AMENDMENT TO HOUSE BILL 97

2    AMENDMENT NO. ______. Amend House Bill 97 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Supreme Court Act is amended by changing
5Section 11 as follows:
 
6    (705 ILCS 5/11)  (from Ch. 37, par. 16)
7    Sec. 11. Marshals.
8    (a) The office of marshal for the Supreme Court is hereby
9created, such marshals to be selected by the Supreme Court, and
10the duties of such marshals shall be to attend upon its
11sittings and to perform such other duties, under the order and
12direction of the said court, as are usually performed by
13sheriffs of courts. The salary of such marshals shall be fixed
14by the judges of the Supreme Court, such salary to be payable
15from the State treasury, upon bills of particulars, signed by
16any one of the judges of the Supreme Court.

1    (b) Marshals are peace officers and have all the powers
2possessed by police officers in cities and by sheriffs.
3Marshals may exercise these powers throughout the State. No
4marshal has peace officer status or may exercise police powers
5unless: (i) he or she successfully completes the basic police
6training course mandated and approved by the Illinois Law
7Enforcement Training Standards Board; or (ii) the Illinois Law
8Enforcement Training Standards Board waives the training
9requirement by reason of the marshal's prior law enforcement
10experience or training or both.
11    (c) The office of marshal for the Supreme Court may also
12employ court security officers to be responsible for
13maintaining the security of any courthouse or courtroom
14occupied by the Supreme or Appellate Court of this State. A
15court security officer hired under this subsection is subject
16to the same training requirements and has the same authority to
17arrest as a court security officer hired by a county sheriff
18under Section 3-6012.1 of the Counties Code. However, the
19arrest powers of the court security officer are limited to the
20performance of the official duties of the court security
21officer. A court security officer who is trained and qualified
22as permitted by law may carry a weapon at his or her place of
23employment and to and from his or her place of employment. No
24court security officer authorized under this Section may
25exercise arrest powers or carry a firearm unless: (i) he or she
26successfully completes the basic police training course

1mandated and approved by the Illinois Law Enforcement Training
2Standards Board pursuant to subsection (b); or (ii) the
3Illinois Law Enforcement Training Standards Board waives the
4training requirement by reason of the individual's prior law
5enforcement experience or training or both.
