AMENDMENT TO HOUSE BILL 208

2    AMENDMENT NO. ______. Amend House Bill 208 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Critical Health Problems and Comprehensive
5Health Education Act is amended by changing Section 3 as
6follows:
 
7    (105 ILCS 110/3)
8    Sec. 3. Comprehensive Health Education Program. The
9program established under this Act shall include, but not be
10limited to, the following major educational areas as a basis
11for curricula in all elementary and secondary schools in this
12State: human ecology and health; , human growth and
13development; , the emotional, psychological, physiological,
14hygienic, and social responsibilities of family life,
15including sexual abstinence until marriage; , prevention and
16control of disease, including instruction in grades 6 through

112 on the prevention, transmission and spread of AIDS; ,
2age-appropriate sexual abuse and assault awareness and
3prevention education in grades pre-kindergarten through 12; ,
4public and environmental health; , consumer health; , safety
5education and disaster survival; , mental health and illness; ,
6personal health habits; , alcohol and , drug use, and abuse,
7including the medical and legal ramifications of alcohol, drug,
8and cannabis tobacco use; , abuse during pregnancy; ,
9evidence-based and medically accurate information regarding
10sexual abstinence; , tobacco, including the medical and legal
11ramifications of tobacco use; nutrition; , and dental health.
12The program shall also provide course material and instruction
13to advise pupils of the Abandoned Newborn Infant Protection
14Act. The program shall include information about cancer,
15including without limitation types of cancer, signs and
16symptoms, risk factors, the importance of early prevention and
17detection, and information on where to go for help.
18Notwithstanding the above educational areas, the following
19areas may also be included as a basis for curricula in all
20elementary and secondary schools in this State: basic first aid
21(including, but not limited to, cardiopulmonary resuscitation
22and the Heimlich maneuver), heart disease, diabetes, stroke,
23the prevention of child abuse, neglect, and suicide, and teen
24dating violence in grades 7 through 12. Beginning with the
252014-2015 school year, training on how to properly administer
26cardiopulmonary resuscitation (which training must be in

1accordance with standards of the American Red Cross, the
2American Heart Association, or another nationally recognized
3certifying organization) and how to use an automated external
4defibrillator shall be included as a basis for curricula in all
5secondary schools in this State.
6    The school board of each public elementary and secondary
7school in the State shall encourage all teachers and other
8school personnel to acquire, develop, and maintain the
9knowledge and skills necessary to properly administer
10life-saving techniques, including without limitation the
11Heimlich maneuver and rescue breathing. The training shall be
12in accordance with standards of the American Red Cross, the
13American Heart Association, or another nationally recognized
14certifying organization. A school board may use the services of
15non-governmental entities whose personnel have expertise in
16life-saving techniques to instruct teachers and other school
17personnel in these techniques. Each school board is encouraged
18to have in its employ, or on its volunteer staff, at least one
19person who is certified, by the American Red Cross or by
20another qualified certifying agency, as qualified to
21administer first aid and cardiopulmonary resuscitation. In
22addition, each school board is authorized to allocate
23appropriate portions of its institute or inservice days to
24conduct training programs for teachers and other school
25personnel who have expressed an interest in becoming qualified
26to administer emergency first aid or cardiopulmonary

1resuscitation. School boards are urged to encourage their
2teachers and other school personnel who coach school athletic
3programs and other extracurricular school activities to
4acquire, develop, and maintain the knowledge and skills
5necessary to properly administer first aid and cardiopulmonary
6resuscitation in accordance with standards and requirements
7established by the American Red Cross or another qualified
8certifying agency. Subject to appropriation, the State Board of
9Education shall establish and administer a matching grant
10program to pay for half of the cost that a school district
11incurs in training those teachers and other school personnel
12who express an interest in becoming qualified to administer
13cardiopulmonary resuscitation (which training must be in
14accordance with standards of the American Red Cross, the
15American Heart Association, or another nationally recognized
16certifying organization) or in learning how to use an automated
17external defibrillator. A school district that applies for a
18grant must demonstrate that it has funds to pay half of the
19cost of the training for which matching grant money is sought.
20The State Board of Education shall award the grants on a
21first-come, first-serve basis.
22    No pupil shall be required to take or participate in any
23class or course on AIDS or family life instruction or to
24receive training on how to properly administer cardiopulmonary
25resuscitation or how to use an automated external defibrillator
26if his or her parent or guardian submits written objection

1thereto, and refusal to take or participate in the course or
2program or the training shall not be reason for suspension or
3expulsion of the pupil.
4    Curricula developed under programs established in
5accordance with this Act in the major educational area of
6alcohol and drug use and abuse, including cannabis, shall
7include classroom instruction in grades 5 through 12. The
8instruction, which shall include matters relating to both the
9physical and legal effects and ramifications of drug and
10substance abuse, including cannabis, shall be integrated into
11existing curricula; and the State Board of Education shall
12develop and make available to all elementary and secondary
13schools in this State instructional materials and guidelines
14which will assist the schools in incorporating the instruction
15into their existing curricula. In addition, school districts
16may offer, as part of existing curricula during the school day
17or as part of an after school program, support services and
18instruction for pupils or pupils whose parent, parents, or
19guardians are chemically dependent.
