1 | AN ACT concerning finance.

2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Capital Development Board Act is amended by | ||||||
5 | changing Section 5 as follows:
| ||||||
6 | (20 ILCS 3105/5) (from Ch. 127, par. 775)
| ||||||
7 | Sec. 5.
The Board shall consist of 7 members, no more than | ||||||
8 | 4 of whom may
be of the same political party, all of whom shall | ||||||
9 | be appointed by the
Governor, by and with the consent of the | ||||||
10 | Senate, and one of whom shall be
designated as chairman by the | ||||||
11 | Governor. No person may be appointed as a
member of the Board | ||||||
12 | who is serving as an elected officer for the State or
for any | ||||||
13 | unit of local government within the State.
| ||||||
14 | If the Senate is not in session when the first appointments | ||||||
15 | are made,
the Governor shall make temporary appointments as in | ||||||
16 | the case of a vacancy.
In making the first appointments, the | ||||||
17 | Governor shall designate 2 members to
serve until January, | ||||||
18 | 1974, 2 members to serve until January, 1975, 2
members to | ||||||
19 | serve until January, 1976 and 1 member to serve until January,
| ||||||
20 | 1977, or until their successors are appointed and qualified. | ||||||
21 | Notwithstanding any provision of law to the contrary, the term | ||||||
22 | of office of each member of the Board is abolished on January | ||||||
23 | 31, 2019. Incumbent members holding a position on the Board on |

1 | January 30, 2019 may be reappointed. In making appointments to | ||||||
2 | fill the vacancies created on January 31, 2019, the Governor | ||||||
3 | shall designate 2 members to serve until January 31, 2021, 2 | ||||||
4 | members to serve until January 31, 2022, 2 members to serve | ||||||
5 | until January 31, 2023, and one member to serve until January | ||||||
6 | 31, 2024, or until their successors are appointed and | ||||||
7 | qualified. Their
successors shall be appointed to serve for 4 | ||||||
8 | year terms expiring on the
third Monday in January or until | ||||||
9 | their successors are appointed and
qualified. Any vacancy | ||||||
10 | occurring on the Board, whether by death,
resignation or | ||||||
11 | otherwise, shall be filled by appointment by the Governor in
| ||||||
12 | the same manner as original appointments. A member appointed to | ||||||
13 | fill a
vacancy shall serve for the remainder of the unexpired | ||||||
14 | term or until his
successor is qualified.

16 | Section 10. The Design-Build
Procurement Act is amended by | ||||||
17 | changing Section 90 as follows: | ||||||
18 | (30 ILCS 537/90) | ||||||
19 | (Section scheduled to be repealed on July 1, 2019)

20 | Sec. 90. Repealer. This Act is repealed on July 1, 2022 | ||||||
21 | July 1, 2019 .
