Creates the Safe Spaces in Public Places Act. Defines terms. Provides that beginning with the 2020-2021 academic year, each institution of higher learning must install and operate a walk-through metal detector at each public entrance of the institution and during any special event on any campus of the institution if more than 1,000 people are present at the event. Amends the Officers and Employees Article of the Counties Code. Provides that as part of his or her duty to maintain the security of a courthouse, a sheriff shall maintain a walk-through metal detector at each point of entry into the courthouse. Provides that a courthouse shall ensure that all members of the public, other than employees of the county or individuals who display proper credentials, who enter the courthouse at a point of entry are subjected to screening by a walk-through metal detector. Amends the School Code. Provides that beginning with the 2020-2021 school year, a school board shall require each school under its authority to install and operate a walk-through metal detector at all public entrances of the school. Amends the Hospital Licensing Act. Provides that a hospital shall maintain a metal detector at each point of entry into the hospital; defines "point of entry". Provides that a hospital shall ensure that all members of the public, other than the employees of the hospital who display proper credentials, who enter the hospital at a point of entry are subjected to screening by a metal detector. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 1. Short title. This Act may be cited as the Safe |
5 | | Spaces in Public Places Act. |
6 | | Section 5. Definitions. In this Act: |
7 | | "Institution of higher learning" or "institution" has the |
8 | | meaning given to that term under the Higher Education Student |
9 | | Assistance Act. |
10 | | "Public entrance" means the main entrance to each building, |
11 | | gymnasium, or football stadium of an institution of higher |
12 | | learning. "Public entrance" does not include a service |
13 | | entrance, secondary door, or bus loading zone entrance. |
14 | | Section 10. Metal detectors required. |
15 | | (a) Beginning with the 2020-2021 academic year, each |
16 | | institution of higher learning must install and operate a |
17 | | walk-through metal detector at each public entrance of the |
18 | | institution and at all entrances open to the public during any |
19 | | special event on any campus of the institution if more than |
20 | | 1,000 people are present at the event. |
21 | | (b) In consultation and cooperation with the Board of |
22 | | Higher Education, the Department of State Police shall provide |

2 | | walk-through metal detectors and the protocol for responding if |
3 | | contraband is detected with the use of a walk-through metal |
4 | | detector. |
5 | | (c) The Board of Higher Education shall, subject to |
6 | | appropriation, make grants available to each institution of |
7 | | higher learning to assist in the purchase and operation of |
8 | | walk-through metal detectors under this Act. |
9 | | Section 50. The Counties Code is amended by changing |
10 | | Section 3-6023 as follows:

13 | | Sec. 3-6023. Attendance at courts. Each sheriff shall, in |

all courts held in his or her |

orders and |
17 | | directions of the court, and shall maintain the security of the

18 | | courthouse. As part of this duty, the sheriff shall maintain a |
19 | | walk-through metal detector at each point of entry into the |
20 | | courthouse. A courthouse
shall ensure that all members of the |
21 | | public, other than employees of the county or individuals who |
22 | | display proper credentials, who enter the courthouse at a point |
23 | | of entry are subjected to screening by a walk-through metal |
24 | | detector. Court services customarily performed by sheriffs |

by the sheriff or his or her deputies, county |
2 | | corrections officers, or
court security officers, rather than |
3 | | by employees of the court, unless there
are no deputies, county |
4 | | corrections officers, or court security officers
available to |
5 | | perform such services. The expenses of the sheriff in carrying
|
6 | | out his or her duties under this Section, including the |
7 | | compensation of
deputies, county corrections officers, or |
8 | | court security officers assigned
to such services, shall be |
9 | | paid to the county from fees collected pursuant to
court order |
10 | | for services of the sheriff and from any court services fees
|
11 | | collected by the county pursuant to Section 5-1103, as now or |
12 | | hereafter
amended ; except that the Department of State Police |
13 | | shall, subject to appropriation, make grants available to |
14 | | assist in the purchase and operation of walk-through metal |
15 | | detectors .

22 | | 10-20.69 and 34-18.61 as follows: |

1 | | Section 60. The Hospital Licensing Act is amended by adding |
2 | | Section 7.7 as follows: |
3 | | (210 ILCS 85/7.7 new) |
4 | | Sec. 7.7. Metal detectors required. |
5 | | (a) In this Section, "point of entry" means an entrance |
6 | | accessible to the public. "Point of entry" does not include an |
7 | | ambulance entrance. |
8 | | (b) A hospital licensed under this Act shall maintain a |
9 | | metal detector at each point of entry into the hospital. A |
10 | | hospital shall ensure that all members of the public, other |
11 | | than the employees of the hospital who display proper |
12 | | credentials, who enter the hospital at a point of entry are |
13 | | subjected to screening by a metal detector. Individuals subject |
14 | | to screening under this Section shall include, but not be |
15 | | limited to, individuals in wheelchairs. |
16 | | Section 95. No acceleration or delay. Where this Act makes |
17 | | changes in a statute that is represented in this Act by text |
18 | | that is not yet or no longer in effect (for example, a Section |
19 | | represented by multiple versions), the use of that text does |
20 | | not accelerate or delay the taking effect of (i) the changes |
21 | | made by this Act or (ii) provisions derived from any other |
22 | | Public Act.

23 | | Section 99. Effective date. This Act takes effect upon |
24 | | becoming law.
