2 | | AMENDMENT NO. ______. Amend House Bill 423, AS AMENDED, by |
3 | | replacing everything after the enacting clause with the |
4 | | following:

5 | | "Section 5. The School Code is amended by changing Sections |
6 | | 2-3.11d, 14-9.01, 21B-15, 21B-20, 21B-30, 21B-35, 21B-50, and |
7 | | 21B-55 as follows: |

9 | | Sec. 2-3.11d. Teacher preparation institution listing. |
10 | | Data on tests required for teacher preparation and |
11 | | certification. Beginning with the effective date of this |
12 | | amendatory Act of the 94th General Assembly, to collect and |
13 | | maintain all of the following data for each institution of |
14 | | higher education engaged in teacher preparation in this State: |
15 | | (1) The number of individuals taking the test of basic |
16 | | skills under Section 21-1a of this Code. |

1 | | (2) The number of individuals passing the test of basic |
2 | | skills under Section 21-1a of this Code. |
3 | | (3) The total number of subject-matter tests attempted |
4 | | under Section 21-1a of this Code. |
5 | | (4) The total number of subject-matter tests passed |
6 | | under Section 21-1a of this Code. |
7 | | The data regarding subject-matter tests shall be reported in |
8 | | sum, rather than by separately listing each subject, in order |
9 | | to better protect the identity of the test-takers. |
10 | | On or before August 1, 2007, the State Board of Education |
11 | | shall file with the General Assembly and the Governor and shall |
12 | | make available to the public a report listing the institutions |
13 | | of higher education engaged in teacher preparation in this |
14 | | State, along with the data listed in items (1) and (2) of this |
15 | | Section pertinent to each institution. |
16 | | On or before October 1, 2012 and every 3 years thereafter, |
17 | | the State Board of Education shall file with the General |
18 | | Assembly and the Governor and shall make available to the |
19 | | public a report listing the institutions of higher education |
20 | | engaged in teacher preparation in this State , along with the |
21 | | data listed in items (1) through (4) of this Section pertinent |
22 | | to each institution .

7 | | Section 21B-30 of this Code shall be valid for teaching |
8 | | students with visual
disabilities unless the person to whom the |
9 | | license or endorsement is issued
has attained satisfactory |
10 | | performance on an examination that is designed to
assess |
11 | | competency in Braille reading and writing skills according to |
12 | | standards
that the State Board of Education may adopt. Evidence |
13 | | of successfully
completing the examination of Braille reading |
14 | | and writing skills must be
submitted to the State Board of |
15 | | Education prior to an applicant's taking
of the content area |
16 | | test required under Section 21B-30 of this Code. In addition to |
17 | | other requirements, a candidate for a teaching
license in the |
18 | | area of the deaf and hard of hearing granted by the
Illinois |
19 | | State Board of Education for teaching deaf and hard of hearing
|
20 | | students in grades pre-school through grade 12 must demonstrate |
21 | | a minimum
proficiency in sign language as determined by the |
22 | | Illinois State Board of
Education. All other professional |
23 | | personnel employed in any class, service,
or program authorized |
24 | | by this Article shall hold such licenses and shall
have had |
25 | | such special training as the State Board of Education may |
26 | | require;
provided that in a school district organized under |

1 | | Article 34, the school
district may employ speech and language |
2 | | pathologists who are licensed under the
Illinois |
3 | | Speech-Language Pathology and Audiology Practice Act but who do |
4 | | not
hold a license issued under this Code if the district |
5 | | certifies that
a chronic shortage of certified personnel |
6 | | exists. Nothing contained in this
Act prohibits the school |
7 | | board from employing necessary workers to assist the
teacher |
8 | | with the special educational facilities, except that all such |
9 | | necessary
workers must have had such training as the State |
10 | | Board of Education may
require.

11 | | No later than January 1, 1993, the State Board of Education |
12 | | shall develop,
in consultation with the Advisory Council on the |
13 | | Education of Children with
Disabilities and the Advisory |
14 | | Council on Bilingual Education, rules governing
the |
15 | | qualifications for certification of teachers and school |
16 | | service personnel
providing services to English learners |
17 | | receiving special
education and related services.
|
18 | | The employment of any teacher in a special education |
19 | | program provided
for in Sections 14-1.01 to 14-14.01, |
20 | | inclusive, shall be subject to
the provisions of Sections 24-11 |
21 | | to 24-16, inclusive. Any teacher
employed in a special |
22 | | education program, prior to the effective date of
this |
23 | | amendatory Act of 1987, in which 2 or more districts
|
24 | | participate shall enter upon contractual continued service in |
25 | | each of
the participating districts subject to the provisions |
26 | | of Sections 24-11
to 24-16, inclusive.

3 | | Sec. 21B-15. Qualifications of educators. |
4 | | (a) No one may be licensed to teach or supervise or be |
5 | | otherwise employed in the public schools of this State who is |
6 | | not of good character and at least 19 years of age. |
7 | | In determining good character under this Section, the State |
8 | | Superintendent of Education shall take into consideration the |
9 | | disciplinary actions of other states or national entities |
10 | | against certificates or licenses issued by those states and |
11 | | held by individuals from those states. In addition, any felony |
12 | | conviction of the applicant may be taken into consideration; |
13 | | however, no one may be licensed to teach or supervise in the |
14 | | public schools of this State who has been convicted of (i) an |
15 | | offense set forth in subsection (b) of Section 21B-80 of this |
16 | | Code until 7 years following the end of the sentence for the |
17 | | criminal offense or (ii) an offense set forth in subsection (c) |
18 | | of Section 21B-80 of this Code. Unless the conviction is for an |
19 | | offense set forth in Section 21B-80 of this Code, an applicant |
20 | | must be permitted to submit character references or other |
21 | | written material before such a conviction or other information |
22 | | regarding the applicant's character may be used by the State |
23 | | Superintendent of Education as a basis for denying the |
24 | | application. |
25 | | (b) No person otherwise qualified shall be denied the right |

|
1 | | to be licensed or to receive training for the purpose of |
2 | | becoming an educator because of a physical disability, |
3 | | including, but not limited to, visual and hearing disabilities; |
4 | | nor shall any school district refuse to employ a teacher on |
5 | | such grounds, provided that the person is able to carry out the |
6 | | duties of the position for which he or she applies. |
7 | | (c) No person may be granted or continue to hold an |
8 | | educator license who has knowingly altered or misrepresented |
9 | | his or her qualifications, in this State or any other state, in |
10 | | order to acquire or renew the license. Any other license issued |
11 | | under this Article held by the person may be suspended or |
12 | | revoked by the State Educator Preparation and Licensure Board, |
13 | | depending upon the severity of the alteration or |
14 | | misrepresentation. |
15 | | (d) No one may teach or supervise in the public schools nor |
16 | | receive for teaching or supervising any part of any public |
17 | | school fund who does not hold an educator license granted by |
18 | | the State Superintendent of Education as provided in this |
19 | | Article. However, the provisions of this Article do not apply |
20 | | to a member of the armed forces who is employed as a teacher of |
21 | | subjects in the Reserve Officers' Training Corps of any school, |
22 | | nor to an individual teaching a dual credit course as provided |
23 | | for in the Dual Credit Quality Act. |
24 | | (e) Notwithstanding any other provision of this Code, the |
25 | | school board of a school district may grant to a teacher of the |
26 | | district a leave of absence with full pay for a period of not |

1 | | more than one year to permit the teacher to teach in a foreign |
2 | | state under the provisions of the Exchange Teacher Program |
3 | | established under Public Law 584, 79th Congress, and Public Law |
4 | | 402, 80th Congress, as amended. The school board granting the |
5 | | leave of absence may employ, with or without pay, a national of |
6 | | the foreign state wherein the teacher on the leave of absence |
7 | | is to teach if the national is qualified to teach in that |
8 | | foreign state and if that national is to teach in a grade level |
9 | | similar to the one that was taught in the foreign state. The |
10 | | State Board of Education, in consultation with the State |
11 | | Educator Preparation and Licensure Board, may adopt rules as |
12 | | may be necessary to implement this subsection (e).
|
13 | | (f) No person shall be denied a license issued under this |
14 | | Article solely based on his or her citizenship status or |
15 | | immigration status. The General Assembly finds and declares |
16 | | that this subsection (f) is a State law within the meaning of |
17 | | subsection (d) of Section 1621 of Title 8 of the United States |
18 | | Code. Nothing in this subsection shall affect the requirements |
19 | | to obtain a license that are not directly related to |
20 | | citizenship status or immigration status. Nothing in this |
21 | | subsection shall be construed to grant eligibility for |
22 | | obtaining any public benefit other than a license issued under |
23 | | this Article. |
24 | | (g) A candidate enrolled in a teacher preparation program |
25 | | must receive a letter grade of at least a "C", or its |
26 | | equivalent, in his or her student teaching program to obtain an |

4 | | (105 ILCS 5/21B-20) |
5 | | Sec. 21B-20. Types of licenses. The State Board of |
6 | | Education shall implement a system of educator licensure, |
7 | | whereby individuals employed in school districts who are |
8 | | required to be licensed must have one of the following |
9 | | licenses: (i) a professional educator license; (ii) an educator |
10 | | license with stipulations; (iii) a substitute teaching |
11 | | license; or (iv) until June 30, 2023, a short-term substitute |
12 | | teaching license. References in law regarding individuals |
13 | | certified or certificated or required to be certified or |
14 | | certificated under Article 21 of this Code shall also include |
15 | | individuals licensed or required to be licensed under this |
16 | | Article. The first year of all licenses ends on June 30 |
17 | | following one full year of the license being issued. |
18 | | The State Board of Education, in consultation with the |
19 | | State Educator Preparation and Licensure Board, may adopt such |
20 | | rules as may be necessary to govern the requirements for |
21 | | licenses and endorsements under this Section. |
22 | | (1) Professional Educator License. Persons who (i) |
23 | | have successfully completed an approved educator |
24 | | preparation program and are recommended for licensure by |
25 | | the Illinois institution offering the educator preparation |

1 | | program, (ii) have successfully completed the required |
2 | | testing under Section 21B-30 of this Code, (iii) have |
3 | | successfully completed coursework on the psychology of, |
4 | | the identification of, and the methods of instruction for |
5 | | the exceptional child, including without limitation |
6 | | children with learning disabilities, (iv) have |
7 | | successfully completed coursework in methods of reading |
8 | | and reading in the content area, and (v) have met all other |
9 | | criteria established by rule of the State Board of |
10 | | Education shall be issued a Professional Educator License. |
11 | | All Professional Educator Licenses are valid until June 30 |
12 | | immediately following 5 years of the license being issued. |
13 | | The Professional Educator License shall be endorsed with |
14 | | specific areas and grade levels in which the individual is |
15 | | eligible to practice. |
16 | | Individuals can receive subsequent endorsements on the |
17 | | Professional Educator License. Subsequent endorsements |
18 | | shall require a minimum of 24 semester hours of coursework |
19 | | in the endorsement area and passage of the applicable |
20 | | content area test , unless otherwise specified by rule. |
21 | | (2) Educator License with Stipulations. An Educator |
22 | | License with Stipulations shall be issued an endorsement |
23 | | that limits the license holder to one particular position |
24 | | or does not require completion of an approved educator |
25 | | program or both. |
26 | | An individual with an Educator License with |

|
1 | | Stipulations must not be employed by a school district or |
2 | | any other entity to replace any presently employed teacher |
3 | | who otherwise would not be replaced for any reason. |
4 | | An Educator License with Stipulations may be issued |
5 | | with the following endorsements: |
6 | | (A) (Blank). A A provisional educator endorsement |
7 | | for a service member or a spouse of a service member is |
8 | | valid until June 30 immediately following 3 years of |
9 | | the license being issued, provided that any remaining |
10 | | testing and coursework deficiencies are met under this |
11 | | Section. In this Section, "spouse of a service member" |
12 | | means any person who, at the time of application under |
13 | | this Section, is the spouse of an active duty member of |
14 | | the United States Armed Forces or any reserve component |
15 | | of the United States Armed Forces or the National Guard |
16 | | of any state, commonwealth, or territory of the United |
17 | | States or the District of Columbia. |
18 | | Except as otherwise provided under this |
19 | | subparagraph, a |
20 | | (B) Alternative provisional educator. An |
21 | | alternative provisional educator endorsement on an |
22 | | Educator License with Stipulations may be issued to an |
23 | | applicant who, at the time of applying for the |
24 | | endorsement, has done all of the following: |
25 | | (i) Graduated from a regionally accredited |
26 | | college or university with a minimum of a |

|
1 | | bachelor's degree. |
2 | | (ii) Successfully completed the first phase of |
3 | | the Alternative Educator Licensure Program for |
4 | | Teachers, as described in Section 21B-50 of this |
5 | | Code. |
6 | | (iii) (Blank). Passed a test of basic skills |
7 | | and content area test, as required under Section |
8 | | 21B-30 of this Code. |
9 | | The alternative provisional educator endorsement is |
10 | | valid for 2 years of teaching and may be renewed for a |
11 | | third year by an individual meeting the requirements set |
12 | | forth in Section 21B-50 of this Code. |
13 | | (C) Alternative provisional superintendent. An |
14 | | alternative provisional superintendent endorsement on |
15 | | an Educator License with Stipulations entitles the |
16 | | holder to serve only as a superintendent or assistant |
17 | | superintendent in a school district's central office. |
18 | | This endorsement may only be issued to an applicant |
19 | | who, at the time of applying for the endorsement, has |
20 | | done all of the following: |
21 | | (i) Graduated from a regionally accredited |
22 | | college or university with a minimum of a master's |
23 | | degree in a management field other than education. |
24 | | (ii) Been employed for a period of at least 5 |
25 | | years in a management level position in a field |
26 | | other than education. |

1 | | (iii) Successfully completed the first phase |
2 | | of an alternative route to superintendent |
3 | | endorsement program, as provided in Section 21B-55 |
4 | | of this Code. |
5 | | (iv) (Blank). Passed a test of basic skills and |
6 | | content area tests required under Section 21B-30 |
7 | | of this Code. |
8 | | The endorsement is valid for 2 fiscal years in |
9 | | order to complete one full year of serving as a |
10 | | superintendent or assistant superintendent. |
11 | | (D) (Blank). |
12 | | (E) Career and technical educator. A career and |
13 | | technical educator endorsement on an Educator License |
14 | | with Stipulations may be issued to an applicant who has |
15 | | a minimum of 60 semester hours of coursework from a |
16 | | regionally accredited institution of higher education |
17 | | or an accredited trade and technical institution and |
18 | | has a minimum of 2,000 hours of experience outside of |
19 | | education in each area to be taught. |
20 | | The career and technical educator endorsement on |
21 | | an Educator License with Stipulations is valid until |
22 | | June 30 immediately following 5 years of the |
23 | | endorsement being issued and may be renewed. For |
24 | | individuals who were issued the career and technical |
25 | | educator endorsement on an Educator License with |
26 | | Stipulations on or after January 1, 2015, the license |

1 | | may be renewed if the individual passes a test of basic |
2 | | skills or test of work proficiency, as required under |
3 | | Section 21B-30 of this Code. |
4 | | An individual who holds a valid career and |
5 | | technical educator endorsement on an Educator License |
6 | | with Stipulations but does not hold a bachelor's degree |
7 | | may substitute teach in career and technical education |
8 | | classrooms. |
9 | | (F) Part-time provisional career and technical |
10 | | educator or provisional career and technical educator. |
11 | | A part-time provisional career and technical educator |
12 | | endorsement or a provisional career and technical |
13 | | educator endorsement on an Educator License with |
14 | | Stipulations may be issued to an applicant who has a |
15 | | minimum of 8,000 hours of work experience in the skill |
16 | | for which the applicant is seeking the endorsement. It |
17 | | is the responsibility of each employing school board |
18 | | and regional office of education to provide |
19 | | verification, in writing, to the State Superintendent |
20 | | of Education at the time the application is submitted |
21 | | that no qualified teacher holding a Professional |
22 | | Educator License or an Educator License with |
23 | | Stipulations with a career and technical educator |
24 | | endorsement is available and that actual circumstances |
25 | | require such issuance. |
26 | | The provisional career and technical educator |

1 | | endorsement on an Educator License with Stipulations |
2 | | is valid until June 30 immediately following 5 years of |
3 | | the endorsement being issued and may be renewed for 5 |
4 | | years. For individuals who were issued the provisional |
5 | | career and technical educator endorsement on an |
6 | | Educator License with Stipulations on or after January |
7 | | 1, 2015, the license may be renewed if the individual |
8 | | passes a test of basic skills or test of work |
9 | | proficiency, as required under Section 21B-30 of this |
10 | | Code. |
11 | | A part-time provisional career and technical |
12 | | educator endorsement on an Educator License with |
13 | | Stipulations may be issued for teaching no more than 2 |
14 | | courses of study for grades 6 through 12. The part-time |
15 | | provisional career and technical educator endorsement |
16 | | on an Educator License with Stipulations is valid until |
17 | | June 30 immediately following 5 years of the |
18 | | endorsement being issued and may be renewed for 5 years |
19 | | if the individual makes application for renewal. |
20 | | An individual who holds a provisional or part-time |
21 | | provisional career and technical educator endorsement |
22 | | on an Educator License with Stipulations but does not |
23 | | hold a bachelor's degree may substitute teach in career |
24 | | and technical education classrooms. |
25 | | (G) Transitional bilingual educator. A |
26 | | transitional bilingual educator endorsement on an |

|
1 | | Educator License with Stipulations may be issued for |
2 | | the purpose of providing instruction in accordance |
3 | | with Article 14C of this Code to an applicant who |
4 | | provides satisfactory evidence that he or she meets all |
5 | | of the following requirements: |
6 | | (i) Possesses adequate speaking, reading, and |
7 | | writing ability in the language other than English |
8 | | in which transitional bilingual education is |
9 | | offered. |
10 | | (ii) Has the ability to successfully |
11 | | communicate in English. |
12 | | (iii) Either possessed, within 5 years |
13 | | previous to his or her applying for a transitional |
14 | | bilingual educator endorsement, a valid and |
15 | | comparable teaching certificate or comparable |
16 | | authorization issued by a foreign country or holds |
17 | | a degree from an institution of higher learning in |
18 | | a foreign country that the State Educator |
19 | | Preparation and Licensure Board determines to be |
20 | | the equivalent of a bachelor's degree from a |
21 | | regionally accredited institution of higher |
22 | | learning in the United States. |
23 | | A transitional bilingual educator endorsement |
24 | | shall be valid for prekindergarten through grade 12, is |
25 | | valid until June 30 immediately following 5 years of |
26 | | the endorsement being issued, and shall not be renewed. |

|
1 | | Persons holding a transitional bilingual educator |
2 | | endorsement shall not be employed to replace any |
3 | | presently employed teacher who otherwise would not be |
4 | | replaced for any reason. |
5 | | (H) Language endorsement. In an effort to |
6 | | alleviate the shortage of teachers speaking a language |
7 | | other than English in the public schools, an individual |
8 | | who holds an Educator License with Stipulations may |
9 | | also apply for a language endorsement, provided that |
10 | | the applicant provides satisfactory evidence that he |
11 | | or she meets all of the following requirements: |
12 | | (i) Holds a transitional bilingual |
13 | | endorsement. |
14 | | (ii) (Blank). Has demonstrated proficiency in |
15 | | the language for which the endorsement is to be |
16 | | issued by passing the applicable language content |
17 | | test required by the State Board of Education. |
18 | | (iii) Holds a bachelor's degree or higher from |
19 | | a regionally accredited institution of higher |
20 | | education or, for individuals educated in a |
21 | | country other than the United States, holds a |
22 | | degree from an institution of higher learning in a |
23 | | foreign country that the State Educator |
24 | | Preparation and Licensure Board determines to be |
25 | | the equivalent of a bachelor's degree from a |
26 | | regionally accredited institution of higher |

|
1 | | learning in the United States. |
2 | | (iv) (Blank). Has passed a test of basic |
3 | | skills, as required under Section 21B-30 of this |
4 | | Code. |
5 | | A language endorsement on an Educator License with |
6 | | Stipulations is valid for prekindergarten through |
7 | | grade 12 for the same validity period as the |
8 | | individual's transitional bilingual educator |
9 | | endorsement on the Educator License with Stipulations |
10 | | and shall not be renewed. |
11 | | (I) Visiting international educator. A visiting |
12 | | international educator endorsement on an Educator |
13 | | License with Stipulations may be issued to an |
14 | | individual who is being recruited by a particular |
15 | | school district that conducts formal recruitment |
16 | | programs outside of the United States to secure the |
17 | | services of qualified teachers and who meets all of the |
18 | | following requirements: |
19 | | (i) Holds the equivalent of a minimum of a |
20 | | bachelor's degree issued in the United States. |
21 | | (ii) Has been prepared as a teacher at the |
22 | | grade level for which he or she will be employed. |
23 | | (iii) Has adequate content knowledge in the |
24 | | subject to be taught. |
25 | | (iv) Has an adequate command of the English |
26 | | language. |

|
1 | | A holder of a visiting international educator |
2 | | endorsement on an Educator License with Stipulations |
3 | | shall be permitted to teach in bilingual education |
4 | | programs in the language that was the medium of |
5 | | instruction in his or her teacher preparation program, |
6 | | provided that he or she passes the English Language |
7 | | Proficiency Examination or another test of writing |
8 | | skills in English identified by the State Board of |
9 | | Education, in consultation with the State Educator |
10 | | Preparation and Licensure Board. |
11 | | A visiting international educator endorsement on |
12 | | an Educator License with Stipulations is valid for 3 |
13 | | years and shall not be renewed. |
14 | | (J) Paraprofessional educator. A paraprofessional |
15 | | educator endorsement on an Educator License with |
16 | | Stipulations may be issued to an applicant who holds a |
17 | | high school diploma or its recognized equivalent and |
18 | | either holds an associate's degree or a minimum of 60 |
19 | | semester hours of credit from a regionally accredited |

16 | | (N) Special education area. A special education |

18 | | Stipulations may be issued as defined and specified by |

20 | | (3) Substitute Teaching License. A Substitute Teaching |
21 | | License may be issued to qualified applicants for |
22 | | substitute teaching in all grades of the public schools, |
23 | | prekindergarten through grade 12. Substitute Teaching |
24 | | Licenses are not eligible for endorsements. Applicants for |
25 | | a Substitute Teaching License must hold a bachelor's degree |
26 | | or higher from a regionally accredited institution of |

2 | | Substitute Teaching Licenses are valid for 5 years. |
3 | | Substitute Teaching Licenses are valid for substitute |
4 | | teaching in every county of this State. If an individual |
5 | | has had his or her Professional Educator License or |
6 | | Educator License with Stipulations suspended or revoked, |
7 | | then that individual is not eligible to obtain a Substitute |
8 | | Teaching License. |
9 | | A substitute teacher may only teach in the place of a |
10 | | licensed teacher who is under contract with the employing |
11 | | board. If, however, there is no licensed teacher under |
12 | | contract because of an emergency situation, then a district |
13 | | may employ a substitute teacher for no longer than 30 |
14 | | calendar days per each vacant position in the district if |
15 | | the district notifies the appropriate regional office of |
16 | | education within 5 business days after the employment of |
17 | | the substitute teacher in the emergency situation. An |
18 | | emergency situation is one in which an unforeseen vacancy |
19 | | has occurred and (i) a teacher is unable to fulfill his or |
20 | | her contractual duties or (ii) teacher capacity needs of |
21 | | the district exceed previous indications, and the district |
22 | | is actively engaged in advertising to hire a fully licensed |
23 | | teacher for the vacant position. |
24 | | There is no limit on the number of days that a |
25 | | substitute teacher may teach in a single school district, |
26 | | provided that no substitute teacher may teach for longer |

1 | | than 90 school days for any one licensed teacher under |
2 | | contract in the same school year. A substitute teacher who |
3 | | holds a Professional Educator License or Educator License |
4 | | with Stipulations shall not teach for more than 120 school |
5 | | days for any one licensed teacher under contract in the |
6 | | same school year. The limitations in this paragraph (3) on |
7 | | the number of days a substitute teacher may be employed do |
8 | | not apply to any school district operating under Article 34 |
9 | | of this Code. |
10 | | A school district may not require an individual who |
11 | | holds a valid Professional Educator License or Educator |
12 | | License with Stipulations to seek or hold a Substitute |
13 | | Teaching License to teach as a substitute teacher. |
14 | | (4) Short-Term Substitute Teaching License. Beginning |
15 | | on July 1, 2018 and until June 30, 2023, the State Board of |
16 | | Education may issue a Short-Term Substitute Teaching |
17 | | License. A Short-Term Substitute Teaching License may be |
18 | | issued to a qualified applicant for substitute teaching in |
19 | | all grades of the public schools, prekindergarten through |
20 | | grade 12. Short-Term Substitute Teaching Licenses are not |
21 | | eligible for endorsements. Applicants for a Short-Term |
22 | | Substitute Teaching License must hold an associate's |
23 | | degree or have completed at least 60 credit hours from a |
24 | | regionally accredited institution of higher education. |
25 | | Short-Term Substitute Teaching Licenses are valid for |
26 | | substitute teaching in every county of this State. If an |

10 | | absences lasting 6 or more days per licensed teacher who is |

6 | | teaching standards, as determined by the State Board of |
7 | | Education, in consultation with the State Educator Preparation |
8 | | and Licensure Board. The State Board of Education may adopt |
9 | | such rules as may be necessary to implement and administer this |
10 | | Section. |
11 | | (c) (Blank). Except as otherwise provided in this Article, |
12 | | applicants seeking a Professional Educator License or an |
13 | | Educator License with Stipulations shall be required to pass a |
14 | | test of basic skills before the license is issued, unless the |
15 | | endorsement the individual is seeking does not require passage |
16 | | of the test. All applicants completing Illinois-approved, |
17 | | teacher education or school service personnel preparation |
18 | | programs shall be required to pass the State Board of |
19 | | Education's recognized test of basic skills prior to starting |
20 | | their student teaching or starting the final semester of their |
21 | | internship. An institution of higher learning, as defined in |
22 | | the Higher Education Student Assistance Act, may not require an |
23 | | applicant to complete the State Board's recognized test of |
24 | | basic skills prior to the semester before student teaching or |
25 | | prior to the semester before starting the final semester of an |
26 | | internship. An individual who passes a test of basic skills |

2 | | other educator licenses. |
3 | | (d) (Blank). All applicants seeking a State license shall |
4 | | be required to pass a test of content area knowledge for each |
5 | | area of endorsement for which there is an applicable test. |
6 | | There shall be no exception to this requirement. No candidate |
7 | | shall be allowed to student teach or serve as the teacher of |
8 | | record until he or she has passed the applicable content area |
9 | | test. |
10 | | (e) (Blank). |
11 | | (f) Except as otherwise provided in this Article, beginning |
12 | | on September 1, 2015, all candidates completing teacher |
13 | | preparation programs in this State and all candidates subject |
14 | | to Section 21B-35 of this Code are required to pass a teacher |
15 | | performance assessment approved by the State Board of |
16 | | Education, in consultation with the State Educator Preparation |
17 | | and Licensure Board. |
18 | | (g) The Tests of basic skills and content area knowledge |
19 | | and the teacher performance assessment shall be a test the |
20 | | tests that from time to time is are designated by the State |
21 | | Board of Education, in consultation with the State Educator |
22 | | Preparation and Licensure Board, and may be a test tests |
23 | | prepared by an educational testing organization or a test tests |
24 | | designed by the State Board of Education, in consultation with |
25 | | the State Educator Preparation and Licensure Board. The areas |
26 | | to be covered by a test of basic skills shall include reading, |

1 | | language arts, and mathematics. The test of content area |
2 | | knowledge shall assess content knowledge in a specific subject |
3 | | field. The test tests must be designed to be racially neutral |
4 | | to ensure that no person taking the test tests is discriminated |
5 | | against on the basis of race, color, national origin, or other |
6 | | factors unrelated to the person's ability to perform as a |
7 | | licensed employee. The score required to pass the test tests |
8 | | shall be fixed by the State Board of Education, in consultation |
9 | | with the State Educator Preparation and Licensure Board. The |
10 | | test tests shall be administered not fewer than 3 times a year |
11 | | at such time and place as may be designated by the State Board |
12 | | of Education, in consultation with the State Educator |
13 | | Preparation and Licensure Board. |
14 | | The State Board shall implement a test or tests to assess |
15 | | the speaking, reading, writing, and grammar skills of |
16 | | applicants for an endorsement or a license issued under |
17 | | subdivision (G) of paragraph (2) of Section 21B-20 of this Code |
18 | | in the English language and in the language of the transitional |
19 | | bilingual education program requested by the applicant. |
20 | | (h) Except as provided in Section 34-6 of this Code, the |
21 | | provisions of this Section shall apply equally in any school |
22 | | district subject to Article 34 of this Code. |
23 | | (i) The rules developed to implement and enforce the |
24 | | testing requirements under this Section shall include without |
25 | | limitation provisions governing test selection, test |
26 | | validation and determination of a passing score, |

3 | | (a) There is established an alternative educator licensure |
4 | | program, to be known as the Alternative Educator Licensure |
5 | | Program for Teachers. |
6 | | (b) The Alternative Educator Licensure Program for |
7 | | Teachers may be offered by a recognized institution approved to |
8 | | offer educator preparation programs by the State Board of |
9 | | Education, in consultation with the State Educator Preparation |
10 | | and Licensure Board. |
11 | | The program shall be comprised of 4 phases: |
12 | | (1) A course of study that at a minimum includes |
13 | | instructional planning; instructional strategies, |
14 | | including special education, reading, and English language |
15 | | learning; classroom management; and the assessment of |
16 | | students and use of data to drive instruction. |
17 | | (2) A year of residency, which is a candidate's |
18 | | assignment to a full-time teaching position or as a |
19 | | co-teacher for one full school year. An individual must |
20 | | hold an Educator License with Stipulations with an |
21 | | alternative provisional educator endorsement in order to |
22 | | enter the residency and must complete additional program |
23 | | requirements that address required State and national |
24 | | standards, pass the assessment of professional teaching |
25 | | before entering the second residency year, as required |
26 | | under phase (3) of this subsection (b), and be recommended |

1 | | by the principal or qualified equivalent of a principal, as |
2 | | required under subsection (d) of this Section, and the |
3 | | program coordinator to continue with the second year of the |
4 | | residency. |
5 | | (3) A second year of residency, which shall include the |
6 | | candidate's assignment to a full-time teaching position |
7 | | for one school year. The candidate must be assigned an |
8 | | experienced teacher to act as a mentor and coach the |
9 | | candidate through the second year of residency. |
10 | | (4) A comprehensive assessment of the candidate's |
11 | | teaching effectiveness, as evaluated by the principal or |
12 | | qualified equivalent of a principal, as required under |
13 | | subsection (d) of this Section, and the program |
14 | | coordinator, at the end of the second year of residency. If |
15 | | there is disagreement between the 2 evaluators about the |
16 | | candidate's teaching effectiveness, the candidate may |
17 | | complete one additional year of residency teaching under a |
18 | | professional development plan developed by the principal |
19 | | or qualified equivalent and the preparation program. At the |
20 | | completion of the third year, a candidate must have |
21 | | positive evaluations and a recommendation for full |
22 | | licensure from both the principal or qualified equivalent |
23 | | and the program coordinator or no Professional Educator |
24 | | License shall be issued. |
25 | | Successful completion of the program shall be deemed to |
26 | | satisfy any other practice or student teaching and content |

1 | | matter requirements established by law. |
2 | | (c) An alternative provisional educator endorsement on an |
3 | | Educator License with Stipulations is valid for 2 years of |
4 | | teaching in the public schools, including without limitation a |
5 | | preschool educational program under Section 2-3.71 of this Code |
6 | | or charter school, or in a State-recognized nonpublic school in |
7 | | which the chief administrator is required to have the licensure |
8 | | necessary to be a principal in a public school in this State |
9 | | and in which a majority of the teachers are required to have |
10 | | the licensure necessary to be instructors in a public school in |
11 | | this State, but may be renewed for a third year if needed to |
12 | | complete the Alternative Educator Licensure Program for |
13 | | Teachers. The endorsement shall be issued only once to an |
14 | | individual who meets all of the following requirements: |
15 | | (1) Has graduated from a regionally accredited college |
16 | | or university with a bachelor's degree or higher. |
17 | | (2) Has a cumulative grade point average of 3.0 or |
18 | | greater on a 4.0 scale or its equivalent on another scale. |
19 | | (3) Has completed a major in the content area if |
20 | | seeking a middle or secondary level endorsement or, if |
21 | | seeking an early childhood, elementary, or special |
22 | | education endorsement, has completed a major in the content |
23 | | area of reading, English/language arts, mathematics, or |
24 | | one of the sciences. If the individual does not have a |
25 | | major in a content area for any level of teaching, he or |
26 | | she must submit transcripts to the State Board of Education |

1 | | to be reviewed for equivalency. |
2 | | (4) Has successfully completed phase (1) of subsection |
3 | | (b) of this Section. |
4 | | (5) (Blank). Has passed a test of basic skills and |
5 | | content area test required for the specific endorsement for |
6 | | admission into the program, as required under Section |
7 | | 21B-30 of this Code. |
8 | | A candidate possessing the alternative provisional |
9 | | educator endorsement may receive a salary, benefits, and any |
10 | | other terms of employment offered to teachers in the school who |
11 | | are members of an exclusive bargaining representative, if any, |
12 | | but a school is not required to provide these benefits during |
13 | | the years of residency if the candidate is serving only as a |
14 | | co-teacher. If the candidate is serving as the teacher of |
15 | | record, the candidate must receive a salary, benefits, and any |
16 | | other terms of employment. Residency experiences must not be |
17 | | counted towards tenure. |
18 | | (d) The recognized institution offering the Alternative |
19 | | Educator Licensure Program for Teachers must partner with a |
20 | | school district, including without limitation a preschool |
21 | | educational program under Section 2-3.71 of this Code or |
22 | | charter school, or a State-recognized, nonpublic school in this |
23 | | State in which the chief administrator is required to have the |
24 | | licensure necessary to be a principal in a public school in |
25 | | this State and in which a majority of the teachers are required |
26 | | to have the licensure necessary to be instructors in a public |

1 | | school in this State. A recognized institution that partners |
2 | | with a public school district administering a preschool |
3 | | educational program under Section 2-3.71 of this Code must |
4 | | require a principal to recommend or evaluate candidates in the |
5 | | program. A recognized institution that partners with an |
6 | | eligible entity administering a preschool educational program |
7 | | under Section 2-3.71 of this Code and that is not a public |
8 | | school district must require a principal or qualified |
9 | | equivalent of a principal to recommend or evaluate candidates |
10 | | in the program. The program presented for approval by the State |
11 | | Board of Education must demonstrate the supports that are to be |
12 | | provided to assist the provisional teacher during the 2-year |
13 | | residency period. These supports must provide additional |
14 | | contact hours with mentors during the first year of residency. |
15 | | (e) Upon completion of the 4 phases outlined in subsection |
16 | | (b) of this Section and all assessments required under Section |
17 | | 21B-30 of this Code, an individual shall receive a Professional |
18 | | Educator License. |
19 | | (f) The State Board of Education, in consultation with the |
20 | | State Educator Preparation and Licensure Board, may adopt such |
21 | | rules as may be necessary to establish and implement the |
22 | | Alternative Educator Licensure Program for Teachers.

1 | | Sec. 21B-55. Alternative route to superintendent |
2 | | endorsement. |
3 | | (a) The State Board of Education, in consultation with the |
4 | | State Educator Preparation and Licensure Board, may approve |
5 | | programs designed to provide an alternative route to |
6 | | superintendent endorsement on a Professional Educator License. |
7 | | (b) Entities offering an alternative route to |
8 | | superintendent endorsement program must have the program |
9 | | approved by the State Board of Education, in consultation with |
10 | | the State Educator Preparation and Licensure Board. |
11 | | (c) All programs approved under this Section shall be |
12 | | comprised of the following 3 phases: |
13 | | (1) A course of study offered on an intensive basis in |
14 | | education management, governance, organization, and |
15 | | instructional and district planning. |
16 | | (2) The person's assignment to a full-time position for |
17 | | one school year as a superintendent. |
18 | | (3) A comprehensive assessment of the person's |
19 | | performance by school officials and a recommendation to the |
20 | | State Board of Education that the person be issued a |
21 | | superintendent endorsement on a Professional Educator |
22 | | License. |
23 | | (d) In order to serve as a superintendent under phase (2) |
24 | | of subsection (c) of this Section, an individual must be issued |
25 | | an alternative provisional superintendent endorsement on an |
26 | | Educator License with Stipulations, to be valid for only one |

1 | | year of serving as a superintendent. In order to receive the |
2 | | provisional alternative superintendent endorsement under this |
3 | | Section, an individual must meet all of the following |
4 | | requirements: |
5 | | (1) Have graduated from a regionally accredited |
6 | | college or university with a minimum of a master's degree |
7 | | in a management field. |
8 | | (2) Have been employed for a period of at least 5 years |
9 | | in a management level position other than education. |
10 | | (3) Have successfully completed phase (1) of |
11 | | subsection (c) of this Section. |
12 | | (4) (Blank). Have passed a test of basic skills and a |
13 | | content area test for admission into the program, as |
14 | | required by Section 21B-30 of this Code. |
15 | | (e) Successful completion of an alternative route to |
16 | | superintendent endorsement program shall be deemed to satisfy |
17 | | any other supervisory, administrative, or management |
18 | | experience requirements established by law, and, once |
19 | | completed, an individual shall be eligible for a superintendent |
20 | | endorsement on a Professional Educator License. |
21 | | (f) The State Board of Education, in consultation with the |
22 | | State Educator Preparation and Licensure Board, may adopt such |
23 | | rules as may be needed to establish and implement these |
24 | | alternative route to superintendent endorsement programs.
