with the State Educator Preparation
10and Licensure Board.
11    The program shall be comprised of 4 phases:
12        (1) A course of study that at a minimum includes
13    instructional planning; instructional strategies,
14    including special education, reading, and English language
15    learning; classroom management; and the assessment of
16    students and use of data to drive instruction.
17        (2) A year of residency, which is a candidate's
18    assignment to a full-time teaching position or as a
19    co-teacher for one full school year. An individual must
20    hold an Educator License with Stipulations with an
21    alternative provisional educator endorsement in order to
22    enter the residency and must complete additional program
23    requirements that address required State and national
24    standards, pass the assessment of professional teaching
25    before entering the second residency year, as required
26    under phase (3) of this subsection (b), and be recommended

1    by the principal or qualified equivalent of a principal, as
2    required under subsection (d) of this Section, and the
3    program coordinator to continue with the second year of the
4    residency.
5        (3) A second year of residency, which shall include the
6    candidate's assignment to a full-time teaching position
7    for one school year. The candidate must be assigned an
8    experienced teacher to act as a mentor and coach the
9    candidate through the second year of residency.
10        (4) A comprehensive assessment of the candidate's
11    teaching effectiveness, as evaluated by the principal or
12    qualified equivalent of a principal, as required under
13    subsection (d) of this Section, and the program
14    coordinator, at the end of the second year of residency. If
15    there is disagreement between the 2 evaluators about the
16    candidate's teaching effectiveness, the candidate may
17    complete one additional year of residency teaching under a
18    professional development plan developed by the principal
19    or qualified equivalent and the preparation program. At the
20    completion of the third year, a candidate must have
21    positive evaluations and a recommendation for full
22    licensure from both the principal or qualified equivalent
23    and the program coordinator or no Professional Educator
24    License shall be issued.
25    Successful completion of the program shall be deemed to
26satisfy any other practice or student teaching and content

1matter requirements established by law.
2    (c) An alternative provisional educator endorsement on an
3Educator License with Stipulations is valid for 2 years of
4teaching in the public schools, including without limitation a
5preschool educational program under Section 2-3.71 of this Code
6or charter school, or in a State-recognized nonpublic school in
7which the chief administrator is required to have the licensure
8necessary to be a principal in a public school in this State
9and in which a majority of the teachers are required to have
10the licensure necessary to be instructors in a public school in
11this State, but may be renewed for a third year if needed to
12complete the Alternative Educator Licensure Program for
13Teachers. The endorsement shall be issued only once to an
14individual who meets all of the following requirements:
15        (1) Has graduated from a regionally accredited college
16    or university with a bachelor's degree or higher.
17        (2) Has a cumulative grade point average of 3.0 or
18    greater on a 4.0 scale or its equivalent on another scale.
19        (3) Has completed a major in the content area if
20    seeking a middle or secondary level endorsement or, if
21    seeking an early childhood, elementary, or special
22    education endorsement, has completed a major in the content
23    area of reading, English/language arts, mathematics, or
24    one of the sciences. If the individual does not have a
25    major in a content area for any level of teaching, he or
26    she must submit transcripts to the State Board of Education

1    to be reviewed for equivalency.
2        (4) Has successfully completed phase (1) of subsection
3    (b) of this Section.
4        (5) (Blank). Has passed a test of basic skills and
5    content area test required for the specific endorsement for
6    admission into the program, as required under Section
7    21B-30 of this Code.
8    A candidate possessing the alternative provisional
9educator endorsement may receive a salary, benefits, and any
10other terms of employment offered to teachers in the school who
11are members of an exclusive bargaining representative, if any,
12but a school is not required to provide these benefits during
13the years of residency if the candidate is serving only as a
14co-teacher. If the candidate is serving as the teacher of
15record, the candidate must receive a salary, benefits, and any
16other terms of employment. Residency experiences must not be
17counted towards tenure.
18    (d) The recognized institution offering the Alternative
19Educator Licensure Program for Teachers must partner with a
20school district, including without limitation a preschool
21educational program under Section 2-3.71 of this Code or
22charter school, or a State-recognized, nonpublic school in this
23State in which the chief administrator is required to have the
24licensure necessary to be a principal in a public school in
25this State and in which a majority of the teachers are required
26to have the licensure necessary to be instructors in a public

1school in this State. A recognized institution that partners
2with a public school district administering a preschool
3educational program under Section 2-3.71 of this Code must
4require a principal to recommend or evaluate candidates in the
5program. A recognized institution that partners with an
6eligible entity administering a preschool educational program
7under Section 2-3.71 of this Code and that is not a public
8school district must require a principal or qualified
9equivalent of a principal to recommend or evaluate candidates
10in the program. The program presented for approval by the State
11Board of Education must demonstrate the supports that are to be
12provided to assist the provisional teacher during the 2-year
13residency period. These supports must provide additional
14contact hours with mentors during the first year of residency.
15    (e) Upon completion of the 4 phases outlined in subsection
16(b) of this Section and all assessments required under Section
1721B-30 of this Code, an individual shall receive a Professional
18Educator License.
19    (f) The State Board of Education, in consultation with the
20State Educator Preparation and Licensure Board, may adopt such
21rules as may be necessary to establish and implement the
22Alternative Educator Licensure Program for Teachers.

1    Sec. 21B-55. Alternative route to superintendent
2endorsement.
3    (a) The State Board of Education, in consultation with the
4State Educator Preparation and Licensure Board, may approve
5programs designed to provide an alternative route to
6superintendent endorsement on a Professional Educator License.
7    (b) Entities offering an alternative route to
8superintendent endorsement program must have the program
9approved by the State Board of Education, in consultation with
10the State Educator Preparation and Licensure Board.
11    (c) All programs approved under this Section shall be
12comprised of the following 3 phases:
13        (1) A course of study offered on an intensive basis in
14    education management, governance, organization, and
15    instructional and district planning.
16        (2) The person's assignment to a full-time position for
17    one school year as a superintendent.
18        (3) A comprehensive assessment of the person's
19    performance by school officials and a recommendation to the
20    State Board of Education that the person be issued a
21    superintendent endorsement on a Professional Educator
22    License.
23    (d) In order to serve as a superintendent under phase (2)
24of subsection (c) of this Section, an individual must be issued
25an alternative provisional superintendent endorsement on an
26Educator License with Stipulations, to be valid for only one

1year of serving as a superintendent. In order to receive the
2provisional alternative superintendent endorsement under this
3Section, an individual must meet all of the following
4requirements:
5        (1) Have graduated from a regionally accredited
6    college or university with a minimum of a master's degree
7    in a management field.
8        (2) Have been employed for a period of at least 5 years
9    in a management level position other than education.
10        (3) Have successfully completed phase (1) of
11    subsection (c) of this Section.
12        (4) (Blank). Have passed a test of basic skills and a
13    content area test for admission into the program, as
14    required by Section 21B-30 of this Code.
15    (e) Successful completion of an alternative route to
16superintendent endorsement program shall be deemed to satisfy
17any other supervisory, administrative, or management
18experience requirements established by law, and, once
19completed, an individual shall be eligible for a superintendent
20endorsement on a Professional Educator License.
21    (f) The State Board of Education, in consultation with the
22State Educator Preparation and Licensure Board, may adopt such
23rules as may be needed to establish and implement these
24alternative route to superintendent endorsement programs.
