1 | AN ACT concerning transportation.

2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Illinois Lottery Law is amended by changing | ||||||||||||||||||||||||||||||
5 | Section 21.10 as follows: | ||||||||||||||||||||||||||||||
6 | (20 ILCS 1605/21.10) | ||||||||||||||||||||||||||||||
7 | Sec. 21.10. Scratch-off for State police memorials. | ||||||||||||||||||||||||||||||
8 | (a) The Department shall offer a special instant | ||||||||||||||||||||||||||||||
9 | scratch-off game for the benefit of State police memorials. The | ||||||||||||||||||||||||||||||
10 | game shall commence on January 1, 2019 or as soon thereafter, | ||||||||||||||||||||||||||||||
11 | at the discretion of the Director, as is reasonably practical. | ||||||||||||||||||||||||||||||
12 | The operation of the game shall be governed by this Act and any | ||||||||||||||||||||||||||||||
13 | rules adopted by the Department. If any provision of this | ||||||||||||||||||||||||||||||
14 | Section is inconsistent with any other provision of this Act, | ||||||||||||||||||||||||||||||
15 | then this Section governs. | ||||||||||||||||||||||||||||||
16 | (b) The net revenue from the State police memorials | ||||||||||||||||||||||||||||||
17 | scratch-off game shall be deposited into the Criminal Justice | ||||||||||||||||||||||||||||||
18 | Information Projects Fund and distributed equally, as soon as | ||||||||||||||||||||||||||||||
19 | practical but at least on a monthly basis, to the Chicago | ||||||||||||||||||||||||||||||
20 | Police Memorial Foundation Fund, the Police Memorial Committee | ||||||||||||||||||||||||||||||
21 | Fund, and the Illinois State Police Memorial Park Fund , and the | ||||||||||||||||||||||||||||||
22 | Peace Officers Memorial Foundation of Cook County Fund . Moneys | ||||||||||||||||||||||||||||||
23 | transferred to the funds under this Section shall be used, |

1 | subject to appropriation, to fund grants for building and | ||||||
2 | maintaining memorials and parks; holding annual memorial | ||||||
3 | commemorations; giving scholarships to children of officers | ||||||
4 | killed or catastrophically injured in the line of duty, or | ||||||
5 | those interested in pursuing a career in law enforcement; | ||||||
6 | providing financial assistance to police officers and their | ||||||
7 | families when a police officer is killed or injured in the line | ||||||
8 | of duty; and providing financial assistance to officers for the | ||||||
9 | purchase or replacement of bulletproof bullet proof vests to be | ||||||
10 | used in the line of duty. | ||||||
11 | For purposes of this subsection, "net revenue" means the | ||||||
12 | total amount for which tickets have been sold less the sum of | ||||||
13 | the amount paid out in the prizes and the actual administrative | ||||||
14 | expenses of the Department solely related to the scratch-off | ||||||
15 | game under this Section. | ||||||
16 | (c) During the time that tickets are sold for the State | ||||||
17 | police memorials scratch-off game, the Department shall not | ||||||
18 | unreasonably diminish the efforts devoted to marketing any | ||||||
19 | other instant scratch-off lottery game. | ||||||
20 | (d) The Department may adopt any rules necessary to | ||||||
21 | implement and administer the provisions of this Section.

23 | Section 10. The State Finance Act is amended by adding | ||||||
24 | Section 5.891 as follows: |

3 | County Fund. | ||||||
4 | Section 15. The Illinois Income Tax Act is amended by | ||||||
5 | changing Section 507HHH as follows: | ||||||
6 | (35 ILCS 5/507HHH) | ||||||
7 | Sec. 507HHH. Illinois Police Memorial checkoff. | ||||||
8 | (a) For taxable years ending on or after December 31, 2017, | ||||||
9 | the Department must print on its standard individual income tax | ||||||
10 | form a provision (i) indicating that if the taxpayer wishes to | ||||||
11 | contribute to the Criminal Justice Information Projects Fund, | ||||||
12 | as authorized by this amendatory Act of the 100th General | ||||||
13 | Assembly, he or she may do so by stating the amount of the | ||||||
14 | contribution (not less than $1) on the return and (ii) stating | ||||||
15 | that the contribution will reduce the taxpayer's refund or | ||||||
16 | increase the amount of payment to accompany the return. Failure | ||||||
17 | to remit any amount of increased payment shall reduce the | ||||||
18 | contribution accordingly. This Section does not apply to any | ||||||
19 | amended return. | ||||||
20 | (b) Moneys deposited into the Criminal Justice Information | ||||||
21 | Projects Fund under this Section shall be distributed equally, | ||||||
22 | as soon as practical but at least on a monthly basis, to the | ||||||
23 | Chicago Police Memorial Foundation Fund, the Police Memorial | ||||||
24 | Committee Fund, and the Illinois State Police Memorial Park |

12 | Section 20. The Illinois Vehicle Code is amended by adding | ||||||
13 | Section 3-699.17 as follows: | ||||||

15 | Sec. 3-699.17. Peace Officers Memorial Foundation of Cook | ||||||
16 | County license plates. | ||||||
17 | (a) The Secretary, upon receipt of all applicable fees and | ||||||
18 | applications made in the form prescribed by the Secretary, may | ||||||
19 | issue special registration plates designated as Peace Officers | ||||||
20 | Memorial Foundation of Cook County license plates to active or | ||||||
21 | retired Cook County peace officers and their family members, | ||||||
22 | surviving family members of deceased law enforcement officers, | ||||||
23 | and members of or donors to the Peace Officers Memorial | ||||||
24 | Foundation of Cook County. |

1 | The special plates issued under this Section shall be | ||||||
2 | affixed only to vehicles of the first division or motor | ||||||
3 | vehicles of the second division weighing not more than 8,000 | ||||||
4 | pounds. | ||||||
5 | Plates issued under this Section shall expire according to | ||||||
6 | the multi-year procedure established by Section 3-414.1 of this | ||||||
7 | Code. | ||||||
8 | (b) The design and color of the plates is wholly within the | ||||||
9 | discretion of the Secretary. The Secretary may allow the plates | ||||||
10 | to be issued as vanity plates or personalized under Section | ||||||
11 | 3-405.1 of this Code. Appropriate documentation, as determined | ||||||
12 | by the Secretary, shall accompany each application. The | ||||||
13 | Secretary shall prescribe stickers or decals as provided under | ||||||
14 | Section 3-412 of this Code. The Secretary must make a version | ||||||
15 | of the special registration plates authorized under this | ||||||
16 | Section in a form appropriate for motorcycles. | ||||||
17 | (c) An applicant for the special plate shall be charged a | ||||||
18 | $25 fee for original issuance in addition to the appropriate | ||||||
19 | registration fee. Of this fee, $10 shall be deposited into the | ||||||
20 | Peace Officers Memorial Foundation of Cook County Fund and $15 | ||||||
21 | shall be deposited into the Secretary of State Special License | ||||||
22 | Plate Fund, to be used by the Secretary to help defray the | ||||||
23 | administrative processing costs. | ||||||
24 | For each registration renewal period, a $25 fee, in | ||||||
25 | addition to the appropriate registration fee, shall be charged. | ||||||
26 | Of this fee, $23 shall be deposited into the Peace Officers |

1 | Memorial Foundation of Cook County Fund and $2 shall be | ||||||
2 | deposited into the Secretary of State Special License Plate | ||||||
3 | Fund. | ||||||
4 | (d) The Peace Officers Memorial Foundation of Cook County | ||||||
5 | Fund is created as a special fund in the State treasury. All | ||||||
6 | moneys in the Peace Officers Memorial Foundation of Cook County | ||||||
7 | Fund shall be paid, subject to appropriation by the General | ||||||
8 | Assembly and distribution by the Secretary, as grants to the | ||||||
9 | Peace Officers Memorial Foundation of Cook County for | ||||||
10 | construction or maintenance of a memorial and park, holding an | ||||||
11 | annual memorial commemoration, giving scholarships to children | ||||||
12 | of Cook County peace officers killed or catastrophically | ||||||
13 | injured in the line of duty, providing financial assistance to | ||||||
14 | Cook County peace officers and their families when a Cook | ||||||
15 | County peace officer is killed or injured in the line of duty, | ||||||
16 | and paying the insurance premiums for Cook County peace | ||||||
17 | officers who are terminally ill.
