1 | AN ACT concerning education.
| ||||||||||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||||
3 | represented in the General Assembly:
| ||||||||||||||||||||||||||
4 | Section 5. The School Code is amended by adding Sections | ||||||||||||||||||||||||||
5 | 10-20.69 and 34-18.61 as follows: | ||||||||||||||||||||||||||
6 | (105 ILCS 5/10-20.69 new) | ||||||||||||||||||||||||||
7 | Sec. 10-20.69. Academic support; at-risk student. | ||||||||||||||||||||||||||
8 | (a) In this Section, "at-risk student" means a student who | ||||||||||||||||||||||||||
9 | meets any of the following: | ||||||||||||||||||||||||||
10 | (1) He or she has failed 2 or more classes in the | ||||||||||||||||||||||||||
11 | immediately preceding school semester. | ||||||||||||||||||||||||||
12 | (2) He or she is experiencing a decline in his or her | ||||||||||||||||||||||||||
13 | grade point average of more than 2 points on a 4.0 scale, | ||||||||||||||||||||||||||
14 | or its equivalent on another scale, compared to the | ||||||||||||||||||||||||||
15 | immediately preceding school semester. | ||||||||||||||||||||||||||
16 | (3) He or she is a chronic truant, as defined under | ||||||||||||||||||||||||||
17 | Section 26-2a of this Code. | ||||||||||||||||||||||||||
18 | (4) He or she has been suspended more than 3 times from | ||||||||||||||||||||||||||
19 | a school pursuant to Section 10-22.6 or 34-19 of this Code. | ||||||||||||||||||||||||||
20 | (5) He or she is homeless or at-risk of becoming | ||||||||||||||||||||||||||
21 | homeless. | ||||||||||||||||||||||||||
22 | (6) He or she is under the legal custody of the | ||||||||||||||||||||||||||
23 | Department of Children and Family Services. |

1 | (7) He or she is the subject of an investigation | ||||||
2 | conducted by the Department of Children and Family | ||||||
3 | Services. | ||||||
4 | (8) He or she displays recurring violent behaviors, | ||||||
5 | including, but not limited to, fighting or threatening | ||||||
6 | other students or school personnel. | ||||||
7 | (b) Beginning with the 2019-2020 school year, a school | ||||||
8 | board shall require its schools to connect at-risk students in | ||||||
9 | need of academic support to either community-based or in-school | ||||||
10 | academic support. The academic support may include, but is not | ||||||
11 | limited to, any of the following: | ||||||
12 | (1) Individual or small-group tutoring. | ||||||
13 | (2) A summer school program. | ||||||
14 | (3) A mentoring program. | ||||||
15 | (4) An evaluation for the purpose of placing the | ||||||
16 | student in an individualized education program or a federal | ||||||
17 | Section 504 plan. | ||||||
18 | (5) Meeting with an academic advisor. | ||||||
19 | Each school district shall inform the parent or guardian of | ||||||
20 | an at-risk student about the community-based or in-school | ||||||
21 | academic support available in that school district or the | ||||||
22 | community in which the school district is located. | ||||||

12 | Section 99. Effective date. This Act takes effect upon | ||||||
13 | becoming law.
