AMENDMENT TO HOUSE BILL 191

2    AMENDMENT NO. ______. Amend House Bill 191 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the Safe
5Spaces in Public Places Act.
 
6    Section 5. Definitions. In this Act:
7    "Board" means the Board of Higher Education.
8    "Institution of higher learning" has the meaning given to
9that term under the Higher Education Student Assistance Act.
10    "Public entrance" means the main entrance to each building,
11gymnasium, or football stadium of an institution of higher
12learning. "Public entrance" does not include a service
13entrance, secondary door, or bus loading zone entrance.
 
14    Section 10. Metal detector pilot program.
15    (a) Subject to appropriation, beginning with the 2020-2021

1academic year, the Board must develop and implement a metal
2detector pilot program for each public university that includes
3the use of walk-through metal detectors at the university's
4public entrances.
5    (b) The Board of Higher Education shall, subject to
6appropriation, make grants available to each institution of
7higher learning to assist in the purchase and operation of
8walk-through metal detectors under this Act.
 
9    Section 50. The School Code is amended by adding Section
102-3.176 as follows:
 
11    (105 ILCS 5/2-3.176 new)
12    Sec. 2-3.176. Metal detector pilot program.
13    (a) In this Section, "public entrance" means the main
14entrance of a school building, gymnasium, or football stadium.
15"Public entrance" does not include a service entrance,
16secondary door, or school bus loading zone entrance.
17    (b) Subject to appropriation, beginning with the 2020-2021
18school year, the State Board of Education must develop and
19implement a metal detector pilot program for school districts
20to install and operate walk-through metal detectors at the
21public entrances of schools and at school sporting events.
22    (c) In consultation and cooperation with the State Board of
23Education, the Department of State Police shall provide
24training to school district employees in the use of

1walk-through metal detectors and the protocol for responding if
2contraband is detected with the use of a walk-through metal
3detector.
4    (d) The State Board of Education shall, subject to
5appropriation, make grants available to a school district to
6assist in the purchase and operation of walk-through metal
7detectors under this Section.
 
8    Section 55. The Hospital Licensing Act is amended by adding
9Section 7.7 as follows:
 
10    (210 ILCS 85/7.7 new)
11    Sec. 7.7. Metal detectors required.
12    (a) In this Section, "point of entry" means an entrance
13accessible to the public. "Point of entry" does not include an
14ambulance entrance.
15    (b) Beginning on January 1, 2020, a hospital licensed under
16this Act shall implement and maintain a security screening
17program for the use of walk-through metal detectors at the
18hospital's points of entry to secure those entrances.
 
19    Section 99. Effective date. This Act takes effect upon
20becoming law.".
