2 | | AMENDMENT NO. ______. Amend Senate Bill 3139, AS AMENDED, |
3 | | by replacing everything after the enacting clause with the |
4 | | following:

5 | | "Section 5. The Illinois Plain Language Task Force Act is |
6 | | amended by changing Sections 5, 10, 15, 20, and 25 and by |
7 | | adding Sections 30 and 35 as follows: |

9 | | Sec. 5. Purpose. The mission of the Illinois Plain Language |
10 | | Task Force is to implement, monitor, and maintain the mission |
11 | | of this Act, including developing training requirements and |
12 | | other assistance, and to conduct a study on, and to propose any |
13 | | additional legislative measures designed to realize: |
14 | | (1) the potential benefits of incorporating plain |
15 | | language in State government documents, statutes, and |
16 | | contracts into which the State enters; and |

1 | | (2) how plain language principles might be |
2 | | incorporated into the statutes governing contracts among |
3 | | private parties so as to provide additional protections to |
4 | | Illinois consumers, to reduce litigation between private |
5 | | parties over the meaning of contractual terms, and to |
6 | | foster judicial economy.

9 | | Sec. 10. Definition. As used in this Act: |
10 | | "Plain language" shall have the same meaning as "plain |
11 | | writing" as used in the federal Plain Writing Act of 2010, and |
12 | | subsequent guidance documents, including the Federal Plain |
13 | | Language Guidelines has the same meaning ascribed to it in the |
14 | | Executive Memorandum of the President of the United States, |
15 | | mandating that Federal Agencies and Federal Administrative |
16 | | Rules employ plain language, issued June 1, 1998, namely that |
17 | | "plain language" documents have logical organization, |
18 | | easy-to-read design features, and use: (i) common, everyday |
19 | | words, except for necessary technical terms; (ii) "you" and |
20 | | other pronouns; (iii) the active voice; and (iv) short |
21 | | sentences .

24 | | Sec. 15. Task Force. |

1 | | (a) The Illinois Plain Language Task Force is hereby |
2 | | created. The Illinois Plain Language Task Force shall be |
3 | | chaired by the Governor or his or her designee and shall |
4 | | consist of the following members: one member appointed by the |
5 | | Illinois Attorney General; one member appointed by the Senate |
6 | | President; one member appointed by the Minority Leader of the |
7 | | Senate; one member appointed by the Speaker of the House; one |
8 | | member appointed by the Minority Leader of the House; and 3 |
9 | | members appointed by the Governor , one of whom represents the |
10 | | interests of the banking industry, one of whom represents the |
11 | | interests of the business community, and one of whom represents |
12 | | the interests of the consumers . |
13 | | (b) Members of the Task Force must be appointed no later |
14 | | than 90 days after the effective date of this Act. |
15 | | (c) If a vacancy occurs on the Task Force, it shall be |
16 | | filled according to the guidelines of the initial appointment. |
17 | | (d) At the discretion of the chair, additional individuals |
18 | | may participate as non-voting members in the meetings of the |
19 | | Task Force. |
20 | | (e) Members of the Illinois Plain Language Task Force shall |
21 | | serve without compensation. The Office of the Governor shall |
22 | | provide staff and administrative services to the Task Force.

25 | | Sec. 20. Duties. Once all members have been appointed, the |

1 | | Task Force shall meet not less than once each quarter following |
2 | | the effective date of this Act to carry out the duties |
3 | | prescribed in this Act. An initial report delineating the Task |
4 | | Force's findings, conclusions, and recommendations shall be |
5 | | submitted to the Illinois General Assembly no later than May |
6 | | 31, 2019, unless such initial report has already been submitted |
7 | | to the General Assembly prior to the effective date of this |
8 | | amendatory Act of the 100th General Assembly. The report to the |
9 | | General Assembly shall be filed with the Clerk of the House of |
10 | | Representatives and the Secretary of the Senate in electronic |
11 | | form only, in the manner that the Clerk and the Secretary shall |
12 | | direct 9 months after the effective date of this Act . |
13 | | Thereafter, the Task Force shall make periodic recommendations |
14 | | on its own motion or at the urging of the Illinois General |
15 | | Assembly.

18 | | Sec. 25. Guidance. The Task Force shall be guided in its |
19 | | discussions on the subject of plain language by the federal |
20 | | Plain Writing Act of 2010 and subsequent guidance documents, |
21 | | including, but not limited to, the Federal Plain Language |
22 | | Guidelines the guidelines for plain language drafting |
23 | | promulgated by the President of the United States on June 1, |
24 | | 1998, which accompanied his plain language Executive |
25 | | Memorandum issued on the same day .

3 | | Sec. 30. Plain language State government communications. |
4 | | Recognizing the importance of plain language in communication |
5 | | with the public: |
6 | | (1) the General Assembly shall draft legislation and |
7 | | other public-facing documents using plain language when |
8 | | practicable; and |
9 | | (2) the executive and judicial branches of State |
10 | | government are advised to make all efforts to draft |
11 | | executive orders, court documents, and other public facing |
12 | | documents using plain language. |

14 | | Sec. 35. Construction. No provision of this Act shall be |
15 | | construed to create any right or benefit, substantive or |
16 | | procedural, enforceable by any administrative or judicial |
17 | | action. There shall be no judicial review of compliance or |
18 | | noncompliance with any provision of this Act.

19 | | Section 10. The Mahomet Aquifer Protection Task Force Act |
20 | | is amended by changing Section 20 as follows: |

1 | | Sec. 20. Report. On or before December 31 July 1 , 2018, the |
2 | | Mahomet Aquifer Protection Task Force shall report its findings |
3 | | and recommendations to the General Assembly , by filing copies |
4 | | of its report as provided in Section 3.1 of the General |
5 | | Assembly Organization Act, and to the Governor. The report to |
6 | | the General Assembly shall be filed with the Clerk of the House |
7 | | of Representatives and the Secretary of the Senate in |
8 | | electronic form only, in the manner that the Clerk and the |
9 | | Secretary shall direct.

11 | | Section 99. Effective date. This Act takes effect upon |
12 | | becoming law.".
